TheplaintiffisemployedbyCKRIndustries,aWinchestercompanythatmakesrubberwindshieldanddoorsealersforNissan.ApieceofplywoodfellonheronJanuary4,1993,andshefiledsuitallegingthatasaresult,sheistotally,permanentlydisabled.Thetrialcourtfoundotherwiseandruledthatshehasnopermanentdisability.Becausethetrialcourtsfindingisfullysupportedbytheevidence,weaffirmthedecision. Theminornatureoftheaccidentisonefactorsupportingthetrialcourtsdecision.Thefourfootbyeightfootsinglesheetofplywoodsurroundedbyametalframewasbeingusedasabulletinboardandwasstandingnexttowheretheplaintiffworked.Itonlyfelloneortwofeetontohershoulder.Theplaintiffdidnotseekanymedicaltreatmentforseveraldays. Shenevermissedanyworkonaccountoftheaccidentthatsheallegeslefthertotallyandpermanentlydisabled.Shenowworkstentotwelvehoursaday,fivedaysaweek. Themostreliablemedicalevidencedoesnotsupportherclaimofpermanentdisability.HeprimarytreatingphysicianwasDr.RayFambrough,anorthopedicsurgeoninHuntsville,Alabama.Hediagnosedtheplaintiffashaving subacromialimpingementwhichisnothingmorethanbursitisoftheshoulder.Dr.Fambroughconcludedthattheblowtotheplaintiffsshoulderdidnotinitselfcausethebursitis,butthatitexacerbatedit.Hetestifiedthatanyimpairmentfromtheblowtotheshoulderwouldbenegligible. TheplaintiffaskedforasecondopinionandwassenttoDr.RichardA.Bagby,aWinchesterorthopaedicsurgeon.Hetreatedtheplaintiffandsenthertophysicaltherapy.Heconcludedthattheplaintiffhasnopermanentimpairment. Thetestimonyofthethreeotherdoctorswhosawtheplaintiffisasinconclusiveasitispredictable.Dr.JamesP.Anderson,aNashvilleneurologistwhosawtheplaintiffforthefirsttimeoverayearaftertheaccident,testifiedthattheplaintiffhasa13%wholebodyimpairment.Thecompanyselectedneurologist,Dr.RichardRubinowicz,contradictedAndersonsdiagnosisandconcludedthattheplaintiffhasnopermanentimpairment.Thedoctortheplaintiffslawyerselected,Dr.RichardFishbein,foundpermanentimpairment. Thoughweaffirmthetrialcourtsdecisiondenyingcompensation,weconcludethatitwaserrorforthetrialcourttohaveorderedtheemployertopayfortheplaintiffsvisitstoDr.Andersonandtopayfortheexpensivetestsheordered.CKRIndustriesprovidedmedicalcaretotheplaintiffincompliancewiththeworkerscompensationstatute,Tenn.CodeAnn.506204.WhentheplaintiffwantedanopinioninadditiontoDr.Fambroughs,theemployerpaidforhertobeseenandtreatedbyDr.Bagby.TheplaintiffsuseofDr.Andersontookplacecompletelyoutsidetheproceduremandatedbythestatute,andthereisnojustificationforrequiringtheemployertopayforit.Buchananv.MissionInsuranceCo,713S.W.2d654,657(Tenn.1986). TheplaintiffcomplainsbecausethetrialcourtdidnotmakeacontingentfindingofdisabilityassuggestedbythisCourtinBradenv.Sears,RoebuckandCompany,833S.W.2d496,499(Tenn.1992).Wemustnote,respectfully,thattheplaintiffmisconstruesthesuggestioninBraden.󛀀Therethetrialcourtdeniedworkerscompensationafterfindingthattheaccidentdidnotariseoutoftheemployment.Wemerelysuggestedthatwhenthetrialcourtmakessuchadecision,acontingentfindingontheextentofpermanentdisabilitywillpreventaremandforanewtrialintheeventthedecisiondenyingworkerscompensationisoverturedonappealasitwasinBraden. Therearemanysituationsinwhichatrialcourtmightfindthatthereispermanentdisability,butatthesametimeforsomeotherreasonfindthattheworkerisnotentitledtocompensation.Failureoftheworkertogivetimelynoticeisonesituation.Failuretotimelyfilesuitisanother.Disqualifyingmisconductisstillanother,orthattheaccidentdidnotariseoutoftheemployment,asthetrialcourtfoundinBraden.󛀀Butwhenthetrialcourthasfoundthattheplaintiffhasnotprovenpermanentdisability,thetrialcourtcannotatthesametimemakeacontingentfindingontheextentofpermanentdisability. Finally,theplaintiffcomplainsbecausethetrialcourtdidnotgrantanewtrialafteritwaspointedoutthatonlytheplaintiffsshoulderinjurycasewastobedecided.Theplaintiffhadanotherinjury,andthetrialcourtapparentlymisunderstoodcounselsstipulationanddecidedbothcases.Buttheconfusionwasclearedupinanamendedjudgment,sotherewasnoreasonforanewtrial.
