TheplaintiffreportedthathehadinjuredhisbackonMay4,1993.Thetrialjudgefoundtheplaintiffhadfailedtoshowbyapreponderanceoftheevidencethathehadsustainedapermanentimpairmentanddismissedthecomplaint. Weaffirmthejudgmentofthetrialcourt. Theundisputedevidenceshowstheplaintiffsufferedfromspinalstenosis,amanifestationoftheagingprocess,whichisnormalforapersonoftheageof62,theageofplaintiff.ThematerialevidenceconsistsofthedepositiontestimonyofDr.RogerRay,aneurosurgeon,andaCTscandoneatCrockettHospital. Dr.Ray,whenaskedondirectquestioning,testifiedtheplaintiffsustainedatenpercentwholebodyimpairmentasaresultoftheallegedbackinjury.ThefindingwasbaseduponthetestinggiventohimanduponhisevaluationoftheplaintiffandreviewoftheCTscanreport. Oncrossexamination,Dr.Raytestifiedhedidnotusethe4thEditionoftheAMAGuidestodeterminethedisabilityoftheplaintiff,buttestifiedhethoughtheusedthe3rdedition.Dr.RaystestimonywaslessthanclearonwhetherheusedϜanyeditionoftheGuidelines. TheultimateoutcomeofthetestimonyofDr.RayandthefindingoftheCTscanisthattheplaintiffsufferedfromspinalstenosis,whichwasnotcausedbytheinjuryatwork.Atmost,theinjuryonlycausedtheplaintifftosufferpain.TheplaintiffwasreleasedbyDr.Raytoreturntoworkwithoutanylimitations. Fromtherecord,wefindtheplaintiffsufferedfromanunderlyingconditionthatwasnotcausedbytheemployment.Atmost,theplaintiffhas,byhisownreport,sufferedonlypain.Thereisnoevidencetheemploymentcausedanyprogressionoraggravationoftheunderlyingcondition,butonlycausedpain.Thisisnotcompensable.Cunninghamv.GoodyearTireandRubberCo.,811S.W.2d888(Tenn.1991).SeealsoTownsendv.State,826S.W.2d434(Tenn.1992). Theplaintiffhastheburdenofshowingbycompetentevidenceeveryessentialelementtosupportaclaimforcompensation.Tindallv.WaringParkAssoc.725S.W.2d935(Tenn.1987).Thisincludestheobligationtoshowbyapreponderanceoftheevidencethataninjuryaroseoutofandinthecourseoftheplaintiffsemploymentand,torecoverforpermanentvocationaldisability,theplaintiffmustshowapermanentimpairmenthasresultedfromtheinjury. Theplaintiffinthiscasehasfailedtoshowhesustainedapermanentimpairmentasaresultofaworkrelatedinjury. Wefindnoerrorinthetaxingofcostsinthetrialcourttoplaintiff.
