àPlaintiff€injured€her€left€arm€at€work€on€February€28,€1992.€When€surgery€didÏœnot€improve›€the€œcondition›€or€decrease€her€pain€she€became€markedly€depressed.Ìà àThe€trial€court€found€that€plaintiffððs€depression€was€related€to€her€arm€injuryÏand€awarded€her€100€percent€permanent€œtotal€disability›€based€on€the€twoÏconditions.€€Ìà àœWe›€affirm€the€judgment€of€the€trial€court.Ìà àPlaintiff€injured€her€left€arm€gradually€at€work€in€February,€March€and€April€ofÏ1992.€She€was€left€hand€dominant€and€her€work€required€that€she€use€a€staple€gunÏrepetitively.€€Dr.€Joseph€C.€DeFiore,€Jr.,€orthopedic€surgeon,€treated€her€left€elbowÏand€shoulder€from€April€13,€1992€through€January€24,€1994.€€Ìà àWhen€Dr.€DeFiore€first€saw€plaintiff,€he€found€tenderness€over€the€left€lateralÍepicondyle€area€and€in€her€left€shoulder,€with€no€specific€abnormalities€on€x„ray.€HeÏdiagnosed€tendinitis€of€the€left€shoulder€and€lateral€epicondylitis,€or€tennis€elbow.€ÏPlaintiff€also€reported€being€extremely€depressed,€primarily€because€of€the€elbowÏproblem.€€A€work„related€low€back€injury€contributed€to€her€depression,€but€we€doÏnot€consider€that€injury,€which€was€non„suited€at€trial.€€Ìà àDr.€DeFiore€advised€plaintiff€to€avoid€use€of€a€staple€gun€at€work,€which€heÏthought€was€causing€some€of€her€irritation,€gave€her€a€TENS€unit€for€pain€controlÏand€prescribed€exercises.€€Plaintiff€returned€to€work€with€the€limitation€that€she€doÏonly€œnonrepetitive›,€non„overuse€work€with€the€left€upper€extremity.€€The€work€sheÏwas€assigned,€though€much€less€harmful€according€to€Dr.€DeFiore,€still€required€herÏto€constantly€reach€with€her€left€hand€and€arm€in€order€to€spray€television€cabinetsÏwith€an€air€pressure€gun.Ìà àPlaintiff€continued€to€have€pain€in€the€elbow€and€therefore€had€cortisoneÏinjections€on€three€occasions,€with€no€improvement.€€Bone€scan€found€arthritis€inÏthe€shoulder€joint.€€Ìà àPlaintiff€was€deposed€by€defendant€on€October€19,€1992,€and€it€wasÏapparently€here€that€both€partiesðð€counsel€learned€from€plaintiff€aboutÏantidepressant€medications€given€to€her€by€her€family€physician€on€a€continuingÏbasis€since€her€first€Ñ ° Ñwork„related€[back]€injury€in€1991.€€Plaintiffððs€counsel€requestedÏdefense€counsel€to€provide€a€list€of€psychologists€or€psychiatrists,€and€defenseÏcounsel€replied,€ð ðSheððll€have€to€go€back€to€one€of€the€family€doctors,€or€one€of€theÏoriginal€panel€doctors€and€theyððll€make€the€referral.ðð€€Defense€counsel€furtherÏadvised,€ð ðJust€see€Dot.€€Sheððll€set€up€an€appointment€with€one€of€them.ðð€€PlaintiffÍtestified€that€she€asked€Dot€[company€nurse]€for€a€referral€to€a€psychiatrist€and€DotÏrefused.€€Doug€Linebarger,€Human€Resources€Manager,€testified€that€Dot€would€notÏhave€had€authority€to€make€such€a€referral.€€Moreover,€we€note€that€plaintiff€hadÏbeen€receiving€antidepressant€medications€from€an€employer„approved€familyÏpractitioner€who€had€never€felt€it€necessary€to€refer€her€to€a€psychologist€orÏpsychiatrist.Ìà àWhen€plaintiff€saw€orthopedic€surgeon€Dr.€Sidney€L.€Wallace€three€monthsÏlater€(December€8,€1992)€for€alleged€work„related€back€problems,€he€found€that€inÏaddition€to€her€back€problems,€she€was€ð ðquite€depressed€.€.€.€slightly€tearful€.€.€.€veryÏslow€and€lethargic€in€her€movement€.€.€.€and€speech€.€.€.€obvious€difficulty€with€shortÏterm€memory€.€.€.€ð ð€He€told€plaintiff€she€needed€to€consult€a€psychiatrist€about€theÏdepression.€Ìà àOn€August€2,€1993€Dr.€DeFiore€performed€surgical€release€of€the€musclesÏand€annular€ligament€and€removal€of€the€ð ðbump€of€boneðð€off€the€side€of€her€elbowÏ(ð ðtennis€elbow€procedureðð).€€Postoperatively,€plaintiff€started€an€exercise€andÏstrengthening€program.€€She€continued€to€complain€of€pain€in€the€elbow€and€theÏshoulder.€€Dr.€DeFiore€placed€her€on€anti„inflammatory€medication,€which€she€foundÏshe€could€not€take€because€of€stomach€complications.€Therefore,€pain€relief€was€notÏobtained.Ìà àBy€November,€1993,€she€had€reached€maximum€medical€improvement€of€theÏelbow,€but€had€continuing€pain€in€both€the€elbow€and€the€shoulder.€€X„ray€showedÏpost„surgical€arthritic€changes€in€the€shoulder€joint.€Dr.€DeFiore€referred€her€to€hisÏpartner,€Dr.€Mathien,€who€specializes€in€shoulder€injuries,€for€evaluation.Ìà àDr.€Mathien€saw€plaintiff€on€December€17,€1993€and€opined€she€had€someÏrotator€cuff€tendinitis€and€impingement€syndrome€but€he€did€not€feel€there€was€anyÏsurgical€remedy€at€that€time.€€He€gave€her€a€steroid€injection€and€told€her€there€wasÏnothing€further€he€could€do.ÌÑ Ð Ñà àDr.€DeFiore€last€saw€plaintiff€on€January€24,€1994.€€He€opined€she€hadÏreached€maximum€medical€improvement€as€to€the€left€arm€and€ordered€a€functionalÏcapacity€evaluation.€€He€opined€that€any€type€of€repetitive€activity,€especially€withÏthe€shoulder,€should€be€avoided.€€He€limited€her€lifting€activities€to€occasionally€11Ïpounds,€frequently€eight€pounds,€and€continuously€four€pounds.€€He€recommendedÏshe€have€a€one„handed€type€of€job,€mainly€using€her€right€hand.€€He€assessedÏseven€percent€impairment€of€the€left€upper€extremity€based€on€the€AMA€Guides€toÏthe€Evaluation€of€Permanent€Impairment.Ìà à€€Plaintiff€first€saw€Dr.€Martin€Gebrow,€psychiatrist,€on€November€8,€1993.€€AtÏtrial,€she€testified€that€she€had€never€seen€a€psychiatrist€until€.€.€.€ð ðWell,€I€got€someÏdepressed€after€I€hurt€my€back,€and€then€after€I€hurt€my€arm€and€seeing€I€wasnððtÏgoing€to€be€able€to€use€my€arm,€I€was€threatening€to€kill€myself.ððÌà àDr.€Gebrowððs€record€of€plaintiffððs€first€office€visit€indicates€she€was€havingÏcrying€spells,€poor€sleeping,€decreased€ability€to€concentrate,€thoughts€of€suicide,Ïpoor€memory,€and€having€to€push€to€get€anything€done.€€He€diagnosed€majorÏdepression€caused€by€unremitting€chronic€pain€from€work„related€injuries.€€HerÏdepression€was€increased€by€the€fact€that€she€could€not€work,€which€caused€herÏfinancial€condition€and€her€self„esteem€to€deteriorate.€€Ìà àDr.€Gebrow€continued€seeing€plaintiff€up€to€the€time€of€trial,€and€opined€thatÏshe€was€actually€getting€worse,€not€better,€because€of€the€unremitting€pain,€theÍstress€of€having€the€employer€refuse€to€pay€her€medical€bills,€and€the€prospect€of€anÏupcoming€trial.€€When€he€last€saw€her€before€trial,€he€noted€chronic€pain,Ïdepression€with€suicidal€ideation,€decreased€intellectual€functioning,Ïdisorganization€of€thought€and€impaired€ability€to€concentrate€due€to€depressionÏand€anxiety.€€He€opined€she€was€Class€IV,€Markedly€Depressed,€that€she€wouldÏcontinue€to€be€depressed€and€require€treatment,€and€that€she€would€improve€only€ifÏher€pain€decreased.€€He€opined€her€prognosis€was€poor€and€she€was€totally€andÏpermanently€disabled€from€work.Ìà àThe€trial€court€found€plaintiff€to€be€permanently€and€totally€disabled€as€aÏresult€of€the€left€arm€injury€and€psychiatric€condition.€€ÌœÌÌÑ ° ÑThe›€employer€appeals,€raising€two€issues:ÌÓÓà8 àI.€€THE€MEDICAL€EVIDENCE€OF€A€MENTAL/EMOTIONALÏIMPAIRMENT€COULD€NOT€SUSTAIN€AN€AWARD€FOR€DISABILITYÏBENEFITS€UNDER€THE€TENNESSEE€WORKERSðð€COMPENSATIONÏLAW.€ÌÌà8 àII.€€THE€TRIAL€COURT€ERRED€IN€AWARDING€THE€COSTSÏASSOCIATED€WITH€TREATMENT€BY€œDR›.€GEBROW.ÌÌÓÓà àOur€review€of€the€findings€of€fact€made€by€the€trial€court€is€òòde€novoóó€upon€theÏrecord€of€the€trial€court,€accompanied€by€a€presumption€of€the€correctness€of€theÏfindings,€unless€the€preponderance€of€the€evidence€is€otherwise.€€òòTenn.€Code€Ann.€ððóóÏ50„6„225(e)(2).€€òòStone€v.€City€of€McMinnville,€óó896€S.W.2d€584€(Tenn.€1991).€Ìà àThe€extent€of€vocational€disability€is€a€question€of€fact€to€be€determined€fromÏall€of€the€evidence,€including€lay€and€expert€testimony.€€òòWorthington€v.€Modine€Mfg.ÍCo.,óó€798€S.W.2d€232,€234€(Tenn.€1990).Ìà à€Where€the€trial€judge€has€made€a€determination€based€upon€the€testimony€ofÏwitnesses€whom€he€has€seen€and€heard,€great€deference€must€be€given€to€thatÏfinding€in€determining€whether€the€evidence€preponderates€against€the€trial€judgeððsÏdetermination.€€òòSeeóó€òòHumphrey€v.€David€Witherspoon,€Inc.,€óó734€S.W.2d€315€(Tenn.Ï1987).€€œPlaintiffððs€testified€that€she€did€not€return€to€work€after€her€shoulder€surgeryÏbecause€she€was€unable€to€work.€The€employerððs€Human€Resource€ManagerÏtestified€that€if€plaintiff€had€attempted€to€return€to€work€he€would€have€given€her€workÏshe€could€do.€He€stated€that€the€companyððs€policy€is€to€find€work€that€an€injuredÏworker€can€do€on€a€trial€basis,€so€that€she€can€earn€income€and€have€socialÏcontacts,€thereby€hopefully€improving€her€physical€condition€and€her€depression.€ÏAlthough€acknowledging€that€the€employer€would€not€have€allowed€her€to€do€ð ðhalfÏworkðð€indefinitely,€he€testified€that€they€would€have€worked€with€her€to€improve€theÏsituation.€€The›€trial€judge€found€plaintiff€to€be€ð ða€22„year€honest€employee€of€theÏdefendant.ðð€€He€found€her€lay€testimony€to€be€credible€and€that€what€she€told€herÏpsychiatrist€was€consistent€with€the€medical€reports€of€her€other€doctors.Ìà àœThe›€medical€evidence€of€disability€was€presented€œby€plaintiff€through›€threeÏdepositions€and€copies€of€medical€records.€œDefendant€presented€no€medicalÏevidence.›Ìà àDr.€DeFioreððs€deposition€addressed€only€plaintiffððs€arm€injury€because€that€isÏthe€only€condition€he€treated.€€He€assessed€7€percent€permanent€partial€disability€toÏthe€left€upper€extremity€according€to€the€AMA€Guides.Ìà àDr.€Gebrow€was€deposed€twice,€on€January€5,€1995€and€again€on€June€28,Í1995.€€At€the€first€deposition€he€opined€that€plaintiff€was€markedly€depressed€but€heÏdeclined€to€assess€permanent€total€disability,€stating€that€her€psychiatric€conditionÏwould€improve€if€ð ðweðð€can€get€rid€of€the€symptoms€and€pain€from€her€injuries.€Ïà àœà àWhen›€he€was€deposed€six€months€later,€Dr.€Gebrow€opined€thatÏplaintiff€had€not€improved€and€he€thought€she€was€probably€€ð ðas€good€as€sheððll€get.ðð€ÏHer€pain€was€worse,€and€she€complained€bitterly€about€it.€She€could€not€get€painÏrelief€because€she€could€not€take€non„steroid€anti„inflammatory€medication.€€HerÏdepression€was€worse€and€she€was€becoming€more€reclusive.€€She€had€moreÏfrequent€crying€spells,€could€not€sleep,€and€in€his€office€was€quiet€and€non„spontaneous.€€He€felt€her€prognosis€was€poor.€€He€opined€she€was€permanentlyÏand€totally€disabled.Ìà àWhere€the€expert€medical€testimony€is€presented€by€deposition,€this€Court€isÏable€to€make€its€own€independent€assessment€of€the€medical€proof€to€determineÏwhere€the€preponderance€of€the€evidence€lies.€€òòCooper€v.€INA,€óó884€S.W.2d€446Ï(Tenn.€1994).€€Ìà àOur€independent€review€of€the€three€medical€depositions€reveals€that€theÏplaintiff€was€indeed€markedly€depressed€with€a€poor€prognosis€for€recovery.€ÏDefendant€has€provided€absolutely€no€expert€medical€proof€to€œrebut›€Dr.€GebrowððsÏœassessment€to€that€effect.›€€Therefore,€the€œplaintiff€has€proved,€by€a€preponderance€ofÏthe€lay€evidence,€and€by€all€of€the€unrebutted€medical€evidence,€that€she€is€totallyÏand€permanently€vocationally€disabled.›Ìœ›à àDefendant€argues€that€the€costs€associated€with€the€treatment€by€Dr.€GebrowÏis€not€compensable€because€he€was€not€an€approved€physician.€€The€evidence€isÍabundant€that€plaintiff€needed€psychiatric€care,€that€an€approved€orthopedicÏsurgeon€directed€her€to€get€such€care,€that€she€told€the€company€nurse€she€neededÏthe€care,€and€that€the€company€nurse€refused€to,€and€in€fact€had€no€authority€to,Ïmake€the€necessary€referrals.€€We€agree€with€the€trial€court€that€plaintiff€met€herÏresponsibility€under€òòTenn.€Code€Ann.€ððóó50„6„204€and€the€defendant€failed€to€meet€itsÏresponsibility.€Therefore€the€trial€court€did€not€err€in€awarding€costs€and€futureÏmedical€expenses€for€plaintiffððs€treatment€by€Dr.€Gebrow.Ìà
