àThis€workers'€compensation€appeal€has€been€referred€to€theÏSpecial€Workers'€Compensation€Appeals€Panel€of€the€Supreme€Court€inÏaccordance€with€Tenn.€Code€Ann.€section€50„6„225(e)(3)€for€hearing€andÏreporting€of€findings€of€fact€and€conclusions€of€law.€€The€appellants€contendÏ(1)€the€award€of€permanent€partial€disability€benefits€is€excessive,€(2)€it€wasÏerror€for€the€trial€judge€to€become€a€witness€in€the€case€and€(3)€the€trialÏjudge€abused€his€discretion€by€commuting€permanent€partial€benefits€to€aÏlump€sum.€€As€discussed€below,€the€panel€has€concluded€the€award€ofÏpermanent€partial€disability€benefits€should€be€modified€and,€as€modified,Ïpaid€in€a€lump€sum,€and€the€evidential€remarks€of€the€trial€judge€wereÏharmless€in€light€of€our€modification.Ìà àThe€claimant,€Kay€Eugene€Blackwood,€Jr.,€is€thirty„nine€yearsÏold€with€a€high€school€education€and€vocational€training€as€an€automobileÏmechanic€and€some€college€training€as€a€minister€of€the€gospel.€€HeÏgradually€developed€bilateral€carpal€tunnel€syndrome€from€the€repetitive€useÏof€his€hands€at€work€for€employer,€Berkline.€€The€employer€referred€him€toÏDr.€James€B.€Talmage.Ìà àà àThe€doctor€diagnosed€bilateral€carpal€tunnel€syndrome€andÏprescribed€braces€for€both€wrists.€€He€restricted€the€claimant€from€repetitiveÏwork€with€his€right€hand€and€recommended€wearing€the€braces€whileÏsleeping.€€The€claimant€was€totally€disabled€for€several€weeks.€€The€doctorÍassigned€zero€percent€permanent€impairment,€but€acknowledged€some€lossÏof€grip€strength€and€conceded€that,€on€the€basis€of€lost€grip€strength,€theÏAMA€Guidelines€provided€twenty€percent€permanent€impairment€to€theÏright€arm€and€ten€percent€to€the€left,€using€a€method€the€doctor€consideredÏinappropriate.€€Dr.€Talmage€did€not€concede€the€loss€of€grip€strength€wasÏpermanent.Ìà àà àDr.€Randy€Gaw,€a€neurologist,€diagnosed€mild€right€carpalÏtunnel€syndrome€but€found€no€evidence€of€"left€median€nerveÏmononeuropathy"€or€"generalized€neuropathic€or€myopathic€processÏinvolving€the€upper€extremities."€€The€claimant€returned€to€work€for€theÏemployer.€€Dr.€S.€M.€Smith,€who€did€not€treat€the€claimant€but€evaluatedÏhim,€diagnosed€moderate€carpal€tunnel€syndrome€on€the€right€and€mildÏcarpal€tunnel€syndrome€on€the€left.€€He€assigned€twenty€percent€permanentÏimpairment€to€the€right€hand€and€ten€percent€to€the€left.Ìà àà àThe€trial€court€awarded,€among€other€things,€permanent€partialÏdisability€benefits€based€on€fifty€percent€to€each€arm,€commuted€to€a€lumpÏsum.€€Appellate€review€is€de€novo€upon€the€record€of€the€trial€court,Ïaccompanied€by€a€presumption€of€correctness,€unless€the€preponderance€ofÏthe€evidence€is€otherwise.€€Tenn.€Code€Ann.€section€50„6„225(e)(2).€€ThisÏtribunal€is€required€to€conduct€an€independent€examination€of€the€record€toÏdetermine€where€the€preponderance€of€the€evidence€lies.€€òòWingert€v.ÏGovernment€of€Sumner€Countyóó,€908€€S.W.2d€€921€(Tenn.€1995).€€The€panelÏis€as€well€situated€to€gauge€the€weight,€worth€and€significance€of€depositionÏtestimony€as€the€trial€judge.ÌÓ àOnce€the€causation€and€permanency€of€an€injury€have€beenÏestablished€by€expert€testimony,€many€pertinent€factors,€including€age,€jobÏskills,€education,€training,€duration€of€disability,€and€job€opportunities€forÏthe€disabled,€in€addition€to€anatomical€impairment,€may€be€considered€forÏthe€purpose€of€evaluating€the€extent€of€a€claimant's€permanent€disability.€ÏTenn.€Code€Ann.€section€50„6„241(a)(2).€€From€a€consideration€of€theÍpertinent€factors€established€in€this€record,€and€in€light€of€the€fact€that€onlyÏone€of€the€three€doctors€who€saw€the€claimant€assigned€any€permanency,€weÏare€persuaded€the€evidence€preponderates€against€an€award€based€on€fiftyÏpercent€permanent€impairment€to€each€arm€and€in€favor€of€one€based€onÏtwenty€percent€to€both€arms.€€The€judgment€is€modified€accordingly.ÌÓ
