àBefore€addressing€the€issues,€we€will€discuss€the€evidenceÏfound€in€the€record.ÌÌà àThe€plaintiff€is€a€lady€thirty„one€years€of€age€at€the€time€ofÏtrial.€€She€completed€high€school€and€before€her€employment€for€theÏdefendant,€she€worked€as€a€cashier€in€a€hardware€store€and€didÏoffice€work.€€She€worked€for€the€defendant€for€nine€years€as€aÏproduction€worker.€€Her€work€required€her€to€pick€up€motors,Ïweighing€from€twenty€to€forty€pounds€each,€placing€them€on€aÏmachine€and€then€placing€the€motors€on€the€production€line.€€SheÍpicked€up€from€three€hundred€and€fifty€to€seven€hundred€motors€perÏday,€depending€on€which€line€she€was€working.€€It€is€not€entirelyÏclear,€but€apparently€she€was€required€to€lift€each€motor€twice.€€ÌÌà àIn€September,€1993,€the€plaintiff€began€experiencing€pain€inÏboth€arms,€numbness€in€both€hands€and€pain€in€her€right€shoulder€andÏneck.€€She€testified€that€she€reported€her€condition€to€her€employerÏwho€offered€her€a€choice€of€physicians.€€She€selected€Dr.€JimÏRobertson€who€gave€her€medication€but€she€did€not€improve.€€Dr.ÏRobertson€then€sent€her€to€Dr.€Dwight€Norman€for€treatment.€€X„raysÏof€the€shoulder€were€normal€and€Dr.€Norman€then€referred€her€to€Dr.ÏMichael€Cobb.Ìà àÌà àDr.€Cobb€treated€the€plaintiff€for€a€period€of€time€and€she€wasÏthen€sent€to€Dr.€Robert€H.€Miller,€an€orthopedic€surgeon€withÏCampell's€Clinic€in€Memphis,€Tennessee.€€Dr.€Miller€desired€a€nerveÏconduction€study€but€the€employer€sent€the€plaintiff€to€Dr.€RonÏBingham€of€Jackson,€Tennessee€to€conduct€these€tests.€€The€plaintiffÏtestified€that€the€defendant€refused€her€request€to€continue€to€seeÍDr.€Miller.ÌÌà àThe€plaintiff€was€then€sent€to€Dr.€Glenn€Barnett,€aÏneurosurgeon€with€Semmes€Murphy€Clinic€in€Jackson,€Tennessee,Ïafter€Dr.€Bingham€had€diagnosed€carpel€tunnel€syndrome€in€bothÏarms.€€Dr.€Barnett€performed€surgery€on€both€arms€in€May€and€June,Ï1994.€€She€testified€that€she€continued€to€have€pain€with€her€neckÏand€shoulders,€as€well€as€her€arms€and€hands.ÌÌà àDr.€Barnett€released€the€plaintiff€for€work€on€June€28,€1994,Ïand€she€worked€until€October,€1994.€€On€September€20,€1994,€sheÏreturned€to€Dr.€Barnett€for€further€treatment€and€he€advised€her€thatÏhe€had€nothing€further€to€offer€to€her.€€The€defendant€placed€theÏplaintiff€on€group€disability€from€October€24,€1994,€through€April€2,Ï1995.€€ÌÌà àOn€April€3,€1995,€she€returned€to€her€work€and€quit€after€twoÏdays.€€She€testified€that€there€was€no€job€that€she€could€do€forÏTecumseh.€€She€testified€that€she€quit€because€she€couldn't€do€theÍlifting€and€straining€due€to€her€injuries.ÌÌà àAt€the€time€of€trial,€she€was€working€part€time€as€a€teller€atÏMcKenzie€Banking€Company.€€She€testified€that€her€neck,€shouldersÏand€arms€continued€to€hurt€and€that€both€arms€are€"real€weak"€butÏher€hands€are€not€numb€since€her€surgery.€€She€testified€that€ifÏoffered€a€full€time€job€at€the€bank,€she€intends€to€attempt€to€do€theÏwork.€€ÌÌà àThe€plaintiff€testifies€that€she€walks€three€miles€every€otherÏday,€mows€the€yard€with€a€riding€lawn€mower,€cooks,€washes€clothesÏand€dishes€and€drives€a€car€with€her€arms€down.€€She€testified€thatÏshe€cannot€do€her€work€as€a€teller€without€hurting€in€her€neck,Ïshoulders€and€arms.€€She€testified€that€she€cannot€help€her€husbandÏwash€the€car,€play€frisbee€with€the€children€or€do€anything€using€herÏarm€and€neck€muscles.€€When€she€does€anything€stressful,€she€mustÏgo€to€bed.ÌÌà àThe€plaintiff's€husband€corroborated€her€testimony,€adding€thatÍhis€wife€is€mentally€depressed€because€she€is€unable€to€do€thingsÏshe€could€do€previously.€€He€massages€her€neck€and€back€with€aÏmassaging€machine€nearly€every€night.€€Before€this€difficulty€cameÏon,€she€was€a€very€cheerful€person.ÌÌà àBy€stipulation,€reports€and€records€of€doctors€were€submittedÏin€evidence€in€lieu€of€their€testimony.€€No€doctor€testified€either€byÏdeposition€or€oral€testimony€but€the€reports€and€records€of€eightÏdoctors€were€submitted.ÌÌà àWe€will€not€attempt€to€burden€this€opinion€with€detailÏdiscussion€of€all€of€these€medical€reports.€€In€summary,€Dr.ÏRobertson€thought€that€she€had€a€muscle€strain€of€the€shoulder.€€HisÏassociate,€Dr.€Norman,€made€x„rays€of€the€shoulder€which€wereÏnormal€and€referred€the€plaintiff€to€Dr.€Cobb.€€Dr.€Cobb's€impressionÏwas€right€shoulder€strain€with€scapular€snapping€syndrome€and€afterÏtreating€her€with€medication€and€physical€therapy,€he€referred€her€toÏDr.€Miller.€€Dr.€Miller€diagnosed€her€as€having€fibromyalgia€andÏordered€nerve€condition€study€which€was€done€by€Dr.€Ron€Bingham.€ÍDr.€Bingham's€testing€resulted€in€positive€findings€of€carpel€tunnelÏsyndrome€in€both€hands€and€wrists.ÌÌà àThe€plaintiff€was€then€referred€to€Dr.€Glen€Barnett€whoÏperformed€surgery€on€both€arms.€€Dr.€Barnett€was€of€the€opinion€thatÏthe€plaintiff€sustained€5%€anatomical€impairment€to€each€arm.€ÏApparently€he€found€no€permanent€impairment€because€of€theÏdifficulty€in€the€plaintiff's€neck€and€shoulder€area,€stating€thatÏthese€difficulties€"are€difficult€to€completely€define."ÌÌÌà àAfter€she€was€discharged€by€Dr.€Barnett€and€the€defendantÏrefused€further€medical€treatment,€the€plaintiff€went€to€Dr.€Terry€O.ÏHarrison,€her€family€physician.€€Dr.€Harrison€was€of€the€opinion€thatÏthe€plaintiff's€pain€in€the€back,€neck€and€shoulders€is€secondary€toÏthe€repetitive€motion€of€her€job.€€He€referred€her€to€Dr.€Ray€W.ÏHester.ÌÌà àDr.€Hester€opined€June€20,€1995,€that€plaintiff€had€reachedÍmaximum€medical€improvement€and€had€sustained€a€10%€impairmentÏto€the€body€as€a€whole€as€a€result€of€her€neck,€hands€and€arms.€€HisÏdiagnosis€was€chronic€pain.€€He€placed€restrictions€of€no€bendingÏfrom€the€waist€while€standing,€no€working€with€her€hands€out€inÏfront€of€her€and€no€repetitive€lifting€over€3„4€pounds.€€He€stated€thatÏshe€had€chronic€tendinitis.€€ÌÌà àUnder€the€first€issue,€we€must€determine€whether€theÏlimitations€of€two€and€one„half€times€the€anatomical€rating€as€setÏinà àT.C.A.€ðð€50„6„241(a)(1)€applies.€€That€code€section€provides:ÓÓÌÌà8 à50„6„241.€€Maximum€permanent€partial€disability€awardÏfor€causes€arising€on€or€after€August€1,€1992€„ÏReconsideration€of€industrial€disability€issue.Ìà8 àÌà8 àà à(a)à à(1)€€For€injuries€arising€on€or€after€August€1,Ï1992,€in€cases€where€an€injured€employee€is€eligible€toÏreceive€any€permanent€partial€disability€benefits,Ïpursuant€to€ðð€50„6„207(3)(A)(i)€and€(F),€and€the€pre„injury€employer€returns€the€employee€to€employment€at€aÏwage€equal€to€or€greater€than€the€wage€the€employee€wasÏreceiving€at€the€time€of€injury,€the€maximum€permanentÏpartial€disability€award€that€the€employee€may€receiveÏis€two€and€one„half€(2„1/2)€times€the€medicalÏimpairment€rating€determined€pursuant€to€the€provisionsÏof€the€American€Medical€Association€Guides€to€theÏEvaluation€of€Permanent€impairment€(American€medicalÍAssociation),€the€Manual€for€Orthopedic€Surgeons€inÏEvaluating€Permanent€Physical€Impairment€(AmericanÏAcademy€of€Orthopedic€Surgeons),€or€in€cases€not€coveredÏby€either€of€these,€an€impairment€rating€by€anyÏappropriate€method€used€and€accepted€by€the€medicalÏcommunity.€€In€Making€determinations,€the€court€shallÏconsider€all€pertinent€factors,€including€lay€and€expertÏtestimony,€employee's€age,€education,€skills€and€training,Ïlocal€job€opportunities,€and€capacity€to€work€at€types€ofÏemployment€available€in€claimant's€disabled€condition.Ìà8 àT.C.A.€ðð€50„6„241(a)(1)€is€not€construed€in€any€publishedÏcases.€ÌIn€our€opinion,€this€code€section€is€not€applicable€when€an€employerÏoffers€an€employee€a€job€equal€to€or€greater€than€the€wage€theÏemployee€was€receiving€at€the€time€of€injury,€and€the€employee€isÏunable€to€sustain€such€employment€because€of€the€injury.€€On€theÏother€hand,€an€employee€cannot€avoid€the€effect€of€this€code€sectionÏby€refusing€an€offer€of€employment€which€he€or€she€is€able€to€do.€€AnÏunsuccessful€trial€by€an€employee€to€resume€employment€will€notÏinvoke€the€provisions€of€the€above€code€section€when€it€laterÏdevelops€that€the€employee€cannot€continue€the€employment€becauseÏof€the€accidental€injury.ÌÌà àThis€code€section€must€be€construed€in€òòpari€materiaóó€with€T.C.A.Ïðð€50„6„241(a)(2):Ìà8 àÓÓIn€accordance€with€this€section,€the€courts€mayÏreconsider€upon€the€filing€of€a€new€cause€of€action€theÏissue€of€industrial€disability.€€Such€reconsideration€shallÏexamine€all€pertinent€factors,€including€lay€and€expertÏtestimony,€employee's€age,€education,€skills€and€training,Ílocal€job€opportunities,€and€capacity€to€work€at€types€ofÏemployment€available€in€claimant's€disabled€condition.€ÏSuch€reconsideration€may€be€made€in€appropriate€casesÏwhere€the€employee€is€no€longer€employed€by€the€pre„injury€employer€and€makes€application€to€the€appropriateÏcourt€within€one€(1)€year€of€the€employee's€loss€ofÏemployment,€if€such€loss€of€employment€is€within€fourÏhundred€(400)€weeks€of€the€day€the€employee€returned€toÏwork.€€In€enlarging€a€previous€award,€the€court€must€giveÏthe€employer€credit€for€prior€benefits€paid€to€theÏemployee€in€permanent€partial€disability€benefits,€andÏany€new€award€remains€subject€to€the€maximumÏestablished€in€subsection€(b).ÌÌÓÓÌà àWhen,€as€in€this€case,€the€employee€is€at€the€time€of€trial€andÏat€the€time€of€filing€suit€no€longer€employed€and€comes€within€theÏtime€frame€of€ðð€(a)(2),€there€is€no€logic€or€purpose€in€enteringÏjudgment€within€the€two€and€one„half€times€medical€impairmentÏlimit€of€(a)(1),€then€entertaining€another€proceeding€pursuant€toÏ(a)(2).€€It€is€the€preferred€practice€to€dispose€of€the€matter€in€oneÏproceeding€as€the€able€trial€judge€did€in€this€case.€€All€of€the€proofÏwas€before€him€to€enable€him€to€determine€whether€the€plaintiffÏwas€physically€capable€of€performing€the€duties€of€her€pre„injuryÏemployment€and€to€render€judgment€accordingly.€€ÌÌà àThe€plaintiff's€testimony€that€she€was€unable€to€do€this€workÏis€abundantly€corroborated€by€the€medical€proof.€€We€find€that€theÏtrial€court's€holding€that€the€plaintiff€was€not€capable€of€performingÏher€duties€at€Tecumseh€is€supported€by€a€preponderance€of€theÏevidence.€€The€defendant€argues€that€the€trial€court's€finding€isÏrefuted€by€the€fact€that€the€plaintiff€applied€for€a€job€as€a€bankÏteller€before€terminating€her€employment.€€While€the€plaintiffÏtestified€that€even€this€work€was€some€what€painful,€we€mustÏobserve€that€this€type€work€is€not€nearly€as€demanding€physically€asÏthe€employment€with€the€defendant.€€The€first€issue€is€withoutÏmerit.ÌÌà àThe€defendant€argues€that€the€evidence€preponderates€againstÏthe€trial€court's€finding€that€plaintiff€sustained€a€45%€permanentÏpartial€disability€to€the€body€as€a€whole.€€ÌÌà àAppellate€review€is€òòde€novoóó€upon€the€record€of€the€trial€court,Ïaccompanied€by€a€presumption€of€correctness€of€the€findings€of€fact,Ïunless€the€preponderance€of€the€evidence€is€otherwise.€€T.C.A.€ðð50„6„225(e)(2).€€This€tribunal€is€required€to€conduct€an€independentÏexamination€of€the€evidence€to€determine€where€the€preponderanceÏlies.€€òòWingert€vs.€Government€of€Sumner€Countyóó,€908€S.W.2d€921Ï(Tenn.1995).ÌÌà àWhere€the€trial€judge€has€seen€and€heard€witnesses,€especiallyÏif€issues€of€credibility€and€weight€to€be€given€oral€testimony€areÏinvolved,€on€review€considerable€deference€must€still€be€accorded€toÏthose€circumstances.€€òòTownsend€vs.€Stateóó,€826€S.W.2d€434Ï(Tenn.1992).ÌHowever,€this€tribunal€is€as€well€suited€to€gauge€the€weight,€worthÏand€significance€of€deposition€testimony€as€the€trial€judge.€€òòSeiberÏvs.€Greenbriar€Industries,€Incóó.,€906€S.W.2d€444€(Tenn.1995).€€This€isÏalso€true€with€respect€to€medical€reports€and€records€when€they€areÏin€evidence€by€stipulation.€€As€stated,€the€medical€proof€in€this€caseÏwas€by€copies€of€medical€records€and€reports.€€All€of€the€otherÏevidence€was€by€oral€testimony.ÌÌÌà àWe€find€that€the€plaintiff€not€only€had€permanent€partialÏdisability€to€both€arms€as€a€result€of€the€carpel€tunnel€syndrome€butÏshe€also€suffered€permanent€partial€disability€in€her€neck€andÏshoulder€area.€€The€arms€are€scheduled€members€but€the€neck€andÏshoulders€are€not€scheduled€so€disability€to€this€area€is€applied€toÏthe€body€as€a€whole.€€The€defendant€does€not€insist€that€theÏdisability€be€limited€to€the€arms€and€does€not€complain€of€the€trialÏcourt's€finding€of€disability€to€the€body€as€a€whole.€€We€haveÏcarefully€reviewed€the€entire€record€and€find€that€the€preponderanceÏof€the€evidence€establishes€that€the€plaintiff€sustained€45%Ïpermanent€partial€disability€to€the€body€as€a€whole.ÌÌà àIn€the€third€issue,€the€defendant€states€that€the€trial€courtÏerred€in€finding€that€it€should€be€responsible€for€medical€expensesÏincurred€by€plaintiff€for€the€care€and€treatment€provided€by€Dr.€TerryÏO.€Harrison€and€Dr.€Ray€W.€Hester.ÌÌà àUnder€T.C.A.€ðð€50„6„204€the€employer€is€required€to€furnishÏfree€of€charge€to€the€employee€all€medical€expenses.€€The€statuteÍrequires€that€the€employer€select€three€physicians€and€that€theÏemployee€accept€the€services€of€one€of€them.€ÌÌà àThe€plaintiff€accepted€the€services€of€all€physicians€referredÏto€her€by€the€defendant.€€The€last€physician€that€she€saw€was€Dr.ÏBarnett€who€performed€surgery€on€her€arms€and€after€treating€herÏadvised€her€that€there€was€nothing€else€that€he€could€do€for€her.€€HerÏneck€and€shoulders€were€still€giving€her€pain€and€impairment€as€wellÏas€her€arms.€€After€being€discharged€by€Dr.€Barnett,€she€requested€toÏsee€another€doctor€but€this€request€was€refused€by€defendant.€€SheÏthen€consulted€her€family€doctor,€Dr.€Ray€W.€Hester€who€referred€herÏto€Dr.€Terry€O.€Harrison.€€Further€treatment€from€these€doctors€didÏnot€improve€the€plaintiff's€condition.ÌÌà àThe€evidence€is€undisputed€that€after€her€discharge€by€Dr.ÏBarnett€and€before€seeing€her€family€doctor,€the€plaintiff€gaveÏnotice€that€she€desired€further€treatment€in€compliance€with€T.C.A.Ïðð€50„6„204.€€See€òòGreenlee€vs.€Care€Inn€of€Jefferson€Cityóó,€644€S.W.2dÏ679€(Tenn.1983).€€The€employer€refused€further€medical€treatment.€ÍThe€question€is€whether€the€plaintiff€was€justified€in€seekingÏfurther€treatment.€€òòPickett€vs.€Chattanooga€Convalescent€and€NursingÏHome,€Incóó.,€627€S.W.2d€941€(Tenn.1982).ÌÌà àWe€think€that€the€preponderance€of€the€evidence€establishesÏthat€this€lady€was€justified€in€seeking€further€treatment.€€She€wasÏstill€having€much€difficulty€with€her€arms,€neck€and€shoulder.€€AÏsecond€or€further€opinion€as€to€whether€any€other€treatment€wouldÏbe€beneficial€is€certainly€a€justified€and€rational€desire€of€anyÏperson€so€situated€as€the€plaintiff.€€As€it€turned€out,€the€effort€ofÏthese€doctors€did€not€materially€assist€the€plaintiff€but€she€did€notÏknow€this€at€the€time€she€sought€the€further€treatment.€€We€find€thisÏissue€in€favor€of€the€plaintiff.ÌÌà
