TheclaimantwasworkingforCarrierinAugustof1993whenhesprainedhiswristwhileoperatinganairgun,therebyaggravatingapreexistingfracture,or"nonunionofthescaphoidbone."Hiswristswelledandhefeltimmediatepain.Hereceivedfirstaidfromthecompanynurse,butcontinuedtowork.Almostayearlater,becauseofcontinuingcomplaintsofpain,hewasreferredbytheemployertoanorthopedicsurgeon.  Thedoctoroperatedandreturnedtheclaimanttoworkwithsomerestrictions.Inhisdeposition,thedoctoropinedthattheinjuryaggravatedthepreexistingconditionbyincreasingpain,butdidnotcreateanypermanentanatomicalchange.Thesurgeonwasproperlypaidbytheemployer.  ThetrialcourtfoundthattheclaimanthadnotsufferedaninjurybyaccidentascontemplatedbytheWorkers'CompensationAct.Appellatereviewisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectness,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.section506225(e)(2).  UndertheTennesseeWorkers'CompensationLaw,injuriesbyaccidentarisingoutofandinthecourseofemploymentwhichcauseeitherdisablementordeathoftheemployeearecompensable.Tenn.CodeAnn.section506102(a)(5).Anaccidentalinjuryisonewhichcannotbereasonablyanticipated,isunexpectedandisprecipitatedbyunusualcombinationsoffortuitouscircumstances.SeeFinkv.Caudle,856S.W.2d952(Tenn.1993),andcasescitedtherein.  Anemployertakesitsemployeewithallpreexistingconditions,andcannotescapeliabilitywhentheemployee,uponsufferingaworkrelatedinjury,incursdisabilityfargreaterthanifhehadnothadthepreexistingcondition;Rogersv.Shaw,813S.W.2d397(Tenn.1991);butifworkaggravatesapreexistingconditionmerelybyincreasingpain,thereisnoinjurybyaccident.Townsendv.State,826S.W.2d434(Tenn.1992).  Theundisputedmedicalprooffromtheoperatingsurgeonisthatthisclaimant'saggravationofapreexistingconditionmerelyincreasedhispainanddidnotcauseanyanatomicalchange.Moreover,theevidencefailstoestablishthattheaccidentincreasedhisdisability.Consequently,wecannotsaytheevidencepreponderatesagainstthefindingofthetrialjudge.
