Asaresultofdevelopingbilateralcarpaltunnelsyndrome,theclaimantwasreferredbyheremployertoDr.WilliamL.Bourlandfortreatment.Dr.Bourlandperformedsurgeryintheformofcarpaltunnelreleasestoeachhand,onApril12andApril26,1994,respectively.Dr.Bourlandwasoftheopinionthatshehadnopermanentimpairmenttoherlefthandandfivepercent(5%)impairmenttoherrighthandasaresultoftheconditionandsurgery.Shereturnedtoworkwiththesameemployeratthesamewage.Somefourteenmonthslater,shewasreferredbyherattorneytoDr.RobertChristopherofMemphisforevaluationofhercontinuingcomplaints.Dr.Christopherexaminedherandgavehersometestsandopinedthatshehadatenpercent(10%)impairmentofeachupperextremity,which,baseduponhisreferencetotheAMAGuidestotheEvaluationofPermanentImpairment,4thEd.,translatedtonineteenpercent(19%)ofthe combinedvaluestables,andconvertstoanelevenpercent(11%)impairmenttothebodyasawhole.Hefeltthatsheshouldavoidanykindofworkthatrequiredrepeatedwristbending,eitherflexionorextension,andfeltthatbendingherwristsmany,manytimesperhourwouldbeplacingheratriskforfurtherproblemswithherhands.Hesaidthatsheshouldavoidjobsthatrequirehertodorepeatedliftingofobjectsweighingmorethantwentypounds,aswellaspushingorpullingobjectsweighingmorethantwentypoundsandshouldavoidworkthatrequireshertoliftherarmsabovehershoulderheightonarepeatedbasis.Hesaidthatsheshouldnotdoworkthatrequiredhertodosevereexertionwithherhands,suchassqueezingtoolsoropeningjars,orthingsofthatsort,severaltimesanhour. Theemployerconcedesthattheclaimanthassomepermanentdisabilityinherrightarm,butfeelsthattheawardbythetrialcourtwastoogreat. Afteratrial,theChancellorawardedatwentyfivepercent(25%)permanentpartialdisabilitytoeacharm.Althoughthereissomeconfusioninthejudgmentinthetrialcourtandthebriefsonappeal,thepartiesstipulatedatoralargumentthatthatwas,indeed,theawardactuallymadebythetrialcourt. Reviewonappealisdenovo,upontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectnessofthefindingsoffact,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.506225(e)(2).Inthiscase,noattackismadeuponthequalificationsofeitherphysician.However,Dr.Christophertestifiedbydeposition,subjecttocrossexamination.OnlyDr.Bourlandsrecordswereintroducedbytheemployer.Thetrialcourtwasabletoseetheclaimantinpersonandevaluatehercredibility.HemightverywellhaveconcludedfromevaluatingtheplaintiffscredibilityandreviewingtheimpressivecredentialsofDr.Christopherthatthelattersopinionwasclosertothetruefacts. Ourindependentexaminationoftheevidenceandtheprinciplesoflawfailstopreponderateagainstthetrialcourtsfindingsinthiscase. THEREFORE ,thejudgmentofthetrialcourtisaffirmed.Costonappealaretaxedtothedefendants/appellants.
