Theissuepresentediswhetherthetrialcourterredinfindingthattheplaintiffsustaineda35percentdisabilitytohisrightarmasaresultofajobrelatedaccident. Thestandardofreviewisdenovoontherecordaccompaniedwiththepresumptionthatthejudgmentiscorrectunlesstheevidenceotherwisepreponderates.Tenn.R.App.P.13(d);T.C.A.506225(e)(2). Thepartiesstipulatedthatthe plaintiffhadincurredworkrelatedbilateralcarpaltunnelsyndrome.Thefindingofdisabilitytotheleftarmisnotcontestedonappeal;thedefendantarguesthatafindingof35percenttotherightarmisexcessive. Thetreatingphysician,Dr.Gorman,testifiedthattheplaintiffsrightarmwasasymptomaticfollowingcorrectivesurgeryandwithoutimpairment. Dr.EricRobertswasemployedbytheplaintiffsattorneytoexamineandevaluatetheplaintiff.Heisaboardcertifiedphysicalmedicinespecialist.Hetestifiedthatheperformedextensivetestingoftheplaintiff,reviewedthevoluminousmedicalreportsandbelievedthattheplaintiffhada20percentimpairmenttohisrightarm,basedonAMAGuidelines.ThedepositionofDr.Robertsisunusuallylengthy,andwehaveconsidereditindepth.Hensonv.CityofLawenceburg,851S.W.2d809,812(Tenn.1993).
