Theplaintiff,age54,sufferedajobrelatedmyocardialinfarctiononMarch1,1994.Acoronaryarteriogramrevealedan80%blockageofhisleftanteriordescendingarterywhichwasalleviatedbyanangioplastyprocedurewhichreducedtheblockagetolessthan15%.Conservativetreatmentfollowed,andhewasreleasedtoreturntofullemploymentonJanuary1,1994.Fromthatdayforward,theplaintiffhasworkedsteadilyandwithoutincident. InJuly1991,theplaintiffwashospitalizedwithchestpains.Acardiaccatheterizationwasperformed,whichrevealedaseriouslesioninhisleftcircumflexcoronaryarteryattheleftventricularridge,withanotherlesioninhisleftanteriordescendingcoronaryartery.Afterthe1994infarction,thelesionintheleftanteriorarterywassubstantiallyworsened. Theemployerinsiststhattheawardisexcessivebecauseitwasimproperlyoneratedwithliabilityforimpairmentresultingfrompreexistingcoronaryarterydisease.Liabilityforbenefitsresultingfromimpairmentasaconsequenceofthemyocardialinfarctionisconceded. Thedispositiveissueattrialwastheextentoftheplaintiffspartialpermanentdisability.TheChancellorfoundthattheplaintiffhada50%permanentpartialdisabilityandawardedbenefitsaccordingly. Ourreviewisdenovoontherecord,accompaniedbythepresumptionthatthetrialcourtsjudgmentiscorrectunlesstheevidencepreponderatesotherwise.T.C.A.506225(e)(2). Thetreatingphysician,Dr.K.P.Channabasappa,testifiedthattheplaintiffsimpairmentwas29%,whichmaybeextrapolatedtoCategoryIIoftheAMAGuidelines.Hestatedinapredepositionletterthat itis29%andondirectexaminationtestifiedthattheimpairmentwas29%. Therewasnocountervailingtestimonyoffered.
