àWe€affirm€the€judgment€of€the€trial€court.Ìà àPlaintiff€sustained€injury€to€his€back€on€April€29,€1994€while€lifting€a€cylinderÏhead€from€a€forklift€truck.€€Medical€records€of€Dr.€Vaughan€Allen,€designated€asÏExhibit€1€to€the€Deposition€of€Dr.€Earl€M.€œJeffres,›€indicate€that€plaintiff€was€firstÍtreated€by€Dr.€Charles€D.€Haney,€who€œprescribed›€medications€and€rest.€€WhenÏœplaintiff›€did€not€improve,€he€was€referred€by€the€employer€to€Dr.€Allen.€In€May€ofÏ1995€he€was€sent€by€his€attorney€to€Dr.€Earl€M.€œJeffres.›€Ìà àThe€plaintiff€first€raises€the€issue€that:ÌÓÓÒ  ÒÒ r ÒÒ ` ÒÒ r Òð ðThe€trial€court€erred€in€basing€its€decision€on€the€written€report€of€aÏnon„testifying€physician€[Dr.€Allen]€and€rejecting€the€testimony€of€theÏonly€medical€expert€[Dr.€œJeffres].ðð›ÌÒ  ÒÒ r ÒÒ  ÒÒ H ÒÓÓÌà àœDr.›€Allenððs€treatment€records€of€May€24,€1994€and€May€27,€1994€revealedÏthat€plaintiff€had€a€loss€of€range€of€motion€of€his€low€back,€muscle€spasm€and€aÏstraight€leg€raise€test€that€was€positive€for€lumbar€injury.€€X„ray€revealed€a€centralÏdisc€protrusion.€€Plaintiff€was€taken€off€work€and€placed€on€physical€therapy€for€fourÏweeks.Ìà àOn€June€28,€1994,€plaintiff€returned€to€Dr.€Allen,€stating€that€he€was€ð ðbetterÏbut€not€well.ðð€€He€told€Dr.€Allen€that€there€was€ð ðabsolutely€no€light€duty€and€that€heÏworks€at€very€heavy€machines€.€.€.€œð ð€›€In€light€of€this€assertion€by€the€patient,€Dr.€AllenÏadvised€him€to€continue€the€chronic€exercise€program€and€return€for€a€re„check€inÏtwo€months.€€Allen€further€opined€that€ð ðCertainly,€if€there€is€light€duty€he€could€startÏdoing€that,€at€this€point.ððÌà àPlaintiff€returned€to€see€Dr.€Allen€on€August€30,€1994,€ð ðdoing€as€well€as€couldÏbe€expected.ðð€€He€was€placed€in€a€work€hardening€program€and€a€functionalÏcapacity€test€was€ordered.€€Dr.€Allen€planned€to€release€plaintiff€to€return€to€work€asÏsoon€as€this€has€been€completed.Ìà àPlaintiff€saw€Dr.€Allen€on€October€7,€1994€after€completing€the€workÍhardening€program.€€Allen€opined€that€it€was€ð ðnot€feasibleðð€for€him€to€return€to€heavyÏactivity€at€work.€€He€limited€plaintiff€to€lifting€up€to€50€pounds.€€Further,€he€opinedÏplaintiff€could€bend€and€twist€without€difficulty€ð ðas€long€as€itððs€not€on€an€absolutelyÏcontinuous€basis.ðð€€He€assessed€5€percent€anatomic€impairment€and€recommendedÏthat€plaintiff€stay€on€a€chronic€exercise€program.€€He€opined€plaintiff€could€return€toÏwork€with€the€above€œlimitations.›Ìà àIn€response€to€an€inquiry€by€plaintiffððs€counsel,€Dr.€Allen€wrote€on€DecemberÏ30,€1994€that€ð ðCertainly€Mr.€Hickman€cannot€do€heavy€mechanical€work,€and,Ïunfortunately,€a€good€deal€of€his€work€would€require€this.€€I€know€of€nothing€that€weÏcan€do€to€change€this,€and€if,€indeed,€he€states€that€he€is€limited€and€cannot€do€thisÏwork€secondary€to€pain€I€would€certainly€have€to€respect€this.ððÌà àOn€May€18,€1995,€œplaintiff€saw€Dr.€Earl€M.€Jeffres€at€his€attorneyððs€request.›€ÏDr.€Jeffres€is€an€orthopedic€surgeon€licensed€to€practice€in€Tennessee€and€on€theÏstaff€of€Lincoln€Regional€Hospital€in€Fayetteville.€€He€formerly€practiced€medicine€inÏFlorence,€Alabama,€but€lost€his€privileges€there.Ìà àDr.€Jeffres€testified€by€deposition€that€he€examined€plaintiff€and€diagnosedÏlumbosacral€back€strain€with€chronic€symptoms€and€herniated€nucleus€pulposus€ofÏthe€fifth€lumbar€paravertebral€disc,€associated€with€bulging€of€the€annulus€fibrosisÏand€with€this€bulging€impinging€upon€the€neural€canal.€€He€opined€that€plaintiff€hasÏa€24€percent€impairment€to€the€whole€person€using€the€AMA€Guides€to€theÏEvaluation€of€Permanent€Impairment,€4th€Edition.€Further,€plaintiff€would€have€workÏrestrictions€including€ð ðno€lifting€while€bending,€no€twisting€while€lifting,€as€in€turningÏfrom€side€to€side,€no€working€with€outstretched€upper€extremities€as€this€putÍadditional€stress€on€his€spine.€€He€is€not€able€to€consistently€stand,€sit€or€lie€down.ðð€€Ìà àDr.€Jeffres€further€testified€that€he€saw€plaintiff€on€June€8€and€December€9,Ï1995,€although€there€is€no€evidence€as€to€whether€this€was€for€treatment€or€furtherÏevaluation.Ìà àThe€trial€court€found€that€the€deposition€testimony€of€Dr.€œJeffres›€was€notÏcredible€and€relied€on€the€medical€records€of€Dr.€Vaughan€œAllen,€who€assessed›€œfive›Ïpercent€œmedical›€œimpairment.›€€Ìà àPlaintiff€first€argues€that€Dr.€Allenððs€treatment€records€are€not€properly€inÏevidence.€€When€Dr.€Jeffres€was€deposed€by€plaintiff,€he€was€holding€in€his€handÏthe€medical€records€of€Dr.€Allen,€upon€which€he€relied€in€performing€hisÏindependent€evaluation.€€On€cross„examination,€counsel€for€Defendant€stated,€ð ðIÏhave€made€a€copy€of€those,€and€I€would€like€to€make€those€Exhibit€1€[to€JeffresððÏdeposition].ðð€€Plaintiff€replied,€ð ðno€objection.ððÌà àòòRule€103(a),€Tennessee€Rules€of€Evidenceóó€provides:ÌÒ ` ÒÒ H ÒÒ ` ÒÒ ½ ÒÓÓÓ  Óà à(a)€Effect€of€Erroneous€Ruling.€„€Error€may€not€be€predicatedÏupon€a€ruling€which€admits€or€excludes€evidence€unless€aÏsubstantial€right€of€the€party€is€affected,€andÌà àà à(1)€Objection.€„€In€case€the€ruling€is€one€admittingÏevidence,€a€timely€objection€or€motion€to€strike€appears€of€record,Ïstating€the€specific€ground€of€objection€if€the€specific€ground€wasÏnot€apparent€from€the€contest;ÌÓÓÓÓÒ  ÒÒ ½ ÒÒ  ÒÒ H ÒÓ  ÓÌÓÓà àFailing€to€make€a€timely,€specific€objection€in€the€trial€court€prevents€a€litigantÏfrom€challenging€the€introduction€of€inadmissible€evidence€for€the€first€time€onÏappeal.€€òòAdams€v.€Manis,óó€859€S.W.2d€323€(Tenn.€Ct.€App.€1993).€€Moreover,€plaintiffÏagreed€to€the€admission€of€Dr.€Allenððs€medical€œrecords€at€trial.›€œ€As›€defendant€pointsÏout,€it€is€disingenuous€for€plaintiff€to€œnow€argue›€that€the€Court€should€not€have€takenÍinto€account€Dr.€Allenððs€medical€notes€when€the€plaintiff€himself€relied€upon€thoseÏnotes€at€trial€as€did€his€expert€in€his€independent€medical€examination.€€Under€theÏcircumstances,€we€conclude€that€introduction€of€the€records€at€trial€was€not€error.Ìà àPlaintiff€next€argues€that€Dr.€Allenððs€records€should€be€accorded€lessÏevidentiary€weight€than€Dr.€Jeffresðð€deposition€because€Allenððs€records€do€not€stateÏwhether€the€opinions€expressed€are€based€on€the€A.M.A.€Guides,€as€required€byÏòòTenn.€Code€Ann.€ððóó€50„6„204(d)(3),€whereas€Dr.€Jeffres€testified€that€his€opinion€wasÏbased€on€the€A.M.A.€Guides.€€However,€use€of€one€of€the€two€guides€named€inÏsubdivision€(d)(3)€is€unnecessary,€although€preferable,€where€causation€andÏpermanency€have€been€established€by€expert€testimony,€because€the€issue€thenÏbecomes€the€extent€of€vocational€disability,€not€anatomical€disability.€€òòLyle€v.€ExxonÏCorp.,óó€746€S.W.2d€694€(Tenn.€1988);€òòDavenport€v.€Taylor€Feed€Mill,€óó784€S.W.2dÏ923€(Tenn.€1990).€€Ìà àWe€have€carefully€reviewed€the€medical€records€of€Dr.€Allen€and€theÏdeposition€of€Dr.€Jeffres€and€agree€with€the€trial€court€that€Dr.€Jeffresðð€testimony€isÏnot€credible.€€Accordingly,€we€find€the€trial€court€did€not€err€in€granting€greaterÏweight€to€Dr.€Allenððs€opinions,€which€are€the€only€credible€medical€evidence€in€theÏrecord.Ìà àPlaintiff€next€raises€the€issue€that:ÌÓÓÒ  ÒÒ ½ ÒÒ ` ÒÒ ½ ÒÓ  Óð ðThe€trial€court€erred€in€limiting€the€award€of€compensation€to€twoÏand€one„half€times€the€plaintiffððs€impairment€rating€rather€than€sixÏtimes€the€plaintiffððs€impairment€rating.ððÌÒ  ÒÒ ½ ÒÒ  ÒÒ H ÒÓÓÓÓÓ  ÓÌà àòòTenn.€Code€Ann.€ððóó50„6„241(a)(1)€provides:ÌÌÒ ` ÒÒ H ÒÒ ` ÒÒ ½ ÒÓ  Óà àFor€injuries€arising€on€or€after€August€1,€1992,€in€casesÍwhere€an€injured€employee€is€eligible€to€receive€any€permanentÏpartial€disability€benefits€.€.€.€and€the€pre„injury€employer€returns€theÏemployee€to€employment€at€a€wage€equal€to€or€greater€than€theÏwage€the€employee€was€receiving€at€the€time€of€injury,€theÏmaximum€permanent€partial€disability€award€that€the€employeeÏmay€receive€is€two€and€one„half€times€the€medical€rating€.€.€.€ÌÒ  ÒÒ ½ ÒÒ  ÒÒ H ÒÓ  ÓÌÓÓà àWhere€an€employee€unreasonably€refuses€to€return€to€work,€disability€isÏlimited€to€two€and€one„half€times€the€medical€impairment€rating.€€òòNewton€v.€ScottÏHealth€Care€Ctr.,€óó914€S.W.2d€884€(Tenn.€œ1995).›€€But€where€an€employee€is€not€ableÏto€return€to€work€on€account€of€.€.€.€injuries,€refusal€to€return€is€not€unreasonable.€ÏòòBrown€v.€Campbell€County€Bd.€of€Education,€óó915€S.W.2d€407€(Tenn.€1995).Ìà àPlaintiff€testified€that€he€attempted€to€return€to€work€when€authorized€to€do€soÏby€his€then„treating€physician,€Dr.€Allen,€and€that€he€worked€each€day€until€his€painÏwas€unbearable,€causing€him€to€leave€work€before€the€end€of€the€work€day.€€HisÏsupervisor,€Tommy€Beech,€testified€that€he€welcomed€plaintiff€back€to€work€and€toldÏhim€to€make€sure€that€he€stayed€within€his€limitations€as€Dr.€Allen€instructed.€€HeÏtold€plaintiff€to€get€help€from€other€employees€if€he€were€faced€with€lifting€objectsÏthat€would€be€too€heavy€to€be€within€his€medical€œrestrictions€(but€plaintiff›€testifiedÏthere€was€seldom€anyone€around€to€help€œhim).›€€Beech€testified€that€he€offeredÏplaintiff€a€job€as€maintenance€mechanic€and€a€supervisory€job€in€the€weldingÏdepartment,€both€of€which€were€within€the€medical€restrictions,€but€plaintiff€refusedÏboth€jobs.€Ìà àThe€trial€court€found€plaintiffððs€refusal€to€return€to€work€to€be€unreasonable.€€InÏreaching€this€conclusion,€the€court€considered€the€demeanor€and€credibility€of€theÏwitnesses€including€the€restrictions€imposed€by€Dr.€Vaughan€Allen€together€with€theÍfunctional€capacity€evaluation€and€made€the€specific€finding€that€the€testimony€ofÏMr.€Tommy€Beech€was€more€credible€than€that€of€the€plaintiff.€€Therefore,€the€courtÏlimited€plaintiffððs€recovery€to€two€and€one„half€times€the€five€percent€medicalÏimpairment€assessed€by€Dr.€Allen€or€twelve€and€one„half€percent€permanent€partialÏdisability.Ìà
