àThe€trial€court€awarded€the€plaintiff€30%€permanentÏpartial€disability€to€the€body€as€a€whole.€€The€plaintiff€wasÏalso€awarded€medical€expenses€she€had€to€pay€herself.€ÏPlaintiff's€group€insurance€had€paid€a€part€of€the€medicalÏexpenses€regarding€plaintiff's€March,€1994€back€treatment,Ïresulting€in€surgery€and€subsequent€follow„up€care.€€The€trialÏcourt€did€not€award€any€amount€for€temporary€total€benefits.Ìà àThe€defendant€below€appeals€the€judgment,€asserting€thatÏthe€€evidence€preponderates€against€the€trial€court's€findingÏthat€plaintiff's€injuries€were€the€result€of€a€job€relatedÏinjury€that€occurred€on€or€about€March€4,€1994.Ìà àThe€plaintiff€below€appeals€the€judgment,€asserting€thatÏthe€trial€court€erred€in€not€awarding€any€amount€for€temporaryÏtotal€benefits,€not€awarding€medical€expenses€except€the€amountÍthat€plaintiff€paid€herself,€and€awarding€only€30€percentÏpermanent€partial€disability€to€the€body€as€a€whole.Ìà àWe€affirm€the€judgment€of€the€trial€court.Ìà àThe€plaintiff€was€50€years€old€at€the€time€of€trial,€AprilÏ25,€1996.€€She€had€been€employed€by€the€defendant€forÏapproximately€twelve€(12)€years,€six€(6)€or€seven€(7)€years€inÏNorth€Carolina€and€four€(4)€or€five€(5)€years€in€Tennessee.€ÏPlaintiff€went€to€the€10th€grade€in€school,€had€no€specializedÏtraining.€€She€had€worked€in€a€daycare€center€preparing€foodÏprior€to€her€employment€with€the€defendant.ÌÌÌà àPlaintiff€was€working€40€hours€per€week€prior€to€herÏinjury€and€sometimes€worked€overtime.Ìà àOn€the€morning€of€March€4,€1994,€when€plaintiff€was€doingÏa€lot€of€lifting,€she€commented€to€a€co„employee,€"Dang,€IÏthink€I€broke€my€€back".€€She€felt€like€something€had€"pulledÏor€snapped".€€Plaintiff€continued€to€work€until€late€in€theÏafternoon.€€The€manager€told€plaintiff€to€take€off€early€and€goÏto€the€doctor.€€The€manager€instructed€plaintiff€to€write€aÏcheck€for€this€medical€service€and€that€they€would€reimburseÍher.Ìà àPlaintiff€went€back€to€work€for€a€week€or€so€and€becauseÏof€persistent€pain,€consulted€another€doctor.€€At€this€time,Ïplaintiff€asked€her€manager€to€put€her€on€a€weeks€vacation.€ÏDr.€West€sent€plaintiff€to€Lebanon€Medical€Center€where€she€sawÏDr.€John€Guillermin,€a€neurosurgeon.€€Dr.€Guillermin€performedÏsurgery€on€March€16,€1994€for€a€right€ruptured€disk€at€L„5.€ÏPlaintiff€never€returned€to€work.€€Dr.€Guillermin€fixedÏplaintiff's€anatomical€impairment€at€10€percent€to€the€body€asÏa€whole.€€He€opined€that€these€findings€were€consistent€withÏthe€history€and€complaints€provided€by€the€plaintiff.Ìà àDr.€Guillermin€had€no€reference€in€his€notes€concerningÏwhen€plaintiff€would€have€reached€maximum€medical€recovery,€andÏtherefore€stated€it€would€be€12€months€after€surgery.Ìà àOur€review€is€de€novo€with€a€presumption€that€the€findingsÏof€the€trial€court€are€correct,€unless€the€evidenceÏpreponderates€otherwise.€€Tenn.€Code€Ann.€Section€50„6„225€(e)Ï(2).Ìà àWe€find,€as€did€the€trial€judge,€the€medical€evidenceÏgiven€by€Dr.€John€Guillermin€to€be€credible€on€the€issues€ofÏcausation€and€disability.Ìà àWe€find€that€the€evidence€does€not€preponderate€against€heÏtrial€court's€findings€that€the€plaintiff€suffered€a€30%Ïpermanent€disability€resulting€from€her€work€related€accident.Ìà àWe€find€that€the€evidence€int€he€record€does€notÏpreponderate€against€the€trial€court's€finding€that€plaintiffÏwas€entitled€to€only€the€medical€expense€she€had€paid€herself.€ÏAlso€we€concur€with€the€trial€court's€finding€that€there€wasÏnot€sufficient€evidence€to€make€an€award€of€temporary€totalÏbenefits.Ìà
