Thetrialcourtawardedplaintiff100%permanentvocationaldisability.Defendantschallengethetrialcourtsfindingofpermanentimpairmentandthetrialcourtsfindingof100%permanentvocationaldisability. Wefindthattheevidencepreponderatesinfavorofafindingofacompensablepermanentinjury.Wefind,however,thattheevidencepreponderatesagainstanawardof100%permanentvocationaldisability.Wefindtheevidencepreponderatesinfavorofafindingof75%permanentpartialvocationaldisability.Wesomodifythejudgmentofthetrialcourtand,asmodified,affirmit.' )Plaintiff,41,hasatenthgradeeducation.Herpastworkhistoryincludesworkasawaitress,bartender,factoryworkerandatruckdriver.OnOctober30,Ϝ1990,plaintiffandherhusbandweredrivingfordefendantwhenplaintifffellfromthetruckcabasshewastryingtoopenapartiallystuckpassengerdoor.Shewasdiagnosedwithaspraintotherightupperbackandrightneckandadmittedtothehospitalforanunstablediabeticcondition.Shewasalsovisitedbyapsychiatristwhileatthehospitalfordepressionandsleeplessness.Sinceherinjury,plaintiffhasdevelopedchronicpaininherneckandbackandeventuallyinherlowerback.Sheneverreturnedtoworkforthedefendantbut,in1992,shebeganworkingasabartender.Shequitaftertenmonthsduetopain. PlaintiffwasfirsttreatedbyDr.GurumurthyReddy,anorthopedicsurgeon,whodiagnosedaneckandupperbackstrainandnotedmusclespasmandlimitationofrangeofmotionoftheneck.HelastsawheronJanuary31,1991,whenhediagnosedmyofascialneckandupperbackpainandreleasedhertoreturntoworkonatrialbasis. PlaintiffwaseventuallytreatedbyDr.DennisAguirre,ananesthesiologist.ϜHediagnosedfibromyalgiainAugust1993.Hetestifiedthatfibromyalgiaisasystemicdiseaseinvolvingmanybodyfunctionsandproducingchronicpainandfatigue.Heopinedthatplaintiffslowerbackpainisconsistentwithfibromyalgia.Heopinedthatplaintiffsfibromyalgiaisrelatedtoherfallfromthetruck.Oncrossexamination,hetestifiedthatthecauseoffibromyalgiaisoftenidiopathicorunknown. Attherequestofthedefendants,plaintiffwasexaminedbyDr.HarryBachman,anorthopedicsurgeonandDr.WilliamPlatt,aphysiatrist.Dr.Bachmantestifiedthathefoundnoobjectivefindingswhatsoever,thattheexistenceoffibromyalgiawasquestionedbysomephysiciansandthatplaintiffcouldreturntowork.Dr.Plattdiagnosedchronicpainsyndromewithdepressingfeatures.Heopinedthatplaintiffdidnothavefibromyalgiawhenhesawherandthatshecouldreturntolightdutywork.Heopinedthatplaintiffslowerbackpainwasmorelikelyrelatedtoherbartendingthanherfall.Hefurthertestifiedthatthecausesoffibromyalgiaareuncertain. PlaintiffsawDr.DavidForester,apsychiatrist.Hediagnosedmajorandseveredepressionwhichislikelytodeteriorate.Herelatedhercurrentmentalconditiontotheresultsofherfall:herfibromyalgiaandherinabilitytowork.HeopinedthatplaintiffhasaClassIVmarkedimpairment.Dr.StephenFulmer,apsychologist,evaluatedplaintifffordefendants.HediagnosedplaintiffwithDysthymicDisorder,ordepressioncontinuingformorethantwoyears.Heopinedthatplaintiffsdepressionprecededherfallandthatherfalldidnotcauseherdepressionbutthatitdidaggravateit. Ourreviewisdenovoontherecord,accompaniedbythepresumptionthatthefactualfindingsofthetrialcourtarecorrect.Tenn.CodeAnn.506225(e)(2).Underthisstandardofreview,wemustweighinmoredepthfactualfindingsofthetrialcourt.Humphreyv.DavidWitherspoon,Inc.,734S.W.2d315(Tenn.1987).Whereevidenceisdocumentary,weareequallysituatedtothetrialcourtinassessingcredibilityandweightofevidence.Landersv.FiremansFundIns.Co.,775S.W.2d355(Tenn.1989).
