ThiscasewasfiledintheGeneralSessionsCourtofWarrenCounty,andwas,byagreement,heardbytheClerkandMaster, actingasJudgeoftheGeneralSessionsCourt,onOctober4,1995. Thetrialcourtfoundthattheplaintiffhada40percentpermanentpartialdisabilitytoherleftarm,anda24percentpermanentpartialdisabilitytoherwholebodyasaresultofacervicalinjury.Theemployerappeals,(1)questioningthefindingofacervicalinjury,and(2)whethertheawardofbenefitsisexcessive. @ II  Theplaintifftestifiedthatshewas,attrialdate, ayoung65,whoenteredthelabormarketatage15or16asasewingmachineoperator,wheresheremained25years. Sheobtainedanotherjobinthetextileindustrywhichrequiredrepetitivehandmovements,followingwhichshebecameanentrepreneur,operatingasmallgroceryforthreeyears.Shetestifiedthatthegrocerybusinessalsorequiredrepetitivemovements. Afterherentreprenurialstintwasover,sheobtainedajobasaschoolbusdriverfortenyears,followedbyaseriesofthreejobsinthetextileindustry,thefinalofwhichwaswiththedefendantwhich,weinfer,wasofshortduration. WhileemployedbyEasyware(thesecondoftheseemployersafterherbusdriverjob)shehadasuccessfulcarpaltunnelreleaseperformedonherrighthand.  Whileemployedbythedefendantshe pulledthisthumboutofsocket,requiringsurgicalcorrection.Sometimelater,shewastreatedbyaneurosurgeon regardinganincidentonthejobwhereby[she]injuredoraggravated[her]neck.Therewaslittleornofurtherexplicationofthis incident. Oncrossexamination,shetestifiedthatshehadanothercarpaltunnelreleaseduringemploymentatRockfordMills,whichwemayinferwasherfirstemployer.Shelaterhadbacksurgerytocorrectaninjurysufferedbyfallingata littlemarketwheresheworkedduringanunspecifiedperiod,andforwhichshewasawardedworkerscompensationbenefits.Thiswasfollowedbyanautomobileaccidentwhichcausedashoulderandankleinjury.Thereafter,shedevelopedextensivekneeproblemsrequiringarthroscopicsurgery,apparentlyunrelatedtoemployment.̜ @ III  Dr.GregoryP.Lanford,aneurosurgeon,testified,bydeposition,thatheinitiallysawtheplaintiff,who,onSeptember3,1992complainedofbilateralhandandneckpain.Theusualtestingrevealedcervicalarthritis,withapinchednerve,forwhichshewastreatedconservatively.HelastsawheronApril1,1993andrecommendedthatshereturntowork. Dr.Lanfordtestifiedthatshehadnoobjectivesymptoms,butbecauseofhercomplaintsofpainformorethansixmonthsandinaccordancewiththeAMAGuides,heassignedherasofttissueimpairmentoffourpercent. @ IV Dr.DavidS.Jones,anorthopedicspecialist,testifiedbydeposition,thatheinitiallysawtheplaintiffonNovember5,1992,atwhichtimeshecomplainedofpainandswellinginherleftthumb.Heperformedcorrectivesurgerybyremovingthetrapeziumatthebaseofthethumb.Thesurgerywassuccessfulandfollowupwasuneventful.Dr.JonesreleasedhertoreturntoworkonMarch22,1993.Thereafter,shedevelopedtendinitiswhichwassuccessfullycorrected.Hetestifiedthatsheretainedatwopercentpermanentpartialimpairmentofherleftarm. Ourreviewofthefindingsoffactmadebythetrialcourtisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofthecorrectnessofthefinding,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.506225(3)(2).Stonev.CityofMcMinnville,896S.W.2d584(Tenn.1991). Wehavecarefullystudiedthetestimonyoftheplaintiffandthedepositionaltestimonyofthetreatingspecialists,andconcludethatwhiletheevidenceofcompensablecervicalinjuryisnotoverpowering,wecannotfindthatitϜpreponderatesotherwise.However,wefindthattheevidencepreponderatesagainstafindingof24percentpermanentpartialdisabilitytoherwholebody,andpreponderatesinfavorofafindingoftenpercenttothewholebody.Thesameistrueofthefindingoffortypercentpermanentpartialdisabilitytoherleftarm;wefindtheevidenceotherwisepreponderates,andthatafindingoftenpercentpermanentpartialdisabilitytoherleftarmadequatelysecurestotheplaintiffthebenefitsoftheworkerscompensationlaws.Itshouldbenotedthatbothphysiciansrecommendedthattheplaintiffreturntowork,ifshechose;thattheirdiagnosesandimpairmentratingswereessentiallybasedonsubjectivesymptoms,andthateachphysicianassignedonlyaminimalimpairmentrating.
