Theappellantsufferedastrokewhileworkingonanassemblyline.Substantialdisabilityresulted,whichsheallegesiscompensableasbeingaccidentrelated.Thetrialjudgedisagreed,andsheappeals.Ourreviewisdenovo,withthepresumptionthatthejudgmentiscorrectunlesstheevidenceotherwisepreponderates.Tenn.CodeAnn.506225(e)(2). Mrs.McKameyis49yearsold,withlimitedskillsandeducation.Herassemblylinejobinvolvedthesewingofshirtcollarstays,whichmaybefairlydescribedasrepetitiveandmonotonous.OnMay12,1992,whileworkingthe7:00a.m.to3:30p.m.shift,shesufferedastrokeshortlybeforetheendofhershiftwhichresultedintotalvocationaldisability.Sheallegesthat,likeallotheremployees,shewasexpectedtomakeproduction,withitsattendantpressuresandtensions,whichcausedorcontributedtothestroke. Causationisthedispositiveissue.TheproofrevealedthatMrs.McKameyhadbeensufferingfromhypertensionforyearsandhadbeenregularlytakingmedicationforthatdiseasesince1988.Shehadsmokedcigarettessinceage14;atthetimeofherstroke,shesmokedmorethantwentyperday. Respondingtoahypotheticalquestion,Dr.JohnPurvis,aneurosurgeon,testifiedthatthesewingofhundredsofcollarstaysduringaregularshiftcouldbeacontributoryfactortothecerebralaccident,dependinguponaresolutionofcertainfactors,thosebeingarteriosclerosisandhypertension,theformerbeingaggravatedorcausedbysmokingwhich playedapartandcontributedtoherpreexistingcondition.Theinducingcausesofherstrokewastheruptureofabloodvessel.Afterreviewingavideotapeoftheassemblylineworkers,Dr.Purvistestifiedasfollows:0 Q. Nowthen,Dr.Purvis,assumingthosefactsthatIstatedbeforeyouwatchedthevideotapeandassumingthatthevideotapedepictsaladydoingthesamejobthatMs.McKameydidonthedayofherstroke,inyourmedicalopinion,Doctor,toareasonabledegreeofmedicalcertainty,wasthiskindofphysicalactivityandlevelofexertionsufficienttocauseMs.McKameysstroke?0 A. IdontthinkthattheandIdontthinkevenwhenIvesaidthatstresscouldproducethis,ImnotreallytalkingsomuchaboutthephysicalstressbecauseIdontthinkthisisarealheavyphysicaljob.Thestressmaybemorehowthatpersonfeelsaboutmakingproduction.ItmaybemoreofaninternalstressthanitwouldbeIdontthinkthejobitselfwasthathardthatitwouldproducemorethanamoderateincreaseinbloodpressure.0 Q. Wouldthatlevelofphysicalexertion,physicalactivity,beenoughtoaggravatethepreexistingconditionthatwouldprecipitateherstroke?0 A. Itsnotamatterofaggravation.Itsjustamatterofbloodpressurerise,andIdontthinkthatthistypeofjobisofanymoreeffort,letssay,thanlotsofhouseworkwouldbewhichcouldsomeonecouldhaveastroke.IthinkthatitsjustamatterthatsasIsaid,itsdependentontwofactors.Thestrengthofthebloodpressurewallatthepointwhereitbled,andpluswhateverriseinbloodpressuretherewas.Andanyamountofphysicalactivitywillraisebloodpressuresome,butIdontthatthatwouldmildactivity,physicalactivity,thatyoucouldblamethatforthestroke.Ithinkthatyoucould,dependingonthepersonalityofthatpersonbystressandthatisoftryingtomakeproductionandwhatstresstheyputonthemselvesintryingtomakethatproduction,thatthatcouldraisethebloodpressure,anditcouldraiseitsignificantly.Oneofthethingsisthatpeoplethathavehypertensionlikethisaremoresensitivetothingsthatwillraisetheirbloodpressure.0 Q. Emotionally?0 A. Yes.0 Q. IdontwanttobesplittinghairsandIapologizeforthat,butunderourlawthatswhatthiscaseisgoingtoboildownto,andIamalmostfinished,butasIunderstandwhatyousaid,andpleasecorrectmeifIamwrong,youresayingthatwhenyoutestifiedthatthisjobcausedoraggravatedherpreviousconditiontocauseherstroke,youwereconcernedabouttheemotionalstressandhernervoussituation,notthephysicalexertionandthelevelofphysicalactivity.Isthattrue?0 A. Yes.Ididntthinkthatherjobwasthatphysicallydemanding,youknow,beingasewingjob,butincertainpeople,itsstressfultryingtomakeproduction.Thatsitprimarily. Itiswellsettledinthisjurisdictionthat worry,anxiety,oremotionalstressofageneralnatureisnot,inandofitself,sufficienttoestablishaninjurybyaccident.Cabev.UnionCarbideCorp.,644S.W.2d397,399(Tenn.1983).SeeFinkv.Caudle,856S.W.2d952,958(Tenn.1993)(holdingthataninjurybyaccidentisonewhichcannotbereasonablyanticipated,isunexpectedandisprecipitatedbyunusualcombinationsoffortuitouscircumstances)andSextonv.ScottCounty,785S.W.2d814,816(Tenn.1990)(holdingthatifrecoveryistobeallowedbecauseofthephysicalresultsofstress,theremustbeaspecificincidentofstresswhichconstitutestheaccident).TheChancellorsuccinctlyabridgedtheproofbyobservingthat iftheplaintiffcanrecoverforthis,thenvirtuallyanystrokesufferedonthejobatanykindofworkwouldbecompensable.
