TheplaintiffallegedthatheinjuredhisbackinanunexplainedmanneronAugust20,1993whileworkingforUniversalTire,Inc.,thathemightnotbeabletoreturntohisnormaloccupation,andthatanybenefitshewasawardedshouldbepaidinalumpsum.Totheseallegationstheemployersinsurerenteredageneraldenial.Trialresultedinafindingthatthemedicalproofis notobjectivelystrongwithsomeinferencethattheplaintiffisexaggeratinghislimitations.Theplaintiffwasfoundtobetenpercentpermanentlypartiallydisabledandwasawardedbenefitsaccordingly.Thedefendantappeals,insistingthattheevidencepreponderatesagainstthejudgment.Weagree,andaccordinglyreverseanddismissthecomplaint. Theplaintifftestifiedthathe pulledmybackwhileliftingalawnmower.Threedayslaterhesawhisfamilyphysician,whoreferredhimtoDr.FredKillefer,anorthopedicspecialist,whoprescribedconservativetreatment,andadvisedtheplaintifftoreturntowork. TheplaintiffthereuponsoughttheservicesofDr.CletusMcMahon,alsoanorthopedicspecialist,whosawtheplaintiffinonNovember8,1993anddiagnosedalumbarstrain.Hetestifiedthathefoundnoobjectiveindicationsofinjury;thathisdiagnosisoflumbarstrainandevaluationoffivepercentimpairmentwasentirelypredicatedonsubjectivecomplaints;thattheplaintiffwasexaggeratinghispain;thathedoubtedwhethertheplaintiffwastruthful.Dr.McMahonthensaid:           Q:Andbecauseyoudonotknowwhetherhestellingyouthetruthabouttheonlyfinding,subjectivecomplaintsofpain,itsspeculativewhetherornotheactuallyhasanypermanentimpairment,isntthatright?A:Thatstrue,yessir.   H   Dr.Killefertestifiedthathefoundnoindicationofinjuryandthattheplaintiffhadnophysicalimpairment.
