PlaintiffinjuredherarmsandwristswhileworkingfordefendantinApril1994.Thetrialjudgeawardedher35percentpermanentpartialdisabilitytoeachupperextremity. Weaffirmthejudgmentofthetrialcourt. Plaintiffwasworkingonanassemblyline,feedingmagazinepagesintoasorter,whenawoodenpalletslidontoherarms,causingpain.Shewasplacedonlightdutyandworewristsplintsforatleastamonth,butwhenshereturnedtofullduty,shehadarecurrenceofpain,numbnessandtingling. Dr.W.CooperBeazley,orthopedicsurgeon,diagnosedplaintiffwithoverusesyndromeinbothhandsandtoldhertoconsiderchangingtoajobwhereshewouldnothavetoperformrapid,repetitiousworkwithherhands.However,hedidnotassessanymedicalimpairmentunderAMAGuidelinesbecausetheGuidesdonotprovideforapermanentimpairmentratingforoverusesyndrome. Dr.LloydWalwyn,orthopedicsurgeon,conductedanindependentmedicalexaminationincludingobjectivetesting.Hediagnosedcumulativetraumadisorderwithmildbilateralcarpaltunnelsyndromeandassessed28percentpermanentpartialimpairmenttoeachupperextremity. Theemployermadeeffortstoputplaintiffbacktoworkwithherpostinjurylimitations,buttherewasnoworkavailableatthefactorythatshewasabletodo. Plaintiffis26yearsoldwithahighschooleducationandworkexperiencemostlyinfactorywork.Thetrialjudgefoundthattheinjuryplaintiffsustainedreducedherabilitytocompeteintheopenjobmarketbecauseitpermanentlyaffectedheruseofherhands.Healsofoundhertestimonythatshehaspaintobeconvincing. Ourreviewisdenovoupontherecordaccompaniedbythepresumptionthatthefindingsoffactofthetrialjudgearecorrectunlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.506225(e)(2). Theremustbemedicalevidencetoshowanimpairmentexists,unlesstheimpairmentisobvious,tosupportanawardofpermanentdisability.However,thetrialjudgemay,whenthereisadifferenceinopinionbetweentheexperts,accepttheopinionofoneormoreovertheopinionofanotherorothers.Johnsonv.Midwesco,Inc.,801S.W.2d804(Tenn.1990).Thetestimonyofexpertwitnessesmustbeconsideredinconjunctionwiththeemployeeandotherlaywitnesses.Thomasv.AetnaLifeIns.Co.,812S.W.2d278(Tenn.1991). Thetrialjudgeconsideredthedepositiontestimonyofbothplaintiffstreatingphysicianandherindependentmedicalexaminerandfoundthatthetwowerenotasfarapartasitfirstseemed.Bothdoctorssaidshewouldhavedifficultydoingrepetitivemotionswithherhands,althoughonlyoneassessedpermanentdisability.Theplaintiffstestimonyaboutherdifficultiesandpainwascredibleand,consideringalltheevidence,thetrialjudgefoundhertohave35percentpermanentpartialdisabilitytoeachupperextremity.
