àThe€plaintiffððs€job€with€the€telephone€company€was€that€of€a€cable€splicer€andÏrepairman.€€During€the€course€of€his€employment,€he€sustained€a€laceration€to€the€extensorÏtendon€of€his€right€hand,€on€October€25,€1994,€involving€the€index,€middle€and€ring€fingers,Ïwhich€was€repaired€by€Dr.€Keith€Morrison,€an€orthopedic€surgeon€in€Bowling€Green,ÏKentucky,€under€whose€care€he€remained€until€February€22,€1995.€€On€that€date,€Dr.ÏMorrison€noted:ÌÓÓÌà0 àMr.€Napier€is€now€4€months€status€post€extensor€tendon€repair€on€his€right€hand.€ÏFour€tendons€repaired€to€the€index€finger,€slips€to€the€middle€and€ring€finger€on€theÏright€hand.€€His€EXAM€today€shows€some€improvement.€€He€still€lacks€full€extensionÏon€the€index€finger€by€about€œ20dg›€when€his€wrist€is€brought€into€extension.€€With€theÏwrist€in€the€flexed€position,€he€has€full€extension€of€the€hand.€€He€has€full€flexion€of€allÏthe€digits€with€his€only€limitation€being€the€lack€of€full€extension€on€the€index€fingerÏwith€his€wrist€in€the€above€mentioned€extension€position.€€They€would€like€to€get€aÏsecond€opinion€for€insurance€reasons€so€we€are€going€to€see€him€back€in€1€month.€ÏAt€that€time€he€will€be€5€months€out.€€I€recommend€tenolysis€exploration.€€If€he€is€stillÏdissatisfied€with€the€result.€€Overall,€he€has€made€a€big€improvement,€having€had€noÏactive€extension€of€the€fingers€on€repair.€€He€remains€neurovascularly€intact.€ÏOtherwise,€no€loss€of€sensation.ÌÓÓÌà àThe€plaintiff€was€later€seen,€on€March€15,€1995€by€Dr.€Stephen€Pratt,€a€specialist€inÏreconstructive€hand€surgery,€because€of€a€30€degree€lag€in€the€index€finger.€€Further€tendonÏrepairs€were€undertaken€to€correct€the€lag.€€Dr.€Pratt€testified€that€the€plaintiff€ð ðdid€very€well€inÏthe€post„operative€period.€€Was€fairly€cooperative€with€his€therapy.€€Seemed€to€heal€okay.ððÌà àHe€saw€the€plaintiff€last€on€May€2,€1995€ð ðto€see€what€type€of€impairment€I€thought€heÏwould€have.ðð€€He€testified,€€ð ðThe€EIP€joint€of€the€second,€third€and€fourth€were€okay€except€forÍthe€third€finger.€€And€I€said€he€had€a€lag€of€five€degrees€there,€although€I€did€not€rate€himÏbased€on€that€thinking€that€this€would€gradually€resolve.ðð€€When€asked€about€the€futureÏcondition€of€the€hand,€Dr.€Pratt€testified,€ð ðWell€I€would€think€that€he€should€do€very€well.€ÏExtensor€tendon€repairs€or€problems€are€usually€not€very€limiting.ðð€€He€recommended€thatÏthe€plaintiff€return€to€his€job€with€no€restrictions€and€was€of€the€opinion€that€he€had€noÏimpairment.Ìà àThe€plaintiff€was€thereupon€referred€by€his€attorney€to€Dr.€Robert€Paul€Landsberg,€anÏorthopedic€surgeon€practicing€in€Goodlettsville,€Tennessee€for€evaluation.€€In€a€manner€notÏentirely€clear,€Dr.€Landsberg€parlayed€the€hand€injury€to€ð ðright€upper€extremity.ðð€€He€testified:ÌÓÓÌà0 àQ.à àDoctor,€as€I€understand€it,€what€youððve€stated€here€is€that€you€found€a€total€ofÏ4€percent€to€the€hand€as€a€result€of€his€flexion€loss€of€his€fingers;€is€that€correct?Ìà0 àA.à àWell,€using€the€guidelines,€itððs€a€4€percent€ð ðupper€extremity€impairmentÏrating,ðð€not€a€4€percent€hand€impairment€rating.Ìà0 àQ.à àItððs€also€4€percent€to€the€hand€impairment€rating€too,€is€it€not,€using€theÏguidelines?Ìà0 àA.à àWell,€let€me€see.Ìà0 àQ.à àBeing€fair€with€everybody,€just€let€me€back€up€just€a€minute.€€The€fact€is,€this€isÏa€hand€injury,€is€it€not?Ìà0 àA.à àYes.Ìà0 àQ.à àI€mean,€the€arm€wasnððt€injured,€the€shoulder€wasnððt€injured,€his€elbow€„„€it€wasÏthe€outer€part€of€his€hand,€as€I€understand€it;€is€that€correct?Ìà0 àA.à àYes.Ìà0 àQ.à àAnd€that€was€the€only€part€that€was,€in€fact,€injured,€wasnððt€it?Ìà àA.à àYes.Ìà0 àQ.à àOkay.€€At€that€level€is€4€percent€to€the€hand.€€Now,€you€also€use€a€loss€of€gripÏstrength€„„€what€is€the€loss€of€grip€œstrenth›[sic]€AMA€Guidelines€percentage€of€disabilityÏto€the€hand?Ìà0 àA.à àWell,€it€only€„„€you€see,€the€AMA€Guides€only€gives€an€upper€extremityÏimpairment€rating.€€The€AMA€Guidelines€doesnððt€know€what€the€tendency€to€„„Ïwhether€itððs€concerned€with€the€hand€or€upper€extremity,€so€it€just€gives€an€upperÏextremity€kind€of€rating.€€One€can€extrapolate€backwards€to€give€an€impairment€ratingÍto€the€hand,€if€one€really€wanted€to,€because€itððs€his€hand€thatððs€non„functioning€thatððsÏcausing€the€impairment€in€the€grip€strength.Ìà0 àQ.à àBut€youððve€not€done€that,€is€that€correct?Ìà0 àA.à àNo.€€I€have€not,€but€I€could.€€That€would€be€an€11€percent€to€the€hand.€€A€10Ïpercent€upper€extremity€impairment€rating€is€an€11€percent€hand€impairment€rating.Ìà0 àQ.à àOkay.€€So€10€percent€„„€so€what€youððre€saying,€again,€then€effectively€to€hisÏhand€a€15€percent€AMA€Guideline;€is€that€what€weððre€saying?€€Iððm€not€trying€to€tellÏyou€what€youððre€saying.€€Is€that€correct?Ìà àA.à àYes.Ìà àQ.à àOr€is€it€11€percent?Ìà0 àAà àItððs€11€and€a€4€combined€for€a€15€percent€impairment€rating€to€the€hand.Ìà0 àQ.à àOkay.€€Now,€how€many€surgeries€of€this€type€have€you€done,€Doctor?Ìà0 àA.à àIn€the€last€15€years?Ìà0 àQ.à àYes.€€Give€me€a€rough€ballpark.Ìà0 àA.à àProbably€repair€extensor€tendons€„„€we€take€call€in€the€emergency€room,€youÏknow,€every€6th€or€7th€night.€€And€you€can€expect€one€of€the€„„€an€extensor€tendonÏlaceration€to€a€hand€to€show€up€every€other€time.€€You€could€average€about€one€aÏmonth€of€these€for€the€last€15€years€or€more.€€I€donððt€know.Ìà0 àQ.à àNow,€Dr.€Pratt,€you€recognize€him€as€an€expert€in€hand€injuries,€do€you€not?Ìà àA.à àYes.Ìà0 àQ.à àAnd€he€indicated€that€this€injury€did€not€cause€any€„€would€not€cause€any€gripÏstrength€loss.€€Why€the€difference€of€opinion?Ìà0 àA.à àI€donððt€know€why€Dr.€Pratt€came€up€with€that.Ìà0 àQ.à àHe€indicated€the€tendon€in€the€back€of€the€hand€had€nothing€to€do€with€gripÏstrength.€€And€I€think€Iððm€quoting€correctly€from€his€deposition.Ìà0 àA.à àThe€problem€with€the€tendons€in€the€back€of€the€hand€is€that€they€help€inÏpositioning€and€opening€the€hand,€and,€as€we€know,€he€has€this€deformity€whereÏwhen€he€goes€to€straighten€his€wrist,€his€fingers€bend.€€The€most€powerful€gripÏstrength€is€with€the€wrist€extended€about€20€to€30€degrees.€€If€he€canððt€fully€grip€theÏJamar€dynamometer€properly€with€his€wrist€in€the€most€strong€position,€then€heððsÏgoing€to€have€a€decrease€in€grip€strength,€plus€he€has€discomfort€which€has€led€to€goÏon€to€have€weakness€because€of€his€injury.ððÌà0 àQ.à àAlso,€Dr.€Pratt€indicated€that€excessive€cigarette€smoking€could€be€just€asÏlikely€to€cause€his€cold€hands€as€this€injury.€€Would€you€agree€or€disagree?Ìà àA.à àWell€„„Ìà0 àQ.à àIn€other€words,€vascular€problems?Ìà0 àA.à àYes.€€Excessive€cigarette€smoking€can€cause€vascular€problems,€but€it€shouldÏaffect€both€hands€equally,€one€would€think.Ìà0 àQ.à àAnd€he€also€indicated€that€perhaps€this€gentleman€was€not€using€his€handÏenough.Ìà0 àA.à àWell,€heððs€not€using€his€„„Ìà àQ.à àHand€enough.Ìà0 àA.à àWell,€I€agree.€€Heððs€not€using€his€hand€anywhere€near€as€much€as€he€wasÏbefore,€because€itððs€uncomfortable€for€him€and€it€produces€discomfort€and€thatððs€oneÏof€the€reasons€why€he€has€weakness€as€well.Ìà0 àQ.à àDoctor,€you€gave€him€some€limitations€and€Dr.€Pratt€gave€him€none.€€Can€youÏaccount€for€the€reason€for€that?Ìà0 àA.à àNo.€€Itððs€just€my€opinion€from€examining€him€and€measuring€his€grip€strengthÏand€from€listening€to€his€story€about€the€things€that€he€can€and€cannot€do.€€I€had€noÏreason€to€disbelieve€the€things€that€he€told€me,€and€therefore,€I€felt€that€he€shouldÏhave€certain€restrictions€and€limitations.ÌÓÓÌà àThe€testimony€of€the€plaintiff€was€directed€in€large€measure€to€the€shortcomings€of€Dr.ÏPratt,€and€œto€his›€praise€of€Dr.€Landsberg,€with€respect€to€the€kinds€of€tests€each€performed.€ÏHe€demonstrated€to€the€trial€judge€his€asserted€inability€to€make€a€fist;€in€point€of€fact,Ïcounsel€persuaded€the€trial€judge€to€make€a€diagnosis€based€upon€the€purely€subjectiveÏdemonstration€of€the€plaintiff.€€This€colloquy€is€instructive€of€the€point.ÌÓÓÌà0 àYour€Honor,€I€would€suggest€to€the€Court€that€it€[a€measurement€conducted€byÏcounsel]€shows€at€least€three€to€four€inches,€but€he€lacks€even€making€€fist.ÌÓ  Ó*€€*€€*ÌÓ  Óà0 àTHE€COURT:€€.€.€.€Iððll€let€the€record€reflect€itððs€probably€about€an€inch„and„a„half€to€hisÏindex€finger.€€Itððs€about€at€a€90€degree€angle,€letððs€just€say€about€90€degrees€and€itððsÏsome€inch„an„a„half€up€to€the€base€of€his€thumb€also.€€His€index€finger,€Iððm€talkingÏabout€the€base€of€the€finger€itððs€about€an€inch„and„a„half€gap€there.Ìà0 àMR.€FARRAR:€€Could€Your€Honor,€for€the€recordððs€sake,€let€the€record€reveal€how€farÏhis€fingers€lack€touching€the€inside€of€his€hand?Ìà0 àTHE€COURT:€€An€inch„and„a„half,€in€my€opinion.ÌÓÓ€Ìà àThe€trial€judge€found€that€the€injury€was€confined€to€the€plaintiffððs€right€hand€„„Ïapparently€in€response€to€the€testimony€of€Dr.€Landsberg€„„€but€that€ð ðI€disagree€with€Dr.€PrattÏgiving€him€a€zero€evaluation.ðð€€He€then€discussed€the€litany€of€activities€the€plaintiff€wasÏunable€to€perform€[carrying€blocks,€using€a€hammer,€pulling€heavy€timbers,€spray„painting,Íchanging€tires]€which€was€seemingly€confirmed€by€his€in„court€testing€of€the€plaintiffððs€abilityÏto€extend€his€wrist.€€While€these€demonstrations,€and€the€courtððs€conclusions€therefrom,€doÏnot€approach€the€extrajudicial€observations€as€reported€in€òòVaughn€v.€Shelby€Williams€ofÏTennessee,€Inc.óó,€813€S.W.2d€132€(Tenn.€1991),€we€think€the€trial€judge€inadvertentlyÏbecame€a€witness€in€the€case€as€evidenced€by€the€conclusion€he€announced€as€reproducedÏin€the€colloquy.€€He€found€that€the€plaintiff€has€a€75€percent€permanent€partial€disability€to€hisÏright€hand.€€The€defendant€appeals,€asserting€the€excessiveness€of€this€award.Ìà àWhile€the€extent€of€vocational€disability€can€be€established€by€lay€testimony,€òòPerkinsÏv.€Enterprise€Truck€Lines,€Inc.óó,€896€S.W.2d€123,€127€(Tenn.€1995),€and€the€œcredibility›€ofÏwitnesses€is€for€the€trial€judge€to€determine,€òòWalls€v.€Magnolia€Truck€Lines,€Inc.6óó22€S.W.2dÏ526,€528€(Tenn.€1981),€we€think€the€proof€in€this€case€falls€short€of€establishing€that€theÏplaintiffððs€hand€is€crippled€to€the€extent€of€75%.€It€is€not€disputed€(1)€that€the€plaintiff€returnedÏto€his€employment;€(2)€that€he€was€able€to€return€to€work€and€was€able€to€do€the€job€that€heÏhad€before;€(3)€and€that€he€performs€the€job€satisfactorily.Ìà àThe€treating€physicians,€especially€Dr.€Pratt,€testified€firmly€that€the€plaintiff€had€noÏimpairment,€and€his€testimony€that€the€tendons€involved€in€the€injury€have€nothing€to€do€withÏgrip€strength€was€not€essentially€refuted.€€This€point€is€significant€since€much€of€the€record€isÏgiven€over€to€testimony€about€and€discussion€of€the€loss€of€grip€strength.€€Dr.€LandsbergÏopined€that€the€plaintiff€had€a€15€percent€impairment,€most€of€which€he€attributed€to€loss€ofÏgrip€strength.Ìà àFrom€a€common„sense€point€of€view€it€seems€obvious€that€the€treating€physician€isÏbetter€advantaged€to€provide€an€in„depth€opinion,€if€not€a€more€accurate€one,€of€anyÍresulting€impairment€or€disability€than€is€a€physician€hired€by€the€employee€to€evaluate€hisÏcondition.€€òòOrman€v.€Williams€Sonoma,€Inc.,óó€803€S.W.2d€672,€677€(Tenn.€1991).€€This€is€notÏto€say€that€the€opinion€of€an€evaluating€physician€has€no€weight;€it€frequently€does€andÏshould€be€considered€in€conjunction€with€all€of€the€evidence.€€In€this€case,€the€testimony€ofÏthe€treating€physician€was€debunked,€without€elaboration.€€We€have€read€the€testimonyÏcarefully€and€conclude€that€we€must€respectfully€disagree€with€the€trial€judge,€as€is€ourÏprerogative,€òòCooper€v.€INAóó,€884€S.W.2d€œ446,€451›€(Tenn.€1994)€concerning€the€weight€andÏeffect€to€be€accorded€the€testimony€of€Dr.€Pratt,€a€recognized€specialist€in€the€treatment€ofÏhand€injuries.€€We€find€the€evidence€preponderates€against€a€finding€of€75%€permanentÏpartial€disability€to€the€right€hand€and€preponderates€in€favor€of€an€award€of€25€percentÏpermanent€partial€disability€to€the€right€hand.€€As€modified,€the€judgment€is€affirmed€withÏcosts€on€appeal€assessed€to€the€appellee.€€The€case€is€remanded€for€all€appropriateÏpurposes.ÌÓÓÌà
