Thetrialcourtdismissedtheplaintiffspetitionforworkerscompensationbenefits. Theplaintiffraisesthefollowingissues:   I.8 ThetrialcourterredinfindingthatthealtercationbetweentheplaintiffandThomasWilson,acoemployee,wasnotan accidentsufficienttojustifyanϜawardofworkerscompensationbenefits. II.8 Thetrialcourterredinfindingthatthemedicalevidencewasinsufficienttojustifyanawardbasedonamentalornervousdisorder.   Weaffirmthejudgmentofthetrialcourt. TheplaintiffinthecasewasemployedasasupervisoratPargos,Inc.,arestaurant. OnJanuary27,1994,duringthelunchhour,theplaintiffbecameinvolvedinanexchangewithacookoveranorder.Theevidenceshowstheplaintiffenteredthekitchentoreprimandthecook.Theplaintiffpointedhisfingeratthecooksfaceashespoketohim.Thereisadisputebetweentheplaintiffandtheotherwitnessesaboutwhatthenoccurred. Theplaintifftestifiedthecookstruckhimontheneckwithhisarm,andthathefelltothefloorasaresultoftheblow.Theplaintiffwastheonlywitnesstogivethishistoryoftheconfrontation.Theotherwitnessestestifiedthecookplacedhishandontheplaintiffsfaceandpushedhimaway.Allofthesewitnessestestifiedtheplaintiffdidnotfall. Thedayfollowingtheincident,theplaintiffbecameemotionallyupsetandhadtoleavework.Basically,theplaintiffwasneversuccessfullyemployedafterthistimebecausehismentalconditionseemedtodeteriorate. TheChancellorsmemorandumstatedinitsmostpertinentpartasfollows:  8  TheCourtfindsthatthealtercationonJanuary27,1994betweentheplaintiffandMr.Wilsondidnotamounttoan accidentsufficienttojustifyanaward.Whiletheplaintiffclaimsthattheplaintiffassaultedhimwithsuchforcesufficienttocausehimtofalltothefloorandsufferfromneckstiffness,evidenceintherecordandtestimonyattrialdonotsupportsuchaconclusion.Testimonyattrialbycoworkerswhowitnessedthealtercationreportsthattheplaintiffbeganthealtercationbyverballyinsultingthelinecook.TheplaintiffthenproceededtoenterthekitchenandputhisfingerinMr.Wilsonsfaceashespoke.Mr.Wilsonthenshovedtheplaintiff.PlaintiffsustainednophysicalinjuriesfromthisassaultbyMr.Wilson.  Ӝ̛ Ourreviewofthefindingsoffactmadebythetrialcourtisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofthecorrectnessofthefinding,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.506225(e)(2).Stonev.CityofMcMinnville,896S.W.2d584(Tenn.1991). ThetrialcourtheldthattheplaintiffhadfailedtoshowhesustainedaninjurybyaccidentwithinthemeaningoftheWorkersCompensationLaw. Thetrialjudgefoundtheincidentcomplainedofinthiscasedidnotexceedthestressandstrainofeverydaylife,andthereforethiscaseiscontrolledbytheCourtsholdinginJosev.Equifax,556S.W.2d82(Tenn.1977),whichheld:  8 Thestatutorycriterionforinjurybyaccidentdoesnotembraceeverystressorstrainofdailylivingoreveryundesireableexperienceencounteredincarryingoutthedutiesofacontractofemployment.̛  Ӝ WeconcurintheconclusionsreachedbytheChancellor.̛ Weseenoneedtosetoutthemedicalevidenceinthiscase.Thetrialcourtfoundtherewasnocrediblemedicalevidencetosupporttheplaintiffsclaimthathispsychiatricillnesswascausedbytheincidentwhichoccurred.Wehavereviewedthemedicalevidence,whichisbydepositiontestimonyandreports,andfindtheChancellorsfindingsonthemedicalevidenceiscorrect.
