Plaintiffinjuredherrightarm,shoulderandneckatworkonSeptember26,1988.Thetrialcourtawarded24percentpermanentpartialdisabilitytothebodyasawhole.Further,thetrialcourtorderedacredittotheemployerfortemporarytotaldisabilitybenefitspaidafterMay5,1992,thedatethecourtfoundasplaintiff'sdateofmaximummedicalimprovement. Weaffirmthejudgmentofthetrialcourt. Plaintiffis38yearsoldwithacollegedegree.WhileworkingasarecreationspecialistatVanderbiltChildandAdolescentPsychiatricHospital,shewasinjuredassheattemptedtocatchafallingpatient.ShewastreatedintheEmergencyRoomforacutethoracicstrainbutcontinuedtohavepain. FurtherevaluationledtosurgicalremovaloftorncartilageandthedistalclavicleonAugust2,1990byDr.J.WillisOglesby.Shedidnotimprove,andsubsequentlybeganseeingDr.JohnCampa,aneurologist,onJuly1,1991. Dr.Campatreatedplaintiffwithnerveblocks,injections,physiotherapy,biofeedbackandantidepressantmedications.HediagnosedC56subligamentousdiskprotrusionwithsecondaryradiculopathyandC67degenerativediskdiseasewithsecondaryradiculopathy.Heopinedsherequiresfurtherrehabilitation,includingfuturesurgery,toimprovefunctioningandpermitlighttomediumwork.OnJuly21,1993,whenplaintiffadvisedshedidnotchoosetohavetherecommendedsurgery,Dr.Campaopinedthatthereforeshehadreachedmaximummedicalimprovement,andassessed24percentmedicalimpairmenttothebodyasawholeunderAMAGuidelines.  DuringtheperiodwhenplaintiffwasbeingtreatedbyDr.Campa,shewassentbacktoDr.Oglesby,thesurgeon,foranindependentmedicalexaminationonMay5,1992.Dr.Oglesbyopinedshehadreachedmaximummedicalimprovementasofthatdate.Heassessed10percentpermanentpartialdisabilitytoherrightupperextremityusingtheguidelinesoftheAmericanAcademyofOrthopedicSurgeons.Helimitedherworktoexcludeliftingandoverheaduseoftherightarmandopinedshecouldnotreturntoworkwherepeoplemightgrabherarm. Thetrialjudgesetplaintiff'spermanentpartialdisabilityat24percenttothebodyasawhole.Inmakingthisdetermination,heconsideredplaintiff'sage,educationandworkhistory.Heconsideredhertestimonyaboutcontinuingpaininhershoulderandtinglinginherhand.Henotedthatsheisnowselfemployedandhasheldvariousjobssinceherinjury,andopinedthatsheiseminentlyemployable,evenwithherdisability.WefindthatthetrialjudgecorrectlyappliedthefactorsinCorcoranv.FosterAutoGMC,Inc.,746S.W.2d452(Tenn.1988)andweaffirmtheawardof24percentpermanentpartialdisabilitytothebodyasawhole. Thetrialjudgedecidedthefactualissueofplaintiff'sdateofmaximummedicalimprovementinfavorofMay5,1992,thedatesetbyhersurgeon,Dr.Oglesby,ratherthanJuly1,1993,thedategivenbyDr.Campa. IndeterminingthatplaintiffwasnotentitledtotemporarydisabilitybenefitsafterMay5,1992,thetrialjudgeconsiderednotonlyhersurgeon'sassessmentofthedateofmaximummedicalimprovement,butalsothefactthatplaintiffreceivedunemploymentcompensationbenefitsduringthatperiod,conductinconsistentwithhercontentionthatshewastotallydisabled.Further,plaintiffappliedforvariousjobsduringthattime.Therewasampleevidencetosupportthecourt'sfindingoffact. Ourreviewisdenovoontherecordwithapresumptionthatthefindingsoffactofthetrialcourtarecorrectunlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.506225(e)(2).Wefindthatthetrialjudgedidnoterrinsettingplaintiff'sdateofmaximummedicalimprovementasMay5,1992andweaffirmthejudgmentinthisrespect.
