Thetrialcourtfoundthattheplaintifffailedtocarryherburdenofprovingthatshesustainedapermanentdisablinginjury,afindingbaseduponassessingthecredibilityofthewitnesses.Giventheconsiderabledeferencewemustgivetothetrialcourtscredibilitydeterminations,McCalebv.SaturnCorp.,910S.W.2d412(Tenn.1995)andthepresumptionofcorrectnessofthetrialcourtsfindings,Tenn.CodeAnn.506225(e)(2),weaffirmthetrialcourtsdecision. TheplaintiffworkedforPremierManufacturingSupportServices,Inc.,acontractorattheSpringHillSaturnautomobileassemblyplant.ThecompanyperformedavarietyofservicesforSaturn,includingcleaningtheinteriorsofbuildingsandmaintainingthegrounds.Theplaintiffworkedatseveralinsideandoutsidejobsbeforeshesoughtandreceivedajobdrivingcarsofftheassemblyline. OnJanuary14,1994,thecartheplaintiffwasdrivingbackedintoalightpole.ShewastakentoaColumbiahospitalwhereshewastreatedandreleased. ThecompanysenttheplaintifftoDr.LarryLaughlin,anorthopedicsurgeon,whodiagnosedherashavingbackandneckstrain.Hereferredher͜toPinnacleRehabilitationforphysicaltherapy.OntheplaintiffssecondvisittoLaughlin,heconductedatestthatindicatedthattheplaintiffwasmagnifyinghersymptoms.ThefindingofaMRIwasnormal.Pinnacleconductedasymptommagnificationtestontheplaintiff,andshescoredafouroutoffive,whichmeanspositiveforsymptommagnification.Laughlintestifiedthathecouldnotfindanysignificantproblemswiththeplaintiffandhefoundnopermanentimpairment.Heplacednophysicalrestrictionsonherwork. TheplaintiffsawDr.RichardS.Lisella,aneurologist,aboutamonthaftertheaccident.Hethoughtshehadposttraumaheadandneckpain,whichheexpectedtoimprove,andhedidnotfindanypermanentimpairment.Hegavehernorestrictionsandtestifiedthatshecouldperformallthejobsshehadperformedinthepast. ThemedicalrecordsofneurosurgeonVaughnA.Allenwereintroducedinevidence.TheplaintiffsawDr.AllenfromJune1994throughFebruary1995.Hefilledoutaformindicatingthattheplaintiffsuffersa4%wholebodyimpairment.Atthesametime,though,henotedthathecouldnotfindanygoodreasonforthedifficultytheplaintiffwasdescribing. Incontrastthethisbenignmedicalevidence,theplaintifftestifiedtoconsiderabledisability.Shetestifiedthatsheisinconstantpain.Herleg givesway.Shecannotdriveforasmuchasthirtyminutes.Shecannotcutthegrassonaridinglawnmower.Shehasbadheadachesandnumbnessontheleftsideofherbody.Shecannotdothegroundmaintenanceshewasdoingwhenshewasdischarged.Shecannotevenvacuumherhouse.Shecannotpickupherfiveyearolddaughter.Theplaintifftestifiedshecouldnotdoherpreviousworkasabartender,conveniencestoreassistantmanager,andfloorpersonatadepartmentstore.Twooftheplaintiffsfriendstestifiedtotheirobservationsoftheplaintiffsphysicallimitations. Substantialevidencecontradictstheplaintiffstestimonyregardingdisability.First,ofcourse,istheminornatureoftheaccident.Shewasonlytravelingfivemilesperhourwhenthecarshewasdrivinghitthepole.ThenthereisthetestimonyofdoctorsLaughlinandLisellawhosawtheplaintiffshortlyaftertheaccident.Neitherofthemfoundanypermanentimpairment.AndLaughlinandPinnacleRehabilitationfoundthattheplaintiffwasmagnifyinghersymptoms. Whentheplaintiffreturnedtoworkalittleoveramonthfollowingtheaccident,shedidstrenuousoutsidegroundsmaintenanceuntilshewasdischargedforotherreasons.Thensheusedthegrievanceprocesstotrytogetbackthejobshetestifiedshecouldnolongerperform.Theplaintiffdrewunemploymentbenefits,forwhichshecertifiedshewasphysicallyabletowork. WilliamThomasFuller,aprivateinvestigator,filmedtheplaintiffatherhomeonNovember2223,1994,andhistestimonyandvideotapewereintroducedinevidence.Fullertestifiedthatheobservedtheplaintiffbendfullyatthewaist,pickuparug,andshakeit.Hesawhersweepherfrontporchandstepswithabroom.Hesawherpickupabarbequegrillandmoveit.Shethrewsomethingtoherdogs.Shecleanedoutacar. Theimagesonthevideotapearenotofthebestquality,buttheyclearlyshowanvigorous,activepersonworkingaroundtheoutsideofherhouse.Sherepeatedlybendsoveratthewaste.Shesweeps.Sheshakeswhatlookslikeawelcomemat.Sheplayswiththedogs.Shemovesthegrill.Shehopsupthefrontstepsandlaterbouncesdownthesteps.Noonecouldconcludethatthepersononthetapeissignificantlyimpaired.
