Atthetimeofthetrialtheplaintiffwasworkingatsubstantiallythesamejob,makingevenmoremoney.Whileshewouldsometimeshavetotakeabreaktorestherfoot,torelievepainandreduceswelling,shewasabletodotheworkeventhoughitinvolvedconstantstandingorwalking. Threephysicianstestifiedbydeposition.Dr.Kaelin,thetreatingphysician,opinedthatsheretaineda5%anatomicalimpairmenttotheleftfoot.Dr.Landsberg,whosawtheemployeeforanevaluationattherequestofherattorney,evaluatedherpermanentanatomicalimpairmentas14%totheleftfoot.Dr.Fishbein,alsoemployedbyherattorneytodetermineherpermanentimpairment,setheranatomicalimpairmentat7%. Thetrialjudgerenderedjudgmentbasedupona55%vocationalimpairmenttotheleftfoot.  @ THEISSUE Complaintismadethatthe55%impairmenttothefootisexcessive,andthatthecourterredinallowingthe$612.00costsofDr.Landsberg'sdepositionasapartofthediscretionarycosts.@ APPLICABLELAW Ourreviewisdenovaupontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectnessofthefindingsbelow,unlessthepreponderanceoftheevidenceisotherwise.TennesseeCodeAnnotatedSection506225(e)(2)(1991).Thisstandardofreviewrequiresthiscourttoweighindepththefactualfindingsandconclusionsofthetrialcourt.Humphreyv.DavidWitherspoon,Inc.,734S.W.2d315(Tenn.1987). Theissueofvocationaldisabilityisaquestionoffacttobedeterminedfromalloftheevidence,includinglayandexperttestimony.Worthingtonv.ModineMfg.Co.,798S.W.2d232,234(Tenn.1990). Amedicalexpert'sratingofanatomicaldisabilityisoneoftherelevantfactors,butthevocationaldisabilityisnotrestrictedtothepreciseestimateofanatomicaldisabilitymadebyamedicalwitness.Corcoranv.FosterAutoGMC,Inc.,746S.W.2d452,458(Tenn.1989). Whenthemedicaltestimonyispresentedbydeposition,asitwasinthiscase,thiscourtisabletomakeitsownindependentassessmentofthemedicalprooftodeterminewherethepreponderanceoftheevidencelies.Landersv.Fireman'sFundIns.Co.,775S.W.2d355,356(Tenn.1989);Hensonv.CityofLawrenceburg,851S.W.2d809,812(Tenn.1993).@ CONCLUSION Thisinjuredemployeehasreturnedtoherregularjob.Admittedly,shesometimessufferspainanddiscomfort;butithasnotdisabledher.Sheworkslonghoursandherpayisgreaterthanbeforetheaccident.Heremployer'srepresentativetestifiedthatsheisaverygoodemployeewhoseperformanceistotallysatisfactory. Itisourjudgmentthatsheshouldhaveajudgmentfor35%permanentpartialimpairmenttotheleftfoot,andwereducethejudgmentaccordingly. Theissueregardingdiscretionarycostsiswithoutmerit.
