Theclaimant,Ms.Toy,is56yearsoldwithahighschooleducationandcomputertraining.ShehasworkedforNationalLifesince1957asanofficeassistant.OnJuly15,1991,sheslippedandfell,landingonherbacksideandsufferingimmediateandlastingpain.Shehasworkedcontinuouslysincetheaccidentexceptforvacationsandholidays.  Shewastreatedbyanorthopedicsurgeon,whodiagnosedaggravationofpreexistingdegenerationandarthritis.Thedoctorprescribedconservativecareandestimatedherpermanentimpairmentatsevenpercenttothewholeperson.  Anotherorthopedicsurgeonestimatedherpermanentimpairmentatfivepercenttothewholeperson.Becauseofpain,theclaimanthasbeenrequiredtochangeherlifestyle,butisnotdisabledfromperformingherdutiesatwork.  Thetrialcourtawardedpermanentpartialdisabilitybenefitsbasedonfortypercenttothebodyasawhole.Theemployercontends,initsargument,theawardshouldnotexceedfifteenpercent.Appellatereviewofthejudgmentisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectnessofthefindingsoffact,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.section506225(e)(2).Thistribunalisrequiredtoconductanindependentexaminationoftherecordtodeterminewherethepreponderanceoftheevidencelies.Wingertv.GovernmentofSumnerCounty,908S.W.2d921(Tenn.1995).  Oncethecausationandpermanencyofaninjuryhavebeenestablishedbyexperttestimony,thecourtsmayconsidermanypertinentfactors,includingage,jobskills,education,training,durationofdisabilityandjobopportunitiesforthedisabled,inadditiontoanatomicalimpairment,forthepurposeofevaluatingtheextentofaclaimant'spermanentdisability.McCalebv.SaturnCorp.,910S.W.2d412(Tenn.1995).CompensatorydamagesarenotrecoverablefromanemployerundertheWorkers'CompensationAct,whichprovidesonlyfortherecoveryofcertainbenefits.  Fromaconsiderationoftherelevantfactorsinthiscase,particularlytheemployee'sage,jobskills,education,training,durationofdisabilityandmedicalimpairment,wefindtheevidencetopreponderateagainstanawardbasedonfortypercentandinfavorofonebasedontwentyfivepercenttothebodyasawhole.Thejudgmentismodifiedaccordingly.
