I    Thisactionwasfiledbytheemployeranditsinsurerasonefordeclaratoryjudgmentthat thiscaseneedstobeheardbytheCourttodeterminetherespectiverightsofthepartiespursuanttotheTennesseeWorkersCompensationAct,sincetheemployeewasclaimingabackinjurysustainedwhileassistingapatientduringthecourseofheremploymentbyClayCountyHospital. Thedefendantansweredandcounterclaimed,statingthatsheattemptedtokeepapatientfromfallingfromabedasaresultofwhichsheinjuredherback. TheChancellorfoundthattheaccidentoccurredasalleged,asaresultofwhichthedefendantwas70%vocationallydisabledandawardedbenefitsaccordingly.̀ Theplaintiffsappealandpresentforreview(1)whetherthefindingof70%disabilityisexcessive;(2)whetherthemultiplierwasexceeded,(3)whetherapartiallumpsumwasproperlyawarded.   II    Thedefendantisa38yearoldlicensedpracticalnurseandacertifiednursesaide.Shewasassistingapatientathomewhorolledfrombedandbothofthemhitthefloor.Asstatedbytheemployer,theonlyissueslitigatedweretheextentofpermanentpartialdisabilityandtherequestedcommutationoftheawardtoalumpsum. ShetestifiedthatshecouldnolongerperformthedutiesofanLPN. Dr.RayHester,aneurosurgeon,testifiedthatheinitiallysawthedefendantonSeptember14,1993.Shecomplainedofbackpainandhelaterdeterminedthatshehadaruptureddiscwhichsurgerywouldnotcorrect.Weightrestrictionswereimposed.Heopinedthatshehada5%impairmentforthoracicstrainanddiscruptureand10%impairmenttoherwholebodybecauseoflumbarradiculopathy,foracombinedratingof15%wholebodyimpairment. Dr.RobertE.Clendenin,anorthopedicspecialist,sawthedefendantonJuly19,994.Hetestifiedthatmostofhersymptomsweresubjective,thatshehadafivepercentimpairmentowingtothoracicstrainandthathercomplaintsweremagnified. Dr.RobertWeissexaminedthedefendant.Hetestifiedthathersubjectivecomplaintsweredisproportiontetoobjectivefindingsandthathersubjectivecomplaintswereinconsistent.TheMRI,myelogramandCTscanwereunremarkable,accordingtoDr.Weiss.   III    Ourstandardofreviewisdenovoontherecord,accompaniedbythepresumptionthatthetrialcourtsfindingsoffactarecorrectunlesstheevidenceotherwisepreponderates.T.C.A.506225(e)(2).Thejudgmentappearstobegenerousinlightoftheevidenceofmalingering,therelativelymodestanatomicalimpairment,theabsenceofsurgicalinterventionandtheemphasisfromwhateversourceonthedefendantsneedforfinancialassistance.Butwecannotsubstituteourjudgmentforthatofthetrialcourtandtakenasawholeweareunabletofindthattheevidencepreponderatesagainstthejudgment.   IV    AppellantcomplainsthatDr.HesterfailedtofollowtheA.M.A.Guidelines.Wehavereadthequestionspropoundedtohimalongthisline,andhisresponsesthereto,andagreewiththeChancellorthattheguidelinesweresubstantiallyadheredtoandthatthemultipliersmandatedbyT.C.A.506241(b)wereproperlyapplied.   V    TheChancellororderedthat$30,000.00oftheawardshouldbepaidinalumpsum.Weareunabletofindanabuseofdiscretion,sincethereisampleproofinthisrecordthatthedefendantisresponsible,matureandcapableofmoneymanagement.Thefundswillbeusedforhousing,apermanentasset,andnecessaryforaproperlivelihoodforthedefendantandherthreechildren.SeeBurrisv.CrossMountainCoalCo.,798S.W.2d745(Tenn.1990).
