Therelevantfactsarenotdisputed.TheworkperformedbytheseemployeewasatvariousjobsitesinTennesseeandotherstates.Ascompensation,theemployeesreceivedanhourlywageandaperdiemallowanceforlivingandtravelingexpenses.Theywereinjuredinaonecarautomobileaccidentafterworkontheirwayhome,whenthedriver,Valdez,lostcontrolofhiscar,causingittoleavetheroadandoverturn.  Thechancellorfoundtherewasnogenuineissueofmaterialfactantthattheemployerwasentitledtoajudgmentofdismissalasamatteroflaw.Appealsfromsummaryjudgmentinworkers'compensationcasesarecontrolledbyTenn.R.Civ.P.56.Downenv.AllstateIns.Co.,811S.W.2d523(Tenn.1991).Sincethematerialfactsarenotdisputed,theonlyissueforreviewiswhethertheemployerisentitledtojudgmentasamatteroflaw.  Foraninjurytobecompensable,itmustariseoutofandinthecourseofemployment.Asageneralrule,aninjurywhichoccurswhileanemployeeisenroutetoorfromworkisnotcompensablebecauseitdoesnotoccurinthecourseofemployment.Smithv.CamelMfg.Co.,192Tenn.670,241S.W.2d771(1951).Anexceptionmayexistiftheinjuryoccursontheemployer'spremisesoriftheemployeeisinjuredwhileusingtransportationprovidedbytheemployer.  Inthepresentcase,theundisputedfactsarethattheinjuriesoccurredawayfromtheworksiteorotherpremisesoftheemployerandthattransportationwasbeingfurnishedbyMr.Valdez,nottheemployer.Thecontentionoftheemployeesthattheyshouldbetreatedastravelingemployeesorthatthepaymentofaperdiemallowanceascompensationamountedtothefurnishingoftransportationisrespectfullyrejected.Thiscaseclearlyfallswithintheabovegeneralrule.
