PlaintiffdidnottellthemanagementatCadillacCurtainofherinjuryonthatdate.Thisfailurewasinviolationofaknowncompanypolicypostedontheemployeesbulletinboard. ` Plaintifftestifiedthatbythenextmorningherbackhad lockeduponherandshecouldnotgetoutofbed.ShestatedthatcoemployeeTommyLowearrivedatherhousethatmorningtotellhershewouldbefiredifshedidnotshowupatwork.However,shewentinsteadtothelocalhospitalemergencyroom.Shewasgivenanotebythetreatingphysicianatthehospital,excusingherfromwork.bb ` PlaintifffirstadvisedcompanyrepresentativesofherworkinjuryonMay17,1989.ThecompanysenthertoseeDr.WarrenA.AlexanderonMay18and 4506 May24.Dr.Alexanderadvisedplaintifftoengageonlyinlightwork.HethenreferredhertoDr.CraigClark,aneurosurgeon.Clarkprescribedmedicationandinstructedplaintifftomakeanotherappointment.However,whenheremployerrefusedtopayforfurthertreatment,plaintiffdidnotreturn. ` PlaintiffwasterminatedfromemploymentforgrossmisconductonMay25,1989.Heractionsincludedfailingtofollowcompanypolicyforhandlingworkrelatedinjuriesandattemptingtofileafalseworkerscompensationclaim. ` NoothermedicaltestimonywasintroducedconcerningthefirstfewyearsoftreatmentaftertheMay1989injury.bbbb  '  2      ׀PlaintiffwaslatertreatedforherinjuriesbyDr.  StevenDouglasBrandenburg,alicensedchiropractor.Dr.BrandenburgfirstexaminedplaintiffonJune22,1993.Atthattimeshecomplainedofneckpainandstiffness,lowbackpain,andtinglinginherarmsandherleftlegandfoot.Afterhehadtreatedherforsometime,shesaidthepainbecamelocatedontherightside.Heinitiallyopinedthatplaintiffhadsustainedasixpercentpermanentimpairmenttoherbodyasawhole,butlaterchangedhisevaluationtoaneight(8%)percentpermanentimpairmenttothebodyasawhole.Dr.Brandenburgadmittedthattheonlymedicalhistoryhehadtakenwasfromplaintiffherself,andthatctherewerecanumberofvariablesdthatdcouldhavecontributedtoherallegedinjuriestoherleftside.Hispermanentimpairmentratingwasbasedontestingandplaintiffscomplaintsofconstantpain,bothofwhichheacknowledgedweresomewhatsubjectiveandcouldbeinfluencedbythepatient.bbbb ` Attherequestofherattorney,plaintiffwasalsoexaminedbyDr.RobertP.ChristopheronMarch11,1994.Hisnotesindicatethatplaintiffsaidshefeltpaininthelowbackandlefthipatthetimeoftheaccident.Hereviewedxraystaken 4506 ofherlumbarspineandlefthiponedayaftertheallegedincidentandreportedthemasnormal.Dr.Christophersevaluationindicatedsofttissuelesionofthemidthoracicspineandsomesubscapularbursitisandsacroilitisontherightside.HisletteralsostatesthatanMRIperformedonplaintiffwasnegative.Basedonplaintiffssubjectivereportsofpaintohimandhissingleexaminationin1994,Dr.Christopherassignedaseven(7%)percentpermanentimpairmentratingtothebodyasawhole. ` Attrialplaintifftestifiedthatsincethe1989accidentshehashadtroublekeepingajobe,ebbbecausehernumerousbbphysicalproblemsbbaffectherperformance.bbShealsotestifiedthatshewasunabletodancewithoutagreatdealofpain.HertrialtestimonywasshowntobeinconsistentwithtestimonygivenbbinbbdepositionsinAprilbb1991bbandDecemberbb1994.bbbbPlaintiffbbdeniedattrialeversustaininganinjurytoherlefthip,butdiddiscusslefthipproblemsinherdepositions.AttrialanotherwitnessalsotestifiedthathehadseenherdanceseveraltimessinceMay1989andthatplaintiffdidnotseemtobeinmuchpain.ThesamewitnessalsodeniedgoingtoplaintiffshouseonMay16,1989,totellhershewouldbefiredifshedidnotreturntobbwork.fffgFgurther,plaintifftestifiedinher1991depositionthatsheleftonejobbecauseshewasnotneeded;shedeniedanyphysicaljobperformanceproblems.bb
