ShewasfirstreferredtoDr.CharlesStewart,whodiagnosedalacerationoftheleftwrist.Hesuturedthelaceration,butlaterreferredhertoDr.AnthonySegal,aneurosurgeon,whenshecontinuedtocomplain.  Dr.Segalconductednerveconductionstudiesandfoundmildnervedamageandpossiblereflexdystrophy.Dr.Segaltestifiedbydepositionbutassignednopermanentimpairment.  TheclaimantwenttoDr.JamesVarner,anorthopedicsurgeon.Dr.Varnerdiagnosedapartialsensorynervelacerationofthemediannerveandreflexdystrophysyndrome.Hetreatedherconditionwithmedication,physicaltherapyandastellateblock,andassessedapermanentanatomicalimpairmentoffifteenpercenttotheleftarm.Thedoctoradvisedhertoavoidrepetitiveuseoftheleftarm,butsaidshecouldperformjobsthatdidnotrequiresuchrepetitiveuse.Hesaidshewasnotimpairedfrompronatingandsupinatingherwrist.  Aphysicaltherapisttestifiedthatfunctionalcapacityevaluationtestswereinvalidbecausetheclaimantrefusedtoexertmaximumeffort.Theclaimanttestifiedthatherarmstayscoldallthetimeandthatsheisunabletoperformhouseholdchoressuchastwistingcapsfromjarsandopeningdoors.  Thetrialcourtawardedpermanentpartialdisabilitybenefitsonthebasisofeightypercenttotheleftarm.Appellatereviewisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectness,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.section506225(e)(2).  Indeterminingtheextentofvocationaldisability,thecourtsmustconsidermanyfactors,includingjobskills,education,age,training,durationofdisabilityandjobopportunitiesforthedisabled,inadditiontomedicalorclinicalimpairment.Worthingtonv.ModineMfg.Co.,798S.W.2d232,234(Tenn.1990).AsnotedinCorcoranv.FosterAutoGMC,Inc.,746S.W.2d452,458(Tenn.1988),thequestionisnotwhethertheemployeeisabletoreturntotheworkbeingperformedwheninjured,butwhethertheemployee'searningcapacityintheopenlabormarkethasbeendiminishedbytheresidualimpairmentcausedbyaworkrelatedinjury.  Thereislittleornoproofinthisrecordregardingtheclaimant'sdiminishedjobopportunities.Thepanelthusfindsthattheevidencepreponderatesagainstthetrialcourt'sawardandinfavorofonebasedonfiftypercenttotheleftarm.
