OnMarch4,1996,theplaintiffwasinjuredwhenstruckontheheadbyfallingcartonsofpizzadough.ACATscanrevealednocranialpathology,butowingtohiscontinuingcomplaints,theplaintiffwasextensivelytreatedandexaminedbyDr.R.A.Tyrer,Dr.RobertGreene,Jr.,andDr.GlennBarnett,II,neurosurgeons;Dr.RobertPusakulich,aclinicalpsychologist;andotherexperts.Theneurologistsadministeredvarioustests,includinganMRIofthebrain,MRIofthelumbarspine,MRIofthecervicalspine,andanMRIofthehead.Ahostofxrays,abonescanandaspinaltapcompletedthediagnostictesting.Theseexpertsfoundnodisability.Dr.Pusakulichbelievedthattheplaintiffwassufferingfroma greatdealoffinancialoverlay;sodidDr.Barnett.Dr.Pusakulichalsobelievedtheplaintiffdemonstratedaremarkablepsychogenicoverlay,asevidencedbyhiscomplaintofdoublevisionthat hesawdoublewithbotheyesopenandoneeyeclosed,aneuroanatomicalimpossibility. TheplaintiffwasreferredtoDr.TewfikE.Rizk,oftheSt.JosephHospitalRehabilitationCenter,byhisattorney.Onhisinitialexamination,Dr.Rizktestifiedthattheplaintiffhadaslow,slurredspeech,memoryloss,andwaslimpingontheleftside.Hisdiagnosiswasposttraumaticclosedheadinjurysyndromewithleftsidehemiparesis.Hedisagreedwiththeconclusionsoftheneurosurgeonsandthoughtthat somethingiswrongwithhis[plaintiffs]braincellsandhesnotwalkinggood.Heopinedthattheplaintiffhasa40percentimpairmenttohiswholeperson. Dr.SheenaRose,aclinicalpsychologist,testifiedthattheplaintiffhadnospeechimpairment,contrarytotheopinionofDr.Rizk. Finally,theplaintiffwasvideotaped,whichrevealedthathewalkedwithoutlimping,butwhenherealizedhewasunderscrutiny,hebeganlimpingonhisrightleg,ascontrastedtoapriorlimponhisleftside,asdescribedbyDr.Rizk. Ourreviewofthefindingsoffactmadebythetrialcourtisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofthecorrectnessofthefinding,unlessthepreponderanceoftheevidenceisotherwise.T.C.A.506225(e)(2),Spencerv.TowsonMovingandStorage,Inc.,922S.W.2d508(Tenn.1996);Skinnerv.CNAIns.Co.,824S.W.2d164(Tenn.1992).Wherethetrialjudgehasmadeadeterminationbaseduponthetestimonyofwitnesseswhomhehasseenandheard,greatdeferencemustbegiventothatfindingindeterminingwhethertheevidencepreponderatesagainstthetrialjudgesdetermination.SeeHumphreyv.DavidWitherspoon,Inc.,734S.W.2d315(Tenn.1987). Theburdenisontheplaintifftoprovethatheisentitledtoworkerscompensationbenefits,Smithv.EmpirePencilCo.,781S.W.2d833(Tenn.1989,)andthisburdenextendstoeachandeveryelementofplaintiffscase,includingpermanencyofdisability.Roarkv.LibertyMutualInsuranceCo.,793S.W.2d932(Tenn.1990). Theplaintiffscredibilitywasamajorissueinthiscase.Asidefromthefactthathewasaconvictedfelon(theft),heapparentlysetoutonacoursetodeceive,asforinstance,hedidnottellhispsychologist,Dr.SheenaRose,ofhisillegaluseofprescriptionmedication(Valium)andmarijuana. Hetestifiedthatsincehisinjuryhehasalwayswalkedwithalimp,whichclearlywasuntrue.Otherinstancesabound. Thepreponderanceoftheevidencesupportsthefindingsofthetrialjudgethattheplaintiffsufferednopermanentphysicalimpairment.TheopinionofDr.Rizkisnotveryweighty,givenhisrelianceupontherepresentationsandmisrepresentationsoftheplaintiff.Theimpairmentof15percentfor emotionalorbehavioralsymptomsis,fromtherecord,fortuitousfortheplaintiff,andtheevidencedoesnotpreponderateinfavorofagreateraward.
