Whethertheevidencepresentedattrialpreponderatesagainstthetrial 8  courtsawardof55%permanentpartialdisabilitytoplaintiffsleftlower extremityasaresultofplaintiffsworkrelatedaccident?II. Whetherthemedicalexpensesincurredbytheplaintiffwere (#    reasonable,necessaryandcausallyrelatedtoaninjuryarisingoutof thecourseandscopeofemployment?` O] ` Weaffirmthejudgmentofthetrialcourt. ` TheplaintiffwasinjuredonDecember14,1994whenacarbackedintoherandpennedherlegsbetweenthebumpersoftwocars.Theplaintiffwasperformingdutiesinthecourseofherworkforthedefendantwhenthisoccurred.Theplaintiffhadsignificantinjuriestoherleftleg. ` Asnearaswecantellfromthisrecord,theplaintiffwasabsentfromworkforaweek.Whenshewishedtoreturntowork,theemployertoldhershewouldhavetohaveareleasefromaphysiciantoreturn.Theemployerhadnotthen,norsofarasthisrecordlMlMshowsnever,furnishedtheplaintiffwithapanelofdoctorsforexaminationortreatment.lMlM ` Theplaintiffwas53yearsofageatthetimeoftrial,hasahighschooleducation,andhasninemonthsofbeautytraining.ShetestifiedthatshecontinuedtoworkforthedefendantforoneandahalfyearsafterherinjurybuthaddifficultyindoingtheworkbecauseshecouldnotstandforlongperiodsoftimeandhadtroublestoopinglMlMandlMlMbending. ` Weareoftheopinionthattheresolutionofthiscaseturnsuponwhetherthemedicalevidenceofferedbythedefendantwasadmissible. ` ThedefendantofferedasmedicalproofamemorandumreportbyJamesG.Warmbrod,anorthopedicsurgeon,aswellasvariousreportsfromphysical ;7> lMlMtherapistslMlMassociatedtherewith.ThedefendantofferedthesereportslMlMunderRule803(6),lMlMTenn.R.lMlMEvid.,lMlMasabusinessrecord.Thetrialjudgeheldtheywereadmissible.lMlMlMlMlMlM %  1      lMlM X  ` Tenn.CodeAnn.506235(2)(c)(2),whichwasamendedundertheActof1966ch.944entitled WorkersCompensationReformActof1966,"provides:` Thewrittenmedicalreportofatreatingorexaminingphysicianshallbeadmissibleatanystageofaworkerscompensationclaiminlieuofadepositionuponoralexamination,ifnoticeofintenttousetheswornstatementisprovidedtotheopposingpartyorcounselnotlessthantwenty(20)daysbeforethedateofintendeduse.Ifnoobjectionisfiledwithinten(10)daysofthereceiptofsuchnotice,theswornstatementshallbeadmissibleashereindescribed.Intheeventthatapartydoesobject,thentheobjectingpartyshalldeposethephysicianwithinareasonableperiodoftimeortheobjectionshallbedeemedtobewaived.`  ` ThedefendantdidnotgivenoticeunderTenn.CodeAnn.506235(2)(c)(2)ofitsintenttointroducethemedicalrecordswhichwereoffered.TheplaintiffhadnoopportunitytoobjecttothisandtakethedepositionofDr.Warmbrod,asprovidedbythestatute.Itseemsthelegislaturefashionedthisproceduretoreducethecostofpresentingevidenceinworkerscompensationcasesbutintendedtopreservetherightoftheadversepartytoexaminethewitnessconcerningthemedicalreport. ` WethinkinworkerscompensationcasesthatRulelMlM803(6),lMlMTenn.R.lMlMEvid.,lMlMisnotavailableforintroductionofmedicalrecordstouchingupontheinjury.lMlMRule803(6)lMlM,Tenn.R.Evid.,lMlMisgeneralinnatureandTenn.CodeAnn.506235(2)(c)(2)isspecificallydevotedtotheadmissionofmedicalevidenceinworkerscompensationcases.Wherethereisaconflictbetweenaspecificstatuteandageneralstatute,thespecificstatutewillbegiveneffect.Walkerv.FirstStateBank, |)%* 849S.W.2d337(Tenn.App.1992).Followingthisrule,wefindtheevidenceofferedbythedefendantwasinadmissibleandofnoeffectindeterminingtheissueinthiscase. ` TheonlymedicalevidenceproperlyenteredinthiscaseisthatofDr.RobertJ.Barnett,anorthopedicsurgeonwhoserecordswereintroducedinaccordancewithTenn.CodeAnn.506235(2)(c)(2).Dr.Barnettsreportreflectsthattheinjuryaroseoutoftheplaintiffsemploymentandthatshehassuffereda10percentpermanentimpairmenttotheleftlegdueto crepitationwhichisanearlyformof 7 4: arthritis.Dr.Barnettfoundtheplaintiffshouldnotclimb,stoop,kneel,crouch,crawl,etc. ` Thismedicalevidence,alongwiththetestimonyoftheplaintiffconcerningherinabilitytowork,issufficienttosupportthejudgmentofthetrialcourt. ` ThedefendantcomplainsthatthetrialjudgeshouldnothaveawardedtheplaintiffmedicalexpenseschargedbyDr.GlennBarnett,anorthopedicsurgeonwhosawtheplaintiffonareferralfromDr.Mandlesoffice,becausethedefendantdidnotauthorizethetreatmentandbecausetheplaintiffdidnotshowthechargeswerereasonable. ` Wethinkthedefendantmaynotprevailonitsclaimthatthemedicalcarewasnotauthorized.UnderTenn.CodeAnn.506204,theemployermustfurnishtheplaintiffwithatleastthreephysiciansforcare.Iftheemployerdoesnotdoso,theplaintiffmayseekmedicalcareandtheemployershallbeliableforthereasonablecostofthecare.SeeSimpsonv.FrontierCommunityCreditUnion,810S.W.2d147 \ (Tenn.1991);U.S.FidelityandGuar.Co.v.Morgan,795S.W.2d653(Tenn.1990). ,  ` ThedefendantmayhaveamoreviableargumentconcerningthenecessityofthetreatmentbyDr.GlennBarnettbutforthefactthatthedefendantdidnotfurnishtheplaintiffwithalistofphysicians.Infact,thedefendantacceptedthestatementoftheplaintiffsphysician,Dr.Mandle,indeterminingtheconditionoftheplaintiffvisavishermedicalconditionandreturntowork.Becausetheplaintiffcontinuedtohaveproblemswithherinjury,Dr.MandlereferredhertoDr.GlennBarnettfortreatment.TheplaintifftestifiedconcerningthetreatmentbyDr.GlennlMlMBarnett,lMlMandthetrialjudgeacceptedthebillasreasonable. ` IfthedefendanthadfurnishedtheplaintiffwiththenamesofthreephysiciansandshehadchosenoneofthesethreeandthephysicianschosenhadreferredtheplaintifftoDr.GlennBarnett,thentheburdenofprovingthemedicalbillwasunreasonablewouldbeuponthedefendant.Russellv.Genesco,Inc.,651S.W.2d 2.4 206(Tenn.1983). ` WebelieveinthiscasethatboththefailureofthedefendanttofurnishmedicalcareoralistofphysiciansandthedefendantsacceptanceofDr.Mandles medicalreportontheplaintiffsreturntoworkbringthemedicalbillindisputewithin 95< themeaningofRussellandplacetheburdenonthedefendanttodisprovethe  reasonablenessofthebill.  `
