Thisdeclaratoryjudgmentactionlikelycreatedaninterestthatotherwisemightnothaveexistedor,perhaps,mightnothavemanifesteditself.TheemployerfiledtheactionallegingthatitsemployeereportedthatsheexperiencedpaininherneckonAugust17,1995,thatshewassuccessfullytreatedandreturnedtoworkonSeptember12,1995,thathermedicalexpenseshadbeenpaid,andthattheplaintiff[employer]shouldbe dischargedfromresponsibilitytodefendant[employee]. Acounterclaimfollowedincourse,withtheemployeeallegingthatherneckinjuryresultedintemporarytotaldisability,temporarypartialdisability,permanentimpairmentanddisability,togetherwiththeincurrenceofmedicalexpenses. Thetrialcourtfoundtheissuesinfavoroftheemployeeandawardedherbenefitsbaseduponatwelveandonehalfpercentdisabilitytoherwholebody,thusentitlinghertoarecoveryof$20,793.50tobepaidinalumpsum.Byseparateordertheemployeewasawarded$600.00discretionarycosts. Theproprietyoftheseawardsisquestionedonappeal.Ourreviewofthefindingsoffactmadebythetrialcourtisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofthecorrectnessofthefinding,unlessthepreponderanceoftheevidenceisotherwise.T.C.A.506225(e)(2).Stonev.CityofMcMinnville,896S.W.2d548,550(Tenn.1995).    Theclaimantis37yearsold,withlimitedmarketableskills.Shewasinitiallyemployedin1991or1992,accordingtohertestimony.In1992 somethinghappenedtomyneckwhileloadingaspoolofwire.TwoorthreedayslatershewasreferredtoDr.Northcuttfortherapy,andshesoonreturnedtowork.InAugust1995sheinjuredherneckagain,andshewasreferredtoDr.Chastain,whotreatedherconservativelyandsoonreleasedhertoreturntowork. @ MedicalProof  Dr.LelandNorthcutt,achiropractor,testifiedthatheperformedascreeningexaminationofMs.Dunn,thathefoundheringoodhealthandemployable,thathenextsawherNovember12,1992whenshecomplainedofmidbackpain,thathetreatedherfourtimes,andthatshehadamilddiscdegenerationconsonantwiththeagingprocess.Hedidnotseeherforthe1995injury. 0 @ Dr.BenjaminChastain  Dr.Chastainiscertifiedinfamilypractice.HeinitiallysawMs.DunnonMay17,1995whocomplainedofupperrespiratoryproblems.HesawheragainonAugust17,1995forcomplaintsofneckpainwhichhediagnosedasacervicalstrain.Hedeclinedtostateanopinionaboutanyimpairment. @ Dr.DavidGaw  Dr.GawevaluatedMs.DunnonFebruary26,1996attherequestofherattorney.Hediagnosedmusclespasmontherightsideofherneckandintherighttrapeziusmuscles.HeopinedthatbasedontheAmericanMedicalAssociationGuidestotheEvaluationofPermanentImpairment,4thEd.,shehadafivepercentwholebodyimpairment. Wecannotsubstituteourjudgmentforthatofthetrialjudge,andourreviewisalimitedtoaconsiderationofthepreponderanceoftheevidence.Havingdoneso,weareunabletofindthattheevidencepreponderatesagainstthefindingof12percentpermanentpartialdisabilitytothebodyasawhole. Turningnowtotheinsistenceoftheemployerthatthediscretionarycostsof$600.00shouldnothavebeenallowedbecause theopinionsofthemedicalexperts[could]beelicitedontheDepartmentofLaborStandardFormMedicalReportforIndustrialInjuries,wouldhavecostonly$375.00.͜Supportiveofthisinsistenceistheuncontrovertedaffidavitofcounselthatthereis notestimonyinanyofthesedepositionsofsaidphysicianswhichwouldnothavebeenelicitedfromtheuseoftheforms. Thetotalcostsclaimedwere$1,273.13,ofwhich$600.00wasallowed,anexcessiveamountaccordingtotheemployer. ThecostsattributabletothedepositionsofDrs.ChastainandNorthcutt,$607.00,obviouslyshouldnothavebeenallowed,sincetheevidencegivenbyeitheraddednothingtothecase.Thecostsofresearchfees,$35.13,cannotbeallowed,whichbringsustothefeeofDr.Gaw,$500.00,andthetranscriptionchargesof$101.00.Wearenotprovidedanexemplaroftheformadvocatedbytheemployer,andarethushandicappedinourassessmentofitsvalue.Sincethetrialcourtapparentlywasofthesameview,thisissueiswithoutmerit.
