Plaintiffwasemployedbydefendant( Harrahs)inNovember1993.HerworklocationwastheHarrahsCasinoinTunica,Mississippi.OnDecember29,1993,shesufferedaworkrelatedinjuryattheworkplaceinTunica.PlaintiffsubsequentlyfiledaworkerscompensationactioninShelbyCounty,Tennessee,allegingthathercontractforhirewasactuallyenteredintoinTennesseeandthatT.C.A.506115(2)entitledhertoreceivebenefitsunderTennesseelaw. Defendantsfiledamotiontodismiss.Afteraffidavitswerefiledonbehalfofbothparties,thecourttreatedthematterasamotionforsummaryjudgment.Thetrialcourtgrantedthemotion,findingasamatteroflawthatplaintiffsemploymentwasenteredintoinMississippiandthatshewasnoteligibleforcompensationundertheTennesseeWorkersCompensationAct.Weaffirmtheholdingofthetrialcourt. PlaintiffJaymeBussellsubmittedherapplicationforemploymentwithHarrahsonSeptember22,1993.ShewasinterviewedforthispositionduringajobfairheldattheStateTechnicalInstituteinMemphis,ShelbyCounty,Tennessee,byarepresentativeofHarrahs.Duringthatinterviewshewasrequiredtowatchavideoandundergotestingtomakesureshecoulddosimplearithmeticandothersimilarskills.AttheconclusionoftheinterviewplaintiffunderstoodthatshehadbeenofferedajobattheHarrahsCasinoinTunica,Mississippi. ItisthepolicyofHarrahsthatanyemploymentoffersarecontingentupon    firstpassingapreemploymentdrugscreeningandobtainingaMississippigaminglicense.SuchalicenseisrequiredintheStateofMississippiinorderforanyindividualtoworkinacasinothere.OnNovember4,1993,plaintiffappearedasdirectedinSouthaven,Mississippi,whereshesubmittedtothedrugscreeningandcompletedseveralforms,includingInternalRevenueServiceformW4.OnNovember8,1993,plaintiffagainvisitedtheMississippiofficeandwasfingerprintedforthepurposeofapplyingforaMississippigaminglicense.PlaintiffsemploymentofficiallybeganonNovember8,1993,inMississippi.OnDecember29,1993,plaintiffsufferedtheonthejobinjurythatisthesubjectofthisaction. PlaintiffconcedesthatherworksitewasinMississippiandthatherinjuryoccurredinMississippi.TheonlyeventthathappenedinTennesseewasherinterview,whichledtoherbeingsenttoMississippitotakeadrugtestandcompletetheemploymentpapersnecessarytoreceiveaMississippigaminglicense.Plaintiffasserts,however,thattheinitialofferofemploymentmadeinMemphiswasunconditional,anditwasneverexplainedtoherthatthedrugscreenandgaminglicensewereprerequisitestoemployment. GailGonzales,DirectorofHumanResourcesOperationsatHarrahs,statedunequivocallythatdrugtestingwasperformedandpreapplicationemploymentandlicenseapplicationformsalwayswerecompletedforthedefendantinDeSotoCounty,Mississippi,andthatplaintiffcouldnotbehireduntilsuchtimeasthetestshadbeentakenandtheformshadbeencompletedinMississippi. Thetrialcourtfoundasamatteroflawthat,whiletherewasafactdisputebetweenthepartiesastowhattheemployeewastoldwhilestillinTennesseeregardingheremployment,itwasaprerequisiteofemploymentataMississippicasinothatemployeesbegivenadrugtestandapplyforagaminglicense.HethereforefurtherfoundasamatteroflawthatactualemploymentoccurredinMississippionlyafterplaintiffappearedthereandcompletedMississippisrequirementsforsuchemployment. ThetrialcourtcorrectlyfoundasamatteroflawthattheemploymentcontractwasnotmadeinTennessee.Theaffidavitsfiledbyplaintiffareinsufficienttochangethisconclusion.PlaintiffmakesonlythebareassertionthatsheunderstoodtheofferofemploymentmadetoherinMemphistobeunconditionalandthatshewasnotadvisedoftheadditionaltestingandlicenserequirementsuntilseveraldayslater.However,thisexpressionofopinionisnotadequatetorefutetheaffidavittestimonyofHarrahsrepresentativethatnoonecanbeemployedbyHarrahstoworkatacasinoinMississippiuntilheorshehasreceivedaMississippigaminglicense.SeeGannv.Key,758S.W.2d538,54849(Tenn.App.1988).Therefore,plaintiffisnotentitledtoworkerscompensationbenefitsunderTennesseelaw.SeePerkinsv.B.E.&K.,Inc.,802S.W.2d215,216(Tenn.1990).
