ThetrialjudgedeterminedthatCampbellsufferedpermanentpartialvocationaldisabilityintheamountof30%tothewholebodyasaresultoflumbarandcervicalstrainsresultingfromtheelectrocution.Dr.MartinRedish,M.D.,aboardcertifiedorthopaedicsurgeon,testifiedthattheemployeereachedmaximummedicalimprovementpriortolatersubsequentonthejobinjuries,andthatthesubjectaccidentalinjuriesresultedina10%anatomicalimpairmenttoCampbell'swholebody.@ THEISSUE ThesoleissuebeforethiscourtiswhetherornotthetrialcourterredinconsideringthedepositiontestimonyofDr.Redishinthefaceofthedefendant'smotiontoexcludehisexpertopiniontestimonyonthegroundthatitwasbaseduponunderlyingfactsanddatathatwasshowntobelackingintrustworthiness.@ THETRIALCOURT'SRULING Thisissuewasdirectlydealtwithuponthetrial,asthedefendant/appellantthenmovedthatDr.Redish'stestimonynotbeconsidered.Thetrialjudgeopinedhisconclusioninthislanguage:7;XXdXXd7  8 8 Thecentralissueinthecaseathandrevolvesaroundthemedicaltestimonypresented.ThereseemstobenodisputeaboutthetestimonyoftheplaintiffandhiswitnessesconcerninghisconditionsubsequenttotheSeptember14,1991injury.ThedefendantdisputestheusebytheplaintiffofDr.MartinRedish'sdepositiontoestablishthattheplaintiffsustainedapermanentimpairmentof5%tothelumbarspineforatotalof10%disabilitytothebodyasawholeaccordingtothelatesteditionoftheAMAGuidelines.ThedefendanthasobjectedtotheuseofDr.Redish'sdepositiononthebasisthatitlackstrustworthiness.TheCourthasdeferredrulingontheplaintiff'smotionuntilreadingallthemedicaltestimonypresentedinthiscase.Afterreadingallofthemedicaltestimonypresented,theCourtisoftheopinionthetestimonyofDr.Redishisinfactcredibleandtrustworthy.@ APPELLANT'SCONTENTIONSREUNTRUSTWORTHINESS AppellantreliesuponthefactthatDr.Redishwasnottheprimarytreatingphysician,thathisopinionastotheproximatecauseoftheemployee'sdisabilitywasbaseduponthehistorygiventohimbythepatient,andalitanyofothercomplaintsthatbasicallygototheweightofDr.Redish'stestimony.@ APPLICABLELAW Wereviewthefactualfindingsofthetrialcourtdenovo,accompaniedbyapresumptionofcorrectness,tobeoverturnedonlyifthepreponderanceoftheevidenceisotherwise.TennesseeCodeannotatedSection506225(e)(2)(1991). Rule703oftheTennesseeRulesofEvidenceprovidesthatexpertopinionevidenceistobeexcludedwherebaseduponfactsordatalackingtrustworthiness.@ CONCLUSIONANDJUDGMENT Wehavecarefullyreviewedalloftheevidenceandfindthatthetrialjudge'sfactualfindingsareadequatelysupported. WedonotfindthecomplaintsregardingDr.Redish'stestimonytorisetotheleverofuntrustworthiness,renderinghisopinionsinadmissible;noristheweightofhistestimonysubstantiallydiminishedbythecriticismsreliedupon.
