T   EmployeewasinjuredinthecourseandscopeofhisemploymentinApril2000.Hewas & v pryingapieceofmetalfromamachinewhenhe feltsomethinggiveinhisarm.Afterhiselbow  _ startedswelling,hewasreferredtoDr.Warrenwhotreatedhimconservativelywithasplint.A  H nerveconductionstudyindicatedaproblem,andEmployeewastreatedbyDr.Johnson,who  1  diagnosedacarpaltunnelproblemandperformedsurgery.Dr.Johnsontreatedtheelbowfor    tendonitisandratedEmployeewitha5%impairmenttohisupperextremityasaresultofthecarpal   tunnelsurgery.     EmployeesawDr.JohnsoninDecember2001andreportedproblemswithhisshoulder.A n  nerveconductionstudyshowednormalresults.Dr.Johnsonsuspectedashoulderstrainandtestified W  thattheshoulderproblemhadnothingtodowiththeinjuryinApril2000.Dr.Johnsonplacedno @ restrictionsonEmployee,andEmployeereturnedtowork. )y   InJune2001,EmployeewenttoseeDr.Fulbrightaboutpaininhisarmandshoulder. K Employeehadfullrangeofmotionintheshoulderthefirstvisit.Dr.Fulbrightconsideredseveral 4 differentdiagnoses,andconcludedthatEmployeehasafairlyrareshouldercondition.Dr.Fulbright  determinedthatapartofEmployeesacromionbonehadnotfusedatbirthandthatthiscondition  wasprobablycontributingtohispain.Thisdefectisdifficulttohealbecausethereisnoreasonfor  ittofuseandthemusclethatcontrolsthearmcontinuestoirritateiteverytimethearmismoved.  Dr.Fulbrightsuggestedsurgery,butcouldnotpromiseafavorableresult.Therefore,Employee q electednottohavethesurgery.Thedoctortestifiedthatlongperiodsofuseofthearmfurtherthe Z damage.ThefirstobservationofanylossofmotionintheshoulderwasinJune2002.Dr.Fulbright C gaveEmployeea22%upperextremityimpairmentbasedonhisshoulderandelbowsymptomsand ,| flexionandextensioninthewrist. e   EmployeealsowasseenbyDr.JosephBoalsforevaluation.Dr.Boalsdiagnosed  7 impairmenttotherightupperextremityresultingfromthecarpaltunnelsurgery.Hegavean !   impairmentratingof20%totherightupperextremitysecondarytothecarpaltunnelrelease,with " ! anadditional5%totheupperextremityformildulnarnerveneuropathy,or24%totherightupper #" extremity.Atthefirstevaluation,Employeehadfullrangeofmotioninhisshoulder.Afterasecond $# evaluation,Dr.Boalsadded8%for impingementsyndromerightshoulderwithsecondarylossof t% $ motion. ]&!%   TRIALJUDGESFINDINGS /(#'     ThedefendantadmittedacompensableinjuryoccurredinApril2000.Theissuessubmitted *Q%) tothetrialjudgeconsistedoftheextentofvocationaldisability,andwhetherthemedicalexpenses *:&* ofDr.Fulbrightarecoveredundertheworkerscompensationstatute. +#'+  , (,   ThetrialcourtfoundthattheEmployeesustaineda15%vocationaldisabilitytotheright  arm.Someconfusionaroseastothisfinding,becausethetrialjudgestatedthatEmployee has  sufferedapermanentpartialdisabilityoffifteen(15%)percenttotherightupperextremityasa  resultofhisworkrelatedaccident. k   Amotionforadditionalfindingswasfiled,requestingclarificationastowhatthetrialcourt =  meantby rightupperextremity.Thetrialcourtfiledadditionalfindings,stating theCourtisof & v theopinionthatthedisabilityshouldhavebeen15%totherightarm.  _   Ourreviewofthefindingsoffactmadebythetrialcourtisdenovoupontherecordofthe  1  trialcourt,accompaniedbyapresumptionofthecorrectnessofthefinding,unlessthe    preponderanceoftheevidenceisotherwise.Tenn.CodeAnn.506225(e)(2);Stonev.Cityof   McMinnville,896S.W.2d548,550(Tenn.1995). N Pruitt,541S.W.2d594(Tenn.1976),heldthatinjuriestotheupperextremitywhichincludedthe  7 shoulderwerenotequitabletothearm,withconcomitantbenefitsrestrictedtothelossofanarm. !   Thisrulinghasbeenconsistentlyappliedinalegionofcasesholdingthataninjurymaybe " ! apportionedtothebodyasawholeiftheinjuryextendsbeyondthescheduledmember.See,Wells #" v.SentryIns.Co.,834S.W.2d935(Tenn.1992). $#   Inthiscasethetrialjudge,uponmotion,clarifiedthathisopinionwasthattheinjurywasto ]&!% ascheduledmemberonly.Wehavereviewedthedepositionaltestimonyofthemedicalexperts,and F'"& findthattheevidencedoesnotpreponderateagainsttheopinionofthetrialjudge. /(#'   Thepreponderanceoftheevidencewasthattherewasnoworkaccidentwhichcauseda *Q%) compensableshoulderinjury. *:&*   +#'+   Thetreatingphysician,Dr.Johnson,testifiedthathebegantreatingEmployeeinApril2000   fortheworkrelatedinjury,andthatEmployeedidnotmentionshoulderproblemsuntilDecember  2001.Therewasnoevidenceoflossofmotionintheshoulder,oratornrotatorcuff.    Dr.BoalsexaminedEmployeetwice.OnthefirstexaminationinJanuary2001,Employee T hadafullrangeofmotionintheshoulder.AttheAugust2002examination,Employeeexhibited =  alossofrangeofmotionintheshoulder.However,Dr.Boalswashesitantaboutrelatingthisloss & v ofrangeofmotiontotheApril2000injury,statinghecouldnotsaythatthelossofmotioninand  _ ofitselfwasrelatedtotheactualinjury,butitmayhavebeen aprogressivethingovertime.He  H statedthatopinioncamefromtheEmployeewhosaiditwasprogressiveovertime,andthedoctor  1  wasnotpresentedwithanyhistoryofinjuryrelatedtoworkwithregardtotheshoulder.      Dr.FulbrighttestifiedEmployeehadafullrangeofmotionwhenhefirstexaminedhimin   June2001.ThefirstobservationofanylossofmotionintheshoulderwasinJune2002.Thiswas   asubjectivefindingthatreliedonthepatient.Thedoctorfelttherehadbeensomereasonforthe n  change,butcouldnotrelateittotheworkaccident,stating itsdifficulttoexplainthethechange W  ofmotionwiththatexceptforthefactthatIhaveseentheproblemssuchastheosacromialetend @ tocauseshoulderstiffnessovertime. )y   Wefindthattheevidencedoesnotpreponderateagainstthetrialcourtsfindingthatthe K injurywastothearm.Thisissuehasnomerit. 4   MEDICALEXPENSES      EmployeeassertsthemedicalexpensesofDr.FulbrightshouldbepaidbyEmployer.    Whenacoveredemployeesuffersaninjurybyaccidentarisingoutofandinthecourseof Z hisemployment,hisemployerisrequiredtoprovide,freeofchargetotheinjuredemployee,all C medicalandhospitalcarewhichisreasonablynecessaryonaccountoftheinjury.Tenn.CodeAnn. ,| section506204.Theinjuredemployeeisrequiredtoacceptthemedicalbenefitsprovidedbythe e employerandmustconsultwiththeemployerbeforechoosingatreatingphysician.Unlessthe N injuredemployeehasareasonableexcuseforthefailuretoconsultwiththeemployerfirst,the  7 injuredemployeemayberesponsibleforhisownmedicalexpenses.EmersonElectricCo.v.Forrest, !   536S.W.2d343(Tenn.1976).
