THAYER,SpecialJudge Thisworkers'compensationappealhasbeenreferredtotheSpecialWorkers'CompensationAppealsPaneloftheSupremeCourtinaccordancewithTenn.CodeAnn.506225(e)(3)forhearingandreportingtotheSupremeCourtoffindingsoffactandconclusionsoflaw. Theappealhasresultedfromarulingofthetrialcourtthattheemployeesattorneywasnotentitledtoanawardofattorneysfeesfrommedicalexpensesrecoveredinthecase. Atthetrialbelow,theclaimforcompensationbenefitswascontestedonallissuesexceptforastipulationregardingtheemployeescompensationrateandanagreementthatthesumof$582.25hadbeenpaidintemporarytotaldisabilitybenefits.Theemployerdeniedtheherniatedcervicaldiscswerecausedbytheemployeesworkactivitiesandcontendediftherewereaninjury,itwasofaminornature.Afteracontestedhearing,thetrialcourtfoundagainsttheemployer,ClaytonHomes,Inc.,ontheseissues. TheChancellorannouncedhisdecisiononMarch11,1997atahearingwherehemadedetailedfindingsoffactandconclusionsoflaw.OnApril8,1997,theemployeefiledamotiontobeawardeddiscretionarycostsandaseparatemotionseekinga20%awardofattorneysfeesontheamountofmedicalexpensesallowedinthecase. AfinaljudgmentwasenteredonMay13,1997,whichprovidedfor(1)anawardof15%permanentpartialdisabilitytothebodyasawhole,(2)anawardof$6,707.60foradditionaltemporarytotaldisabilitybenefits,(3)directingallaccruedpermanentpartialbenefitsinthesumof$17,200.80bepaidinalumpsum,and(4)directingtheemployeetopayallnecessaryandreasonablemedicalexpenses. Inconnectionwiththepaymentofmedicalexpenses,thejudgmentstated: ThatthissumshallbepaidintheregistryoftheCourtandafterithasbeendeterminedastotheamount,thattheattorneyforthedefendantisawardedalienoftherecoveryhereinforhisattorneysfeesof20%fortherecoveryofthisdisputedmedical. OnMay15,1997,theemployeefiledamotiontoalteroramendthejudgmentseekinganincreaseintheawardof15%permanentdisability.Theemployerfiledaresponsetothemotionandthemotionfordiscretionarycosts. TherecordindicatesahearingwasconductedonJune18,1997,whenthetrialcourtoverruledthemotiontoincreasetheawardofpermanentdisabilityandalsooverruledthemotiontoallowareasonableattorneysfeeforcollectingthedisputedmedicalexpenseswhichtotaled$19,784.05.Thecourtgrantedthemotiontorecoverdiscretionarycosts.Thisappealwasperfectedfromthisorderandtheappealonlypertainstotherulingonattorneysfees. TherecordissilentastowhythetrialcourtdeniedanallowanceofattorneysfeesastherewasnotranscriptofthehearingandtheorderenteredonJuly18,1997,doesnotgiveanyreasonforthedenial. OnappealtheemployeesattorneyisinsistingtheSupremeCourthasheldthatcontestedmedicalexpensesarepartoftherecoveryoftheawardofbenefitsanditispropertoallowattorneysfeesonthispartoftherecoverycitingtherecentcasesofLangfordv.LibertyMut.Ins.Co.,854S.W.2d100(Tenn.1993)andWilkesv.ResourceAuth.ofSumnerCty.,932S.W.2d458(Tenn.1996). Theemployerarguestheissuedoesnotaffectitandthattheemployerhascompliedwiththeorderofthetrialcourtleavingonlyadistributionofthemoneyquestion. IntheLangfordcase,supra,theemployerdeniedliabilitycontendingtheinjurydidnotariseoutoftheemploymentandthatitoccurredasaresultofintentionalhorseplay.Uponfindingagainsttheemployeronthisissue,thetrialcourtenumeratedthemedicalexpensesthatwouldhavetobepaidbytheemployertotheemployeewhointurnwasresponsibleforpaymentstoallmedicalcareproviders.ThetrialcourtwasoftheopinionthelawdidnotsubjectthemedicalexpensestoattorneysfeesandtheSupremeCourtreversednotingthatmoststatecourtshavedeterminedattorneysfeesmaybeassessedonmedicalexpensesrecoveredaspartofacontestedjudgment.Theopinioncitesnumerousauthoritiesonthisissue. Inthepresentcase,itwouldappearthejudgmententeredbythetrialcourtonMay13,1997,grantedthereliefforattorneysfeesasrequestedbythemotionfiledonApril8,1997.However,itmaybethepartiesandthetrialcourttreatedthemotionasnotbeingruleduponafterentryofthejudgment.Ontheotherhand,itmaybethetrialcourtwasawarethequestionhadbeenresolvedbyentryofthefinaljudgmentbutwasmerelyattemptingtochangetheruling.Ifthisbetrue,somequestionmayariseastowhetherthecourtcouldaltertherulingastheposttrialmotionsdidnotraisethequestionastoattorneysfeesandthirtydayshadexpiredfromentryofthejudgmenttotheJune18thhearing. Ourreviewofthecaseisdenovoaccompaniedbyapresumptionofthecorrectnessofthefindingsoffactunlessthepreponderanceoftheevidenceisotherwise.T.C.A.506225(e)(2).However,thepresumptiondoesnotattachinacasewherethereisnodisputeofthefactsbutonlyaquestionoflawispresented.Prostv.CityofClarksville,688S.W.2d425(Tenn.1985). Weresolvetheissuebyholdingthedisputedmedicalexpensesof$19,784.05whichiscurrentlyintheregistryofthetrialcourt,issubjecttoattorneysfeesonbehalfoftheemployeesattorneyandthatundertherecordandcircumstancesofthecase,themaximumfeeof20%oftheexpensesisappropriate.
