THAYER,SpecialJudgeӜ Thisworkers'compensationappealhasbeenreferredtotheSpecialWorkers'CompensationAppealsPaneloftheSupremeCourtinaccordancewithTenn.CodeAnn.506225(e)(3)forhearingandreportingtotheSupremeCourtoffindingsoffactandconclusionsoflaw. Thisappealhasresultedfromadecisionofthetrialcourttoawardplaintiff,ThomasDelias,45%permanentpartialdisabilitytothebodyasawhole.Onappealthedefendant,PhilipsConsumerElectronicsCompany,contendsthe45%awardisexcessiveundertheevidence. Plaintiffdoesnothaveahighschooleducationasheonlycompletedthe8thgrade.Atthetimeofthetrial,hewasalmost60yearsofage.HewasinjuredonthejobduringApril,1992,whileworkingasarouteroperator.Hesaidajigfixturejumpedoffofapinandtheroutermovedcausinghisleftshouldertobejerkedseverely.Hewasseenatthehospitaltwodayslaterandeventuallycameunderthecareofanorthopedicsurgeonwhotreatedhimforawhileandthendischargedhim. Plaintifftestifiedhedidnotmissanytimefromwork(hewenttoschoolforsomeperiodoftime)andreturnedtorouteroperatorworkbutotheremployeesdidtheheavierrouterworkwhichinvolvedconsiderableliftingand/orpushing.Hecontinuedthelightertypeworkandexperiencedpainwhileworking.HeworeaTENSunitabout90%ofthetimetohelpcounteractthepain. Sometimelaterhisconditionbegantogetworseandthecompanyreferredhimtoanotherorthopedicsurgeon.Plaintifftoldthecourthewaslefthandedanduponreturningtowork,hehadtousehisrighthandasitwasdifficulttoliftanythingwithhisleftarm.Hesaidhehadstoppedworkinginhisgardenandcouldnothuntorfishanylonger. EthylDelias,plaintiffswife,testifiedshedidanyliftingthatwasnecessaryaroundtheirhouse;thathehadstoppedworkingintheirgarden;hedidnothuntorfishanylongeranddidnotmowtheyard. Dr.WilliamT.Youmans,thelastsurgeontotreatplaintiff,wasoftheopinionhehadafrozenshoulder;thathisrangeofmotionwaslimited;saidhehadgiveninjectionsandfoundplaintiffhada7%medicalimpairmenttothewholebody.Hedidnotrecommendsurgeryatthetimesinceplaintiffwasworkingandearningwages. CompanyrepresentativeJamesD.Linebargertestifiedthatotheremployeeswereperformingtheheaviertyperouterwork. Thereviewofthecaseisdenovoaccompaniedbyapresumptionofthecorrectnessofthefindingsoffactunlesswefindfromourreviewthepreponderanceoftheevidenceisotherwise.T.C.A.506225(e)(2). Anatomicaldisabilityratingsareonlyoneofmanyfactorstobeconsideredinmeasuringlegalorvocationaldisability.Therealtestiswhethertherehadbeenadecreaseintheemployeescapacitytoearnwagesinanylineofworkavailabletotheemployee,age,education,skills,training,localjobopportunities,andcapacitytoworkattypesofemploymentavailableinclaimantsdisabledcondition.Ormanv.WilliamsSonoma,Inc.,803S.W.2d672,678(Tenn.1991). Indeterminingwhethertheemployeescapacitytoearnwageshasbeendecreased,thisistobeexaminedinrelationtotheopenlabormarketandnotwhethertheemployeeisabletoreturnandperformthejobheldatthetimeoftheinjury.Clarkv.NationalUnionFireIns.Co.,774S.W.2d586,588(Tenn.1989). Wherethetrialcourthasseenandheardwitnessesandissuesofcredibilityandtheweightoforaltestimonyareinvolved,thetrialcourtisinabetterpositiontojudgecredibilityandweighevidenceandconsiderabledeferencemustbeaccordedtothosecircumstances.Landersv.FiremansFundIns.Co.,775S.W.2d355(Tenn.1989). Inobservingandapplyingthesevariousrulesoflawtothefactsofthiscase,wecannotsaytheevidencepreponderatesagainsttheamountofthedisabilityaward.Theawardverywellmaybeatornearthehighestpointofareasonableawardunderthefactsofthecase.However,theawardisnotsubjecttorevisionunlesstheevidencepreponderatesagainstit.
