Atthetimeofthetrial,theemployeeorclaimant,Belinda_Dunlap_,wasfortyoneyearsoldandahighschoolgraduate.Sheworkedfortheemployer,NagleIndustries,onitsproductionlinefromapproximatelyJuly,1991untilSeptember11,1992,whenshereportedtotheemployerthatshewasexperiencingpaininherrighthandafteroperatingadrillpress.ShewassenttoseeDr.DaveAlexanderonSeptember14,1992.  Dr.Alexanderinitiallyexcusedherfromworkforapproximatelytwoandonehalfweeks.Threedayslater,thedoctorreleasedhertoreturntolightduty,butshedidnotreturnuntilSeptember22.Uponherreturn,shecontinuedtocomplainofwristpainandaskedtobereferredtoanotherdoctor.ShewasallowedtoleaveworkandreferredtoDr.Cooper_Beazley_,whoreleasedhertoreturntolefthandworkonly.Thereisafactualdisputeastoherreasonfornotperformingtheworkoffered.Shehassincebegunworkingfor,apparently,anotheremployer.  Atthetrial,Dr._Beazley_Ԁtestifiedthathefoundnoabnormalityandnopermanentimpairment.Dr.LarryLaughlin,whoexaminedherattheemployer'srequest,foundanormalrangeofmotionandfunctionintheclaimant'srightelbow,wrist,handandfingers.  Additionally,theclaimantwastreatedbyDr.Winston_Griner_andevaluatedbyDr.Lloyd_Walwyn_.Dr._Griner_Ԁdiagnosedrightcarpaltunnelsyndromefromrepetitiveuseoftherighthandandassessedapermanentimpairmentratingoffifteentotwentypercenttotherightupperextremity.Dr._Walwyn_Ԁmadeasimilardiagnosisandassessedtwentypercenttotherightupperextremity,fromlossofgripstrengthinherdominanthand.Bothassessmentswerebasedonappropriateguidelines.  Thetrialcourtawarded,interalia,permanentpartialdisabilitybenefitsbasedontwentyfivepercenttothebodyasawhole.Appellatereviewisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectnessofthefindingsoffact,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.section506225(e)(2).   UndertheTennesseeWorkers'CompensationLaw,injuriesbyaccidentarisingoutofandinthecourseofemploymentwhichcauseeitherdisablementordeathoftheemployeearecompensable._Reeser_Ԁv.YellowFreightSystems,Inc.,938S.W.2d690(Tenn.1997).Compensationbenefitsarepayableforthenumberofweeksestablishedbyastatutoryscheduleofthevariousmembersofthebody.Tenn.CodeAnn.section506207(3)(a)(II).Iftheinjurycausesapermanentlossofpartbutnotalloftheuseofascheduledmember,andifsuchlossisnotspecificallyprovidedforintheschedule,benefitsarecomputedbyapplyingthepercentageoflosstothetotallossbenefitcontainedintheschedule.Whereaworker'sonlyinjuryistoascheduledmember,hemayreceiveonlytheamountofcompensationprovidedbythescheduleforhispermanentdisability._Genesco_,Inc.v.Creamer,584S.W.2d191(Tenn.1979).Theextentofaninjuredworker'sdisabilityisanissueoffact._Jaske_Ԁv.MurrayOhioMfg.Co.,750S.W.2d150(Tenn.1988).Ms._Dunlap_'sonlyinjurywastoherrightarm.  Oncethecausationandpermanencyofaninjuryhavebeenestablishedbyexperttestimony,thetrialjudgemayconsidermanypertinentfactors,includingage,jobskills,education,training,durationofdisability,andjobopportunitiesforthedisabled,inadditiontoanatomicalimpairment,forthepurposeofevaluatingtheextentofaclaimant'spermanentdisability.Hillv.RoyalIns.Co.,937S.W.2d873(Tenn.1996).Fromadeliberateconsiderationoftheaboveprinciplesoflawandthosefactors,totheextenttheywereestablishedbytheproof,thepanelfindstheevidencepreponderatesagainstanawardofbenefitstothebodyasawholeandinfavorofonebasedontheeconomicequivalent,fiftypercenttotherightarm.Thejudgmentismodifiedaccordingly.
