WeaffirmthejudgmentofthetrialcourtonthegroundsthatTennesseedoesnothavejurisdictionoverthiscaseundertheprovisionsofT ENN X.C ODE XԀA NN X.506115,whichgovernsextraterritorialjurisdictionoftheTennesseeWorkers'CompensationLaw. TheplaintiffcontactedthedefendantD.B.C.Enterprises'headquartersinGrandRapids,MichiganbytelephoneinlateAugust1993fromCamden,Tennesseeaftershelearnedofthepossibilityofemployment.Shestatedinherdepositionthatatthetimeshemadetheinitialinquiry,theonlycontactthatsheandherhusbandhadwithTennesseewastheirongoingattempttopurchaserealproperty.PlaintifffirstspokebytelephonetothehiringagentforD.B.C.,PeteCarroll,whotoldherthatshewouldhavetotraveltoGrandRapidstofinalizeemploymentwiththecompany.Shewasnothiredduringthecourseofthisinitialphonecall.Bytheplaintiffsownadmission,heremploymentwascontingentuponpassingaphysicalexaminationandcompletingentrancepaperworkatthedefendantsGrandRapidsheadquarters.ShewasactuallyhiredinGrandRapids,MichiganonSeptember1,1993,aftertakingaphysicalexamination,completinganinterviewandfinalizingtheformalpaperwork. TheaffidavitofVictorMainwaring,D.B.C.EnterprisesSafetyDirector,statesthatnocontractforhirewaseverenteredbetweenD.B.C.andtheplaintiffinTennesseeandthattheplaintiff'semploymentwasnotprincipallylocalizedinTennessee.Hisaffidavitfurtherstatesthat[D.B.C.]Enterprisesdoesnotrun,operate,orownaterminalinTennesseeandthatdrivertripdatasheetscompletedbytheplaintiffandherϜhusbandindicatethatatnotimedidtheplaintiffdeliver,pickup,loadorunloadanythingintheStateofTennessee. PlaintiffallegesthatonOctober22,1993,shewasinjuredinGallup,NewMexicowhileenroutefromCaliforniacarryingcargoforthedefendant.UnderTennesseelaw,acourtmayassumejurisdictionofaworkers'compensationactionwheretheaccidentoccurredinanotherstateonlyinlimitedcircumstances.ThesecircumstancesaresetoutinT.C.A.506115asfollows:8 Ifanemployee,whileworkingoutsidetheterritoriallimitsofthisstatesuffersaninjuryonaccountofwhichsuchemployee...wouldhavebeenentitledtothebenefitsprovidedbythischapterhadsuchinjuryoccurredwithinthisstate,suchemployee...shallbeentitledtothebenefitsprovidedbythischapter,provided,thatatthetimeofsuchinjury: (1)Theemploymentwasprincipallylocalizedwithinthisstate; (2)Thecontractofhirewasmadeinthisstate. TheplaintiffdoesnotcontendthatheremploymentactivitieswereprincipallylocalizedinTennesseeandthusourinquirymustfocusonwhetherthecontractofhirewasmadeinTennessee. Inthiscase,thecontractofhirewasnotmadeinTennessee.PlaintiffsinitialphonecalltoPeteCarrolldidnotfinalizeacontractforhirebyD.B.C.Enterprises.Theterm"contractofhire"containedinT.C.A.506115makesitclearthatatelephonecallnotifyingaprospectiveemployeeofajobopeningisnotacontractforhire.Perkinsv.BE&K,Inc.,802S.W.2d215,216(Tenn.1990);Burnsv.WernerEnterprises,20T.A.M.507,at2(Tenn.1995).Thecontractofhirewasnotcompleteuntiltheplaintiffcompletedaphysicalexamination,aninterviewandherformalpaperwork.Therefore,thecontractforhirewasexecutedinGrandRapids,Michigan. Ourreviewisdenovoontherecordaccompaniedbythepresumptionthatthefindingsoffactofthetrialcourtarecorrectunlesstheevidencepreponderatesotherwise.T ENN X.C ODE XԀA NN X.506225(e)(2).Wherethetrialjudgehasseenandheardwitnesses,wemustaccordconsiderabledeferenceonreviewtohisfindings,especiallywhereissuesofcredibilityandweightoforaltestimonyareinvolved.Landersv.Fireman'sFundIns.Co.,775S.W.2d355(Tenn.1989).However,whereproofisdocumentary,sothatallimpressionsofweightandcredibilitymustbedrawnfromthecontentsthereofandnotfromtheappearanceofwitnessesonoraltestimonyattrial,nosuchdeferenceisrequiredandwemustmakeanindependentassessment,ofwherethepreponderanceoftheevidencelies.Id. Wefindthatthetrialcourtdidnoterrwhenitfoundthatitlackedjurisdictiontohearthiscase.WefindthatthecourtsofTennesseedonothavejurisdictionofthiscasebecauseitdoesnotmeettheprovisionsofT ENN X.C ODE XԀA NN X.506115.Accordinglyweaffirmthegrantofsummaryjudgmentbythetrialcourt.
