TheplaintifffiledsuitagainstthedefendantandallegedshesustainedabackinjuryonMarch6,1993. ThetrialjudgefoundtheplaintiffdidnotgivenoticeoftheinjuryuntilSeptember27,1993,andthepetitionwasdismissedforfailuretogivetimelynotice. Weaffirmthejudgmentofthetrialcourt. Weneednotgointogreatdetailconcerningthefactsinthiscase.Theplaintiffaskedhersupervisorforauthoritytomovethedeskintheofficeinwhichsheworkedtobetteraccommodateherwork.Thesupervisorinstructedtheplaintifftohavethemaintenancedepartmenttomovethefurniture. ThemaintenancedepartmentmovedthefurnitureonFriday.TheplaintiffwenttotheofficeonSaturdayandsheandanotheremployeerearrangedthedeskandsomecabinets.OnMondayandTuesday,theplaintiffworkedregularshiftswithnoproblems.OnWednesday,theplaintiffcalledtheemergencyroomtotellthemshewouldbelatetoworkbecauseherbackwashurting.Theplaintiffsawanemergencyroomdoctorandtoldhersupervisorshedidnotknowwhatwaswrongwithherback. Ultimately,theplaintiffwasreferredtoDr.FrankBerklacich,anorthopedicϜsurgeon,whotestifiedthatonMay7,1993,theplaintifftoldhimshehadhurtherbackonMarch7,1993whilemovingfurnitureatwork.OnJune1,1993,theplaintiffunderwentsurgeryonherback. TheplaintiffdidnotgivenoticetothedefendantofaworkrelatedinjurytoherbackuntilSeptember27,1993.ShesaysshedidnotdosoearlierbecauseshedidnotknowherbackproblemwasrelatedtothemovingoffurnitureonMarch7,1993. Wereviewthiscasedenovoupontherecordwithapresumptionofthecorrectnessofthefindingoffactofthetrialjudge.Tenn.CodeAnn.506225(e)(2). Thetrialjudgeheardtheoraltestimonyoftheplaintiffandothersinthetrialofthiscase.Healsohadthebenefitofthetestimonyofthephysician.Theevidenceshowstheplaintiffdiscussedwithherphysicianthecauseofherbackproblem. Theplaintiffcontendsshewasnotrequiredtogivenoticeuntilshewasawarethatherbackproblemwasworkrelated.SheclaimsthiswasinSeptember1993whenDr.Lanfordtoldhertheinjurywasworkrelated.Thetrialjudgefound,andthefindingissupportedbytheevidence,thattheplaintifftoldDr.BerklacichonMay7,1993thatsheinjuredherbackatworkandthatDr.BerklacichwrotealettertoDr.Lanfordgivingthehistory.TheletterwasdatedMay7,1993. ThetrialjudgefoundtheplaintiffkneworshouldhaveknownonMarch6,1993thatherinjurywasrelatedtothemovingoffurnitureatwork.Further,thecourtfoundtherewasnonoticegivenasrequiredandtherewasnoreasonableexcuseforthefailuretogivethenoticewithin30daysfromtheinjury. Anemployeeisrequiredtogivenoticeofaninjurytotheemployerwithin30daysthereof,Tenn.CodeAnn.506201,unlessthereisareasonableexcuseforthefailuretodoso.Pentecostv.AnchorWireCorp.,695S.W.2d183(Tenn.1985).Thereseemstobelittleinthiscasetoexcusethefailureoftheplaintifftogivenoticeoftheinjury.TheplaintifftoldherphysicianherinjurywasrelatedtotheincidentonMarch7,1993,butlaterclaimedthatshedidnotknowshewasinjuredatwork.ThetrialcourtfoundtheplaintiffsclaimoflackofknowledgeofthenatureofherinjuryϜwasnotpersuasive.Weagree. Theplaintiffcontendsthedefendanthadactualnoticeofaworkrelatedinjury.Thisisnotsupportedbytheevidence.Theplaintiffwasinjureddoingwhatshewastoldnottodo.SheneverinformedheremployerthatshewasinjuredatworkuntilSeptember27,1993whenshetoldasupervisorshewasinjuredmovingfurniture. Thetrialjudgesawandheardthewitnesseswhotestifiedonthisissue.Thetrialjudgeevaulatedthecredibilityoftheirtestimony;wecannotweighthecredibilityofthesewitnesses.SeeTownsendv.State,826S.W.2d434(Tenn.1992). Wefindtheevidencedoesnotpreponderateagainstthejudgmentofthetrialcourtinthiscaseandweaffirmthejudgment.
