Theplaintiffwasemployedbythedefendantasasecurityguard.OnJuly8,1993,hewasstruckbyavehicleinthedefendantsgarage.Thereisnodisputethattheplaintiffwasinvolvedinanaccidentinthecourseofhisemployment.Theonlydisputeiswhethertheplaintifffailedtoshowbyapreponderanceoftheevidencethathesufferedanypermanentdisabilityasaresultoftheaccident. Thetrialcourtheldtheplaintiffdidnotproveanypermanentdisabilitybyapreponderanceoftheevidenceasaresultoftheaccident.Wereversethedecisionofthetrialcourt. Thepertinenttestimonyinthecasewastheoraltestimonyoftheplaintiff,andthedepositiontestimonyofDr.DennisCoughlin 0   ,anorthopedicsurgeon;Dr.GilbertL.Hyde,anorthopedicsurgeon;andJosephScottBrown 1   ,achiropractor. Theplaintiff,thirtyyearsoldatthetimeofthecase,testifiedhecontinuedtohavepainasaresultoftheinjurieshereceivedintheaccident.Hetestifiedconcerningmanythingsheisunabletodobecauseofthepainandstiffnessassociatedwiththeinjuries.Heis,however,employedasasecurityofficerwithanotherfirm. Dr.Hyde,theplaintiffswitness,sawtheplaintiffforpurposeofevaluation.Hefoundtheplaintifftohavemusclespasmsinthelowbackandothermanifestationsofinjury.Dr.Hydewasoftheopiniontheplaintiffretaineda5%permanentmedicalimpairmentandwasoftheopiniontheimpairmentwasrelatedtotheonjobinjurywiththedefendant. Dr.Coughlin,thedefendantswitness,sawtheplaintiffontwooccasionsonceforexaminationandorderingoftestsandoncetoreporttheresultsoftheteststohim.Dr.CoughlinfounddegenerativediseaseoftheL4andL5vertebrae.Theessenceofthetestimonyinrelationtotheaccidentisbestillustratedbythefollowingexchange: `  H Q:So,areyoutellingtheladiesandgentlemenoftheJury[sic],Doctor,thatyoudonotrelatetheproblemsthathehastothecaraccidentofJuly8,1993,oryoudo?A:No.WhatImsayingisIcannotstatewithanyreasonabledegreeofmedicalcertaintythathiscomplaintsofbackpainwereduetotheautomobileaccident;and,ontheotherhand,Icannotstateinareasonabledegreeofmedicalcertaintythattherewasnorelationshipthere.   H Dr.Coughlinfoundtheplaintiffhada5%permanentmedicalimpairment. Wereviewthefindingsoffactbythetrialjudgedenovoupontherecordwiththepresumptionthefindingiscorrect.TENN.CODEANN.506225(e);Lockv.NationalUnionFireIns.Co.,809S.W.2d483(Tenn.1991). Thedefendantsaysthetrialjudgeshouldgivemoreweighttothetestimonyoftreatingphysiciansthanisgiventothetestimonyofevaluatingphysicians,andreliesuponCrossnov.PublixShirtFactory,814S.W.2d730(Tenn.1991).WedonotreadCrossnotorequirethetrialjudgetoweighthetestimonyoftreatingphysiciansmoreheavilythanthetestimonyofevaluatingphysicians.WebelieveCrossnoholdsthetrialjudgemaydosowithoutcompulsiontodoso.Beyondthis,wedonotreadCrossnoaschangingtheholdinginLandersv.FiremansFundIns.Co.,775S.W.2d355(Tenn.1989),whichallowstheappellatecourttodrawitsownimpressionoftheweightofevidencepresentedbydeposition. Dr.Coughlincanhardlybeconsideredmorethananevaluatingphysicianinthecasebaseduponthelimitedtimehesawtheplaintiffaswehaveabovesetout.Dr.FardondidnottestifyandhiscontributiontothecaseexistsbecauseDr.CoughlinrelieduponhisnotesandtheywereintroducedthroughDr.Coughlin.Althoughwedonottotallydiscountthem,werecognizeDr.Fardonsopinionisnottestedbythenormalconfrontationprocessofeitherliveordepositiontestimony. ThesumofthemedicalproofintherecordisthatDr.Coughlinsayshecannotfindtheplaintiffs5%impairmentisorisnotconnectedtotheaccident.Dr.Hydesaysitis. Thegeneralandacceptedruleisthatincaseofdoubtallreasonabledoubtshallbyresolvedinfavoroftheemployee.Hallv.AuburntownIndustries,Inc.,684S.W.2d614(Tenn.1985).Wefindtheevidencepreponderatesagainstthefindingofthetrialjudgeandinfavoroftheplaintiff.
