àThe€employee€or€claimant,€Marable,€was€62€years€old€at€the€time€of€theÏtrial.€€She€has€less€than€a€high€school€education.€€She€worked€in€Key's€shirtÏfactory€for€23€years,€sewing€stays€in€collars€of€dress€shirts.€€She€has€sufferedÏthree€separate€work€related€injuries,€all€three€of€which€are€the€subject€of€thisÏlitigation.Ìà àThe€employer€and€its€insurer€contend€first€that€because€the€claimant€hasÏthree€separate€injuries€to€three€separate€scheduled€members,€or€to€two€separateÏscheduled€members€if€the€arms€are€considered€together,€the€claimant's€injuryÏshould€somehow€be€considered€a€scheduled€injury€and€recovery€limited€to€aÏpercentage€of€weeks€provided€in€the€statutory€schedule.€€From€a€considerationÏof€the€authorities€cited€and€others,€we€respectfully€disagree.Ìà J š Ð541€€S.W.2d€€594,€596€(Tenn.€1976).€€The€extent€of€an€injured€worker'sÏdisability€is€an€issue€of€fact.€€òòJaske€v.€Murray€Ohio€Mfg.€Co.óó,€750€€S.W.2d€€150Ð vÆ  Ð(Tenn.€1988).ÌÌà ` àFrom€a€consideration€of€those€authorities,€the€panel€concludes€theÏchancellor€did€not€err€in€awarding€benefits€based€on€a€percentage€of€the€body€asÏa€whole.ÌÌà ` àà ¸ àà  àà h àà À àà  à(2)Ìà ` àBy€the€remaining€issues,€the€employer€and€its€insurer€contend€the€awardÏof€benefits€based€on€one€hundred€percent€permanent€partial€disability€to€theÏbody€as€a€whole€is€excessive€under€the€circumstances.€€While€the€issues€involveÏquestions€of€fact,€it€is€necessary€to€consider€legislative€considerations€and€theirÏeffect€upon€the€facts€of€this€case.ÌÌà .$~ ÐImpairmentóó,€the€òòManual€for€Orthopedic€Surgeons€in€Evaluating€PermanentÐ D%”  ÐPhysical€Impairmentóó,€or,€in€cases€where€an€impairment€rating€by€any€appropriateÐ Z&ª! Ð1995).€€"Clear€and€convincing€evidence"€means€evidence€in€which€there€is€noÏserious€or€substantial€doubt€about€the€correctness€of€the€conclusions€drawn€fromÏthe€evidence.€€òòÔ_ÔMiddletonÔ_Ô€v.€Allegheny€Elec.€Co.,€Inc.óó,€897€€S.W.2d€€695€(Tenn.Ð .~  Ð1995).Ìà ` àMs.€Ô_ÔMarableÔ_Ô€was€born€November€25,€1934.€€As€already€noted,€she€hasÏless€than€a€high€school€education.€€She€worked€for€Key€Industries,€Inc.€forÏtwenty„three€years.Ìà ` àIn€June€of€1992,€she€injured€her€left€foot€when€a€metal€chair€fell€acrossÏher€foot.€€The€accident€fractured€her€little€toe€and€left€her€with€tendinitis€in€herÏfoot.€€She€was€treated€by€three€different€physicians.€€The€doctors€taped€her€toesÏtogether€and€prescribed€rest€and€leg€elevation.€€She€continued€to€work€and€wasÏnot€left€with€any€permanent€impairment.Ìà ` àOn€June€10,€1994,€she€fell€at€work€and€injured€her€left€hand,€which€injuryÏresulted€in€a€trigger€thumb,€or€Ô_ÔQuervainÔ_Ô's€syndrome,€for€which€she€wasÏsurgically€treated.€€Thereafter,€she€gradually€developed€bilateral€carpal€tunnelÏsyndrome€with€lateral€Ô_ÔepicondylitisÔ_Ô€on€the€right€and€ulnar€neuropathy€on€the€left,Ïand€was€treated€conservatively€by€Dr.€McLaughlin,€who€made€an€impairmentÏrating€of€ten€percent€to€the€left€upper€extremity€and€five€percent€to€the€rightÏupper€extremity€and,€on€December€27,€1994,€declared€her€to€have€reachedÏmaximum€medical€improvement€and€released€her€to€return€to€work,€but€to€avoidÏrepetitive€gripping€with€the€hands€or€repetitive€motion€of€the€left€elbow.Ìà ` àShe€returned€to€work€for€a€few€days€but€was€unable€to€perform€the€dutiesÏassigned€to€her€because€of€disabling€pain.€€She€has€not€worked€since.Ìà ` àDr.€Richard€Ô_ÔFishbeinÔ_Ô€examined€the€claimant.€€He€estimated€her€permanentÏimpairment€to€be€eight€percent€to€the€whole€person.€€The€doctor€restricted€herÏfrom€any€type€of€hand€intensive€work€with€the€left€hand,€from€pushing,€pullingÏor€manipulating€heavy€objects€with€either€hand€and€from€running,€jumping,Ïclimbing€or€prolonged€walking€or€standing.Ìà ` àWe€find€in€the€record€no€expert€testimony€as€to€whether€the€claimant€hasÏreasonably€transferable€job€skills€from€prior€vocational€background€and€trainingÏor€whether€she€has€any€reasonable€employment€opportunities.€€TheÏcircumstances€of€this€case€are€such€that€it€should€not€be€exempt€from€the€generalÏrequirement€for€expert€testimony,€particularly€in€light€of€her€relatively€mildÏmedical€impairment.Ð
