ThejobrelatedaccidentfromwhichtheinjuryanddisabilityaroseoccurredApril11,1992.ThecasewasheardJanuary12,1996resultinginajudgmentthattheplaintiffhadsustaineda60percentdisabilitytoherwholebody.Theemployerappealsandpresentsforreviewtheissueofwhethertheawardisexcessive. Ourstandardofreviewisdenovoontherecordaccompaniedwithapresumptionofthecorrectnessofthejudgmentunlesstheevidenceotherwisepreponderates.Tenn.R.App.P.13(d);T.C.A.506225.TheapplicationofthisstandardrequiresthisCourttoweighinmoredepththefindingsandconclusionsofthetrialcourtsinworkerscompensationcases.Corcoranv.FosterAutoGMC,746S.W.2d452,456(Tenn.1988). Theplaintiffwasinvolvedinatrafficaccidentduringthecourseofheremploymentasafamilycounselor.HermostseriousinjurywasabrokenhipwhichrequiredaprostheticreplacementbyDr.ThomasL.Huddleston,anorthopedicsurgeon,whotestifiedbydepositionthattheplaintiffhada37percentpermanentpartialimpairmenttoherleftleg,extrapolatedto15percentforthewholebody. Theplaintiffwas42yearsoldatthetimeoftrial.ShehasaMastersDegreeinherareaofdiscipline.ShewasemployedbytheFirstTennesseeHumanResourcesAgencyinNovember1990asaHomeTiesspecialistand,followinghersurgery,shereturnedtoworkwithnoprescribedlimitationsorrestrictions.Theproofshowsalitanyofphysicalactivitiesinwhichshemayengagebywayofdemonstratingtheextentandrangeofherrecoveryandpresentcondition,whichincludebutarenotlimitedtodrivingacar,hiking,backpacking,playingtennisandperformingallnormalhouseholdfunctions.Herdischargesummarywas, Herhipwasfreeofpain....therangeofmotionofherhipwasexcellent....Herimmediatesupervisortestifiedthatshewasabletoperformallofherduties,andthemostrecentevaluationofherworkscoredhersignificantlyaboveaverageinjobperformance. Permanencyandcausationarenotanissue.Theemployerquestionstheextentofdisability,whichmaybedeterminedfromlayaswellasexperttestimony,KellwoodCompanyv.Gibson,581S.W.2d645,648(Tenn.1979),andadeterminationofdisabilityrequiresaconsiderationofage,education,training,skills,jobopportunitiesandotherrationalfactors.FederatedMutualImplement&HardwareCo.v.Cameron,422S.W.2d427,429(Tenn.1967);T.C.A.506241. Weagreewiththeappellantthattheevidencepreponderatesagainstafindingthattheplaintiffhasa60percentpermanentpartialdisabilitytoherwholebody;wefindtheevidencepreponderatesinfavorofafindingthattheplaintiffhasaforty(40%)percentdisabilitytoherwholebody,andthejudgmentisaccordinglymodified.
