ÐÌWilliam€Joseph€Butler,€Farrar€&€Holliman,€Lafayette,€TN,€for€the€appellee,Ð Þ).%# ÐJames€Morris.Ð ì*<&$ Ðà@ìì*ìàˆÐ ú+J'% ЇÓ  Óò òMEMORANDUM€OPINIONÐ ° Ðó óÓ  ÓÌÓ  Óà  àJames€Morris€(Morris),€the€employee„appellee,€was€employed€by€TheÐ Ò" ÐGap,€which€is€insured€by€Zurich€American€Insurance€Company€(ð ðZurichðð),€theÐ à0 Ðappellant,€during€the€period€Morris€claims€to€have€sustained€two€separateÐ î> Ðwork„related€injuries.€€The€first€incident€occurred€on€August€5,€1999€whenÐ ü L ÐMorris€was€struck€by€a€forklift.€€Morris€claims€to€have€received€injuries€to€hisÐ  Z Ðneck€and€left€shoulder€as€a€result€of€this€incident.€€The€second€incidentÐ  h Ðoccurred€on€August€12,€1999,€when€Morris€caught€his€leg€between€twoÐ & v Ðcolliding€forklifts.€€He€claims€to€have€received€injuries€to€his€left€leg,€knee,€andÐ 4„  Ðfoot€as€a€result€of€the€second€incident.€€Ð B’  Ðà  à¹Ó¿ ÓÓ  Óà  àIn€1993,€six€years€prior€to€the€incidents€at€issue,€Morris€sustainedÐ ^®  Ðinjuries€as€the€result€of€a€motor€vehicle€accident€€€€The€1993€injuries€involvedÐ l¼  Ðhis€shoulder,€left€arm,€neck,€left€knee,€along€with€a€broken€scapula€andÐ zÊ Ðclavicle.€€Morris€also€sustained€an€injury€to€an€artery,€which€requiredÐ ˆØ Ðimmediate€surgery.€€A€year€later,€in€1994,€Morris€underwent€surgery€to€repairÐ –æ Ðdamage€to€his€left€knee€(lateral€meniscetomy).€Ð ¤ô ÐÌÓ/ ÓÓ  Óà  àBetween€1994€and€1997,€Morris€visited€his€family€physician,€Dr.Ð À ÐBachstein,€ten€times€for€shoulder€and€neck€pain.€€After€1997,€MorrisÐ Î Ðexpressed€no€complaints€of€neck,€shoulder€or€knee€pain€until€the€incidents€atÐ Ü, ÐThe€Gap€in€August€of€1999.€€This€history€was€confirmed€by€Dr.€BachsteinððsÐ ê: Ðtestimony.€€Ð øH ÐÌà  àMorris€continued€to€experience€mild€pain€in€his€left€knee€in€1997.€Ð d ÐConsequently,€he€was€seen€by€Dr.€Roy€Terry,€a€board„certified€orthopaedicÐ " r Ðsurgeon.€€€The€record€suggests€he€received€conservative€care€from€Dr.€Terry.Ð 0!€ ÐThe€record€further€suggests€that€Morris€was€never€rated€for€a€permanentÐ >"Ž Ðimpairment€for€any€injuries€resulting€from€the€1993€accident.€€Ð L#œ ÐÌà  àDr.€Terry€indicated€that€from€April€8,€1997€until€the€incidents€at€The€GapÐ h%¸  Ðin€August€of€1999,€there€was€nothing€in€his€record€to€indicate€that€Morris€wasÐ v&Æ!  Ðnot€doing€fine.€€Furthermore,€Dr.€Bachsteinððs€records€do€not€reveal€anyÐ „'Ô"! Ðproblems€with€the€shoulder€or€knee€between€1997€and€1999.€€Ð ’(â#" Ðà  àÌÓuÓÓ  Óà  àFollowing€the€incidents€at€The€Gap€in€August€of€1999,€Morris€againÐ ®*þ%$ Ðelected€to€be€treated€by€Dr.€Terry€though€Dr.€Terry€was€not€recommended€byÐ ¼+ '% Ðthe€employer.€€In€October€1999,€Dr.€Terry€performed€knee€surgery€on€MorrisððÐ ° Ðleft€knee€to€repair€a€meniscal€tear.€€Ð ¾ ÐÌà  àDr.€Terry€placed€Morris€on€light€duty€restrictions€on€Dec.€20,€1999€andÐ Ú* Ðagain€on€Feb.€9,€2000.€€Specifically,€Dr.€Terry€restricted€Morris€from€walkingÐ è8 Ðor€standing€more€than€four€hours,€occasional€lifting€and€carrying€up€to€20Ð ö F Ðpounds,€and€only€occasional€squatting,€climbing€and€reaching€above€shoulderÐ  T Ðlevel€with€the€left€arm.€€Ð  b ÐÌà  àDr.€Terry€testified€via€deposition€that€Morris€should€avoid€climbing€stairsÐ .~  Ðand€avoid€using€his€left€arm€above€shoulder€level,€that€he€keep€his€left€legÐ <Œ  Ðextended,€and€avoid€turning€and€twisting€of€his€neck€from€side€to€side€andÐ Jš  Ðflexion€of€the€neck,€if€he€experienced€pain€with€these€activities.Ð X¨  Ðà  àÌà  àDr.€Terry€assessed€a€2%€whole€body€impairment€for€the€knee€injury€andÐ tÄ Ða€5%€impairment€for€the€neck€injury,€for€a€combined€impairment€rating€for€TheÐ ‚Ò ÐGap€injuries€of€7%€to€the€whole€person.€Ð à ÐÓÓÌÓ  Óà  àIn€March€of€2000,€Dr.€John€McInnis,€a€board„certified€orthopaedicÐ ¬ü Ðsurgeon€selected€by€the€employer,€found€mild€swelling€in€Morrisðð€left€leg,€yetÐ º  Ðfull€range€of€motion€with€the€left€knee.€€Though€he€placed€no€restrictions€onÐ È ÐMorris,€Dr.€McInnis€€assigned€an€impairment€rating€to€the€left€leg€of€5%.Ð Ö& ÐÓZÓÌÓ  Óà  àAn€Independent€Medical€Examination€was€conducted€in€April€of€2000,Ð òB Ðby€Dr.€S.€M.€Smith.€€Dr.€Smith€testified€that€causation€of€Morrisðð€medicalÐ P Ðproblems€was€the€result€of€and€due€to€The€Gap€injuries.€€This€finding€wasÐ ^ Ðapparently€based€upon€the€conclusion€that€Morris€was€having€no€problemsÐ  l Ðimmediately€prior€to€the€date€of€the€incidents€at€The€Gap;€therefore,€theÐ *!z Ðresulting€problems€were€not€old€ones,€they€were€new€ones.€€Dr.€SmithÐ 8"ˆ Ðassigned€a€22%€impairment€rating€to€the€leg€(9%€whole€body),€18%€for€theÐ F#– Ðupper€extremity€(11%€whole€body),€and€14%€whole€body€impairment€for€theÐ T$¤ Ðneck,€for€a€total€whole€body€impairment€of€31%.׃ ×Ý ƒ#ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×€€€€€€€€€€€Ð b%²  ÐÓÿÓÐ p&À!
