THAYER,SpecialJudge Thisworkers'compensationappealhasbeenreferredtotheSpecialWorkers'CompensationAppealsPaneloftheSupremeCourtinaccordancewithTenn.CodeAnn.506225(e)(3)forhearingandreportingtotheSupremeCourtoffindingsoffactandconclusionsoflaw. Theappealhasbeenperfectedbytheemployee,GwendolynSueMulkey,fromadecisionofthetrialcourtresultinginadismissalofthecomplaint.TheCircuitJudgefoundtheemployeehadfailedtoestablishshehadsustainedaninjuryasaresultofherworkactivitiesonAugust13,1993. Plaintiff,age42years,hadworkedfordefendant,PalmBeachCompany,foranumberofyears.Shewasengagedinsewingworkwhenshesaidshewasliftingabundleofcoatsandfeltsomethingpullinherneck.Laterthesameday,shetestifiedshewasliftingaboveherheadandfeltapullinherlowback.Shewenttoseeadoctorfurnishedbyheremployerandwasreturnedtolightdutywork.ShecontinuedworkinguntilJanuary31,1994,whenshewasterminatedbecausetheemployerconcludedtherewasnoworkavailableundertherestrictionsimposedbythedoctor.Sheeventuallyfoundotheremploymentandwasworking2022hoursaweekasajanitor.Shetestifiedthistypeofworkcausedherneckandbacktohurt. Therecordindicatesthatshehadsustainedseveralworkrelatedinjuriesinpreviousyearsandhadbeentreatedforaribinjury,acarpaltunnelsyndromeinjuryandashoulderinjury. Alloftheexpertmedicaltestimonywasbydeposition. Dr.JonathanN.Degnan,anorthopedicsurgeon,firstsawplaintiffonMarch17,1994,whichwasaboutsevenmonthsaftertheactivitiesinquestion.HetestifiedshecomplainedofneckpainontheinitialvisitbutdidnotcomplainoflowbackproblemsuntiltheSeptember1994visit.Hefounddegenerativediscdiseasewhichwasnotworkrelated.Hegavehera9%impairmenttothebodyasawholeandrelatedtheinjurytoherworkdutiesupontheassumptionthehistorygiventohimwasaccurate.Ingivingthehistory,shetoldthedoctorshehadrecoveredfromallpriorinjuriesandwasnotsufferingfromneckandbackpainbeforeAugust1993. Dr.RobertE.Finelli,aneurosurgeon,testifiedhehadtreatedplaintiffforsomeofherpriorinjuries.HesawherduringMarch1993(about5monthsbeforeincident)andshehadcomplaintsthenofneckandarmpain.HenextsawheronSeptember7,1993(about3weeksafterincident)whenshewascomplainingofneck,shoulder,armandbackpain.Heperformedanumberoftestsandconcludedshehadaneckandbackstrainwhichwasconsistentwithherpriorphysicalproblems.Hefeltherpresentcomplaintswerejustareoccurrenceofpreviouscomplaints.Hetoldthecourtshealsoinformedhimshehadbeeninvolvedinanautomobilewreck. Dr.FredA.Killeffer,aneurosurgeon,firstsawplaintiffonNovember4,1993,andreviewedmedicalrecordsofnumerousotherdoctorswhohadseenher.Heconcludedthatshehadhadatleastsevenoccurrencesofthiskindofpainoverthepast45years.Hefelthersymptomswereessentiallythesameasshehadexperiencedinpastyearsandherpresentcomplaintswerenotrepresentativeofarecentinjury. Thecaseistobereviewedonappealdenovoaccompaniedbyapresumptionofthecorrectnessofthefindingsoffactunlessthepreponderanceoftheevidenceisotherwise.T.C.A.506225(e)(2). Inresolvingdisputesinmedicaltestimony,thetrialcourtmaychoosewhichmedicaltestimonytoaccept.Indoingthis,thecourtmayconsiderthequalificationsoftheexperts,thecircumstancesoftheirexamination,theinformationavailabletothemandtheevaluationoftheimportanceofthatinformationbyotherexperts.Ormanv.WilliamsSonoma,Inc.,803S.W.2d672,676(Tenn.1991). Onappealtheonlyissueiswhethertheevidencepreponderatesagainstthedecisionofthetrialcourt.Wehavecarefullyreviewedtherecordandareoftheopiniontheevidencedoesnotpreponderateagainsttheconclusionofthetrialcourt.Inthisconnection,wenoteDr.Finelliwastheonlyexperttohaveseenplaintiffashortperiodoftimepriortotheincidentandsoonaftertheallegedinjury.Also,thetrialcourtwasinabetterpositiontojudgecredibilityoftheplaintiffwhotestifiedorally.
