Theemployeeorclaimant,Mullinax,sufferedacompensablelowbackinjuryonAugust30,1995,whenhewashitintheheadbyasteelbeamandknockedtenorfifteenfeetontohisback.Hewasreferredbytheemployertoachiropractor,whoreferredhimtoDr.VerneAllenfortreatmentofpaininhisleftshoulderandarm,lowbackpainandproblemswithhishipsandlegs.ThedoctororderedanMRIandmyelogram,restrictedhimfromliftingmorethanfortypoundsoccasionallyortwentypoundsrepetitively,andassessedhispermanentmedicalimpairmentatfivepercenttothewholebody,withoutperforminganyrangeofmotiontests.Hetoldtheclaimanttherewasnothinganybodycoulddoforhim.  Theclaimantwasreferred,apparentlybyhisattorney,toDr.RobertBarnett,forexaminationandevaluation.Afterconsideringtheclaimant'shistory,resultsofscientifictestsandrangeofmotiontests,Dr.Barnettrestrictedtheclaimantfromanyheavylifting,repetitivelifting,bending,stooping,bendingorsquatting,andassessedhispermanentimpairmentattenpercenttothewholebody.  Bothdoctorsbasedtheiropinionsonappropriateguidelinesandbothareeminentlyqualifiedexpertsintheirfieldsofspecialty.Dr.Allenisboardcertifiedinneurologicalsurgery,Dr.Barnettinorthopedicsurgery.  ThetrialjudgeacceptedtheopinionofDr.BarnettandrejectedthatofDr.Allen.Appellatereviewofafindingoffactinaworkers'compensationcaseisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectnessofthefinding,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.section506225(e)(2).  Accordingly,wehaveconductedanindependentexaminationoftherecordtodeterminewherethepreponderanceoftheevidencelies.Fromthatexamination,wearepersuadedthattheevidencefailstopreponderateagainstthefindingofthetrialjudge.
