Thesoleissueonappealiswhetherthetrialcourtsawardof65%permanentpartialdisabilitytotheplaintiffslefthandisexcessive.Thepanelconcludesthatitisandreducesitto50%. WhileworkinginanassemblylinejobinAugust1994,,theplaintiffdevelopedarepetitivemotioninjurytoherlefthand.Sheisrighthanded.Theinitialconservativemedicaltreatmentconsistedofrestrictingtherepetitiveuseoftheplaintiffslefthand.Shetriedonejob,butsaidshecouldntdoit,thenwasgivenajobshecouldperformwithonlyonehand.Shesaidshecouldntdothat,either. Theemployerinformedtheplaintiffthatnomorejobswereavailableforherthatday,butmadeanappointmentforhertoseeanorthopedicsurgeon.Thefirstavailableappointmentwasfairlyfarinthefuture,sotheemployertoldtheplaintiffthatitwouldattempttoaccommodateherrestrictionuntiltheappointment.Theplaintiffrespondedbyquittingherjob.Sheneverreturnedtoworkfortheemployer.Andshehasnotsoughtanyotheremployment. Dr.HowardMillerperformedoutpatientsurgeryontheplaintiffinJanuary1995andreleasedhertolightdutyworkshortlythereafter.HereleasedhertoreturntoherformerjobattheendofFebruary.ThedoctorreportedinJune1995thattheplaintiffhadfullmotioninherwristanddigitsandthatshewaslargelyasymptomatic.Dr.Millerdidnotgivetheplaintiffanypermanentrestrictionsanddidnotgiveheranypermanentimpairment. Theplaintiffsattorneysenthertoseeanotherdoctor,EarlJeffres,inSeptember1995.Heassesseda22%permanentpartialimpairmenttotheplaintiffslefthand.Heacknowledgedthattheplaintiffscomplaintsofpainexceededhisobjectivefindings. Theplaintiffscomplaintsofpaininherlefthandandtheprobabilitythatsheshouldavoidrepetitiveuseofitdoeslimitheremployability.Butsheiscertainlyemployable.Shecompletedtwoyearsofbusinessschoolandworkedasassistantmanageratarestaurantforanumberofyears.
