àThis€workers'€compensation€appeal€has€been€referred€to€theÏSpecial€Workers'€Compensation€Appeals€Panel€of€the€Supreme€CourtÏin€accordance€with€Tennessee€Code€Annotated€Section€50„6„225Ï(e)(3)€for€hearing€and€reporting€to€the€Supreme€Court€of€findingsÏof€fact€and€conclusions€of€law.Ìà@ àÌà àThis€case€has€an€unusually€long€and€complicated€history.€ÏThe€employee/plaintiff€fell€at€work€on€September€26,€1990Ïinjuring€her€back.€€The€trial€did€not€take€place€until€April€12,Ï1995;€and€the€issues€were€taken€under€advisement€until€July€10,Ï1996.€€The€plaintiff€was€awarded€temporary€total€disabilityÏbenefits€from€September€26,€1990,€through€November€9,€1990,€aÏtotal€of€$1,176.00.€€The€defendant€was€held€liable€for€theÏmedical€bills€of€Drs.€Richard€W.€Brackett,€Paul€A.€Broadstone€andÏJohn€W.€Laramore;€and€the€plaintiff€was€judged€responsible€forÏany€other€medical€expenses€incurred€in€the€past,€but€futureÍmedical€expenses€were€ordered€paid€by€the€defendant.€€CertainÏexpenses€in€connection€with€depositions€were€assessed€asÏdiscretionary€costs€to€be€paid€by€the€defendant,€as€were€theÏregular€court€costs.ÌÌà àThe€plaintiff€was€found€by€the€trial€court€to€be€50%Ïpermanently€partially€disabled€to€the€whole€body;€and€awarded€200Ïweeks€compensation,€which€calculates€to€$39,200.00.Ì€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€Ìà àOn€this€appeal€the€only€issue€raised€relates€to€the€award€ofÏpermanent€partial€disability.€€The€employer/appellant€contendsÏthat€no€permanent€partial€disability€resulted€from€this€accident;Ïand,€even€if€there€was€some€permanent€partial€disability€it€wasÏnot€50%€to€the€body€as€a€whole.ÌÌ€€€€€The€plaintiff€was€a€clerical€worker.€€No€doubt€she€fell€inÏthe€course€of€her€employment,€and€claimed€a€back€injury.€€She€hasÏa€history€of€back€problems€dating€back€to€her€teens.€€At€the€timeÏof€her€fall€she€was€43€years€old€and€had€completed€three€years€of€ÌÌcollege€study.€€From€July€1986€until€August€of€1988€aÏchiropractor,€Rickey€Hurst,€treated€her€for€low€back€painÏresulting€from€lumbosacral€strain,€as€well€as€neck€and€shoulderÏpain.€€In€October€of€1986€she€saw€W.E.€Vanatta,€anotherÏchiropractor,€for€an€injury€to€her€lower€back€caused€by€movingÏfurniture.€€She€saw€him€again€in€August€of€1988€with€similarÍsymptoms.€€She€began€seeing€Leland€Northcutt,€anotherÏchiropractor,€in€September€of€1988,€complaining€of€low€back€pain.€ÏShe€recorded€for€him€that€her€condition€developed€in€high€school,Ïand€stated€that€she€had€been€receiving€chiropractic€treatment€forÏ20€to€25€years.ÌÌà àThe€plaintiff€worked€approximately€seven€days€following€theÏfall€in€issue.€€She€then€started€seeing€her€family€physician,€Dr.ÏJohn€Laramore,€and€saw€him€several€times.€€He€released€her€toÏreturn€to€work€on€November€19,€1990.€€She€worked€about€fourÏmonths€and€was€terminated€for€excessive€absenteeism€on€March€22,Ï1991.€ÌÌ€€€€€She€again€was€treated€by€Leland€Northcutt,€D.C.,€for€backÏand€neck€pain.€€He€found€muscle€spasm€and€restricted€motion,€theÏsame€findings€that€he€had€made€before€her€fall€on€September€26,Ï1990.€€On€December€19,€1990,€she€was€again€treated€by€Northcutt,Ïwith€complaints€of€€pain€caused€by€a€fall€on€her€kitchen€floor.€ÏA€week€later€she€returned€to€him€with€the€same€complaints,€sayingÏthat€she€had€fallen€again.€€He€continued€to€treat€her€untilÏSeptember€14,€1991.€€He€testified€that€he€could€not€give€her€anÏimpairment€rating€because€she€had€not€completed€herÏrehabilitation€program.ÌÌà àThe€plaintiff€was€treated€by€an€orthopaedic€surgeon,€Dr.ÏPaul€Broadstone.€€He€first€saw€her€on€January€9,€1991,€more€thanÍthree€months€after€her€fall€at€work.€€In€her€history€given€to€Dr.ÏBroadstone€she€denied€having€any€previous€neck€or€back€problemsÏprior€to€the€fall€at€work.€€She€complained€to€him€of€pain€in€theÏwhole€spine,€worse€in€the€lower€back.€€The€pain€began€four€daysÏafter€her€fall€at€work.€€He€testified€that€while€she€was€underÏthe€Ìcare€of€Dr.€Laramore€(who€referred€her€to€him)€that€she€hadÏnegative€x„rays€of€the€skull,€right€knee€and€lumbar€spine;€andÏthat€she€also€had€normal€EMG€and€nerve€conduction€studies.€€AnÏMRI€of€both€the€cervical€and€lumbar€spine€done€in€November€ofÏ1990€was€normal.€€Dr.€Broadstone€had€a€bone€scan€of€the€plaintiffÏdone€in€February€of€1991€and€the€results€were€normal,€except€forÏevidence€of€bursitis€in€the€right€shoulder€area.€€His€diagnosisÏwas€some€residual€inflammation€in€the€muscle€and€tendons€andÏcharted€it€as€lumbosacral€inflammation.ÌÌà àDr.€Broadstone€continued€to€treat€the€plaintiff€for€severalÏweeks.€€She€complained€of€numbness,€tingling€in€the€right€lowerÏextremity€and€some€feeling€of€weakness€in€the€right€lowerÏextremities.€€He€concluded€that€she€had€"a€fibrositis€typeÏpicture",€which€is€inflammation€of€the€fibrous€tissue€in€theÏbody.€€He€testified:ÌÓÓà8 àà8 àIt's€more€of€a€diffuse€process€and€can€affectÏvarying€parts€of€the€body€that€have€fibrousÏtissue.€€It's€not€a€real€well„defined€diseaseÏprocess.ÌÌà@ à*€*€*€*€*€*€ÌÌà8 àà8 àThere's€probably€several€causes.€€I'm€not€upÏon€all€of€them,€that's€why€I€usually€have€theÏrheumatologist€to€evaluate€and€treat€theseÏpeople.ÌÌà@ à*€*€*€*€*€*€ÌÌà8 àà8 àThey€deal€with€many€arthritic€conditions€orÏinflammatory€conditions€of€the€joints€whichÏis€what€arthritis€is;€muscles,€tendons.€€AndÏthey€also€treat€the€fibrositis€for€some€ofÏthe€autoimmune€type€disease€like€rheumatoidÏand€lupus€and€those€kinds€of€processes.ÌÌÓÓÌà àDr.€Broadstone€testified€that€he€had€never€given€theÏplaintiff€any€restrictions€€or€placed€her€on€any€restrictions€asÏfar€as€physical€activity€was€concerned.€€He€testified€that€herÏfinal€orthopaedic€diagnosis€was€diffuse€spinal€pain€of€unknownÏetiology.€€His€examinations€and€treatments€failed€to€yield€to€himÏany€specific€diagnosis€for€her€problem.€€He€referred€her€to€aÏrheumatologist,€Dr.€Richard€W.€Brackett,€to€see€what€he€thought.ÌÌà àDr.€Brackett€diagnosed€the€plaintiff's€condition€asÏfibromyalgia,€or€soft€tissue€rheumatism,€and€bursitis€of€theÏright€hip€region.€€He€testified€that€"€all€likelihood€it€wasÏtriggered€by€her€accident€in€September€of€1990".€€He€did€notÏthink€that€the€bursitis€was€related€to€the€fall€at€work.€€HeÏtestified€that€joint€pain€can€be€a€symptom€of€fibromyalgia,€andÏthat€tissue€or€muscle€pain€is€"one€of€the€hallmarks€of€theÏsyndrome".€€He€continued€to€treat€her€through€July€30,€1992.€€SheÏwas€then€complaining€of€arms€and€legs€hurting€and€was€tender€inÏher€muscle€groups.€€He€prescribed€a€tricyclic€anti„depressantÍ"that€she€was€unable€to€afford€previously".ÌÌà àOn€cross„examination€Dr.€Brackett€testified€that€upon€herÏfirst€visit€the€plaintiff€hurt€all€over:€her€legs,€her€low€back,Ïher€upper€back,€her€shoulders,€her€arms€and€her€neck.€€He€agreedÏthat€there€are€many€possible€cases€of€fibromyalgia:€stress,Ïidiopathic,€multiple€medical€illnesses,€thyroid€dysfunction,Ïelectrolyte€abnormalities€related€to€other€arthritic€processes.€ÏHis€testimony€as€to€the€cause€of€her€fibromyalgia€was€foundedÏupon€her€subjective€history.€€He€heard€no€details€of€stress€inÏher€life.€€He€testified€that€fibromyalgia€is€usually€a€chronicÏdisorder;€but€said€that€accident€related€fibromyalgia€"should€beÏa€short„term€syndrome".€€In€the€plaintiff's€case,€he€testifiedÏthat€her€syndrome€would€be€expected€to€be€resolved€in€three€toÏsix€months.€€He€also€testified€that€hypothyroidism€was€aÏpotential€cause€of€fibromyalgia,€and€that€the€plaintiffÏcomplained€of€a€history€of€hypothyroidism.€€He€testified€furtherÏher€prior€complete€hysterectomy€and€her€cessation€of€the€takingÏof€hormone€replacement€pills€"can€give€very€similar€symptoms€toÏfibromyalgia",€if€her€ovaries€were€not€intact.€€Dr.€BrackettÏadmitted€that€in€his€first€report€on€the€plaintiff's€condition,Ïdated€May€3,€1991,€that€he€stated€that€he€could€not€unequivocallyÏsay€that€her€soft€tissue€rheumatism€was€directly€related€to€herÏfall€on€the€job.€€When€asked€about€the€plaintiff's€falls€afterÏthe€Ìfall€on€the€job,€Dr.€Brackett€testified€that€any€fall€might€causeÍa€condition€like€this.€€He€also€admitted€that€the€A.M.A.Ïguidelines€do€not€give€an€impairment€rating€for€this€condition.ÌÌà àThe€plaintiff€saw€other€doctors.€€She€saw€Dr.€RobertÏSendele,€another€orthopaedic€surgeon;€Dr.€Ogrodowczyk,€aÏchiropractor;€and€Drs.€Donothan€Ivy,€George€Graves€and€a€Dr.ÏBoehn.€€There€is€no€evidence€that€any€of€them€assigned€plaintiffÏan€impairment€rating.ÌÌà àDr.€Kenneth€Stanly,€D.C.,€saw€the€plaintiff€on€March€31,Ï1994.€€He€diagnosed€muscle€strain/sprain€injuries€to€her€entireÏspine,€assigned€her€an€impairment€rating€of€20%€to€the€body€as€aÏwhole,€based€upon€decreased€range€of€motion€of€the€spine.ÌÌà àThe€trial€judge€noted€that€the€plaintiff€was€presentlyÏworking€full€time€at€a€local€golf€course€in€an€information€booth.€ÏShe€answers€the€telephone,€handles€the€payroll€and€is€involvedÏwith€some€work€on€the€computer.ÌÌà àThe€trial€judge€based€his€finding€of€50%€permanent€partialÏimpairment€to€the€body€as€a€whole€upon€the€diagnosis€by€Dr.ÏBrackett€of€traumatic€fibromyalgia.ÌÌà àWe€review€the€€judgment€of€the€trial€court€òòdeóó€òònovoóó€upon€theÏrecord,€with€a€presumption€of€correctness€unless€theÏpreponderance€of€the€evidence€is€otherwise.€€Tennessee€CodeÍAnnotated€Section€50„6„225€(e).ÌÌà àAccepting€as€fact€that€the€plaintiff€has€permanentÏfibromyalgia,€we€find€the€evidence€that€it€is€the€proximateÏresult€of€the€fall€at€work€to€be€legally€insufficient€toÏestablish€that€fact.€€Additionally,€the€medical€evidenceÏpreponderates€against€the€testimony€of€Dr.€Kenneth€Stanley,€D.C.€ÌÌÌà àWe€hold€that€the€judgment€of€50%€permanent€partialÏdisability€to€the€whole€body€is€reversed€and€that€the€judgment€beÏmodified€to€a€finding€of€no€permanent€partial€disability;€andÏthat€the€judgment€for€future€medical€expenses€be€modified€toÏexclude€liability€of€the€defendant€for€future€medical€expensesÏincurred€in€the€treatment€of€fibromyalgia.ÌÌà
