TheclaimantoremployeeisthirtyyearsoldwithaGED.Heisacertifiednursingassistantandhad,atthetimeofhisinjury,workedfortheemployer,MethodistMedicalCenter,since1991asanattendant.Hisdutiesincludedturning,bathing,weighingandwalkingpatientsandpushingstretchersandwheelchairsofpatients.Hegraduallydevelopedcarpaltunnelsyndrome.  Dr.EugenioVargastreatedtheclaimantandultimatelyperformedbilateralcarpaltunnelsurgery.Hetestifiedtheinjurieswerecausallyrelatedtotheclaimant'sjobandthathewouldretainatenpercentpermanentimpairmenttobotharms.  Dr.CliffordPosmanviewedtheclaimant'smedicalrecords,includingthereportsofDr.Vargas,andopinedthattheclaimant'sinjurieswerenotworkrelated.RodneyCaldwell,avocationalconsultant,opinedtheclaimantwasfortysevenpercentvocationallydisabled.  Thetrialcourtfoundtheinjuriestobecompensableandfixedtheclaimant'spermanentpartialdisabilityatthirtysevenandonehalfpercenttobotharms.     / u`  3   ׀Appellatereviewisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectnessofthefindingsoffact,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.section506225(e)(2).  Fromacarefulconsiderationofthemedicalandlayproofinthiscase,thepanelisunabletosaytheevidencepreponderatesagainstthetrialjudge'sfindingthattheinjuriesareworkrelated.Thefirstissueisresolvedinfavortheemployee.  Fromacarefulconsiderationoftheexpertandlaytestimonyastotheclaimant'sage,jobskills,education,lackoftrainingandanatomicalimpairment,thepanelisunabletosaytheevidencepreponderatesagainsttheawardofpermanentpartialdisabilitybenefitsbasedonthirtysevenandonehalfpercenttobotharms.Thesecondissueisresolvedinfavoroftheemployee.
