Theemployeeorclaimant,Perryman,isfortyyearsoldwithahighschooleducation.Shehasworkedfortheemployerfortwentyyears.In1994,sheinjuredherelbowatwork.Aspartofhertreatment,shewasrequiredtotakemedicationwhichcontainedblueandyellowdyes,whichwerealsousedintheemployer'smanufacturingprocess.Shehadanallergicreactiontothedyesaftertakingthemedication.  Asaconsequence,sheisnolongerabletoworkfortheemployer.ShereturnedtogainfulemploymentonOctober31,1994,thirteenweeksafterthebeginningofherinabilitytoworkbecauseoftheinjuryandtreatment.  TheproofofpermanencyconsistedofthefollowingfromthetestimonyofDr.SamuelRoweMarney,Jr.,aboardcertifiedspecialistinAllergyandImmunology:0   Q.Dr.Marney,Ms.Perrymannowhastheseallergies.Doyouhaveanopinionbaseduponareasonabledegreeofmedicalcertaintyastowhethershewillhavethoseinthefuture?0   A.Basedontheusualcourseofallergies,she'salmostcertaintocarrytheseallergiestherestofherlife.  Thetrialjudgeawardedpermanentpartialdisabilitybenefitsbasedonfortypercenttothebodyasawholeandtemporarytotaldisabilitybenefitsforsixtyfiveweeks.Thecompensationratewasfixedat$216.22.Appellatereviewisdenovoupontherecordofthetrialcourt,accompaniedbyapresumptionofcorrectnessofthefindingsoffact,unlessthepreponderanceoftheevidenceisotherwise.Tenn.CodeAnn.section506225(e)(2).  Exceptwheredisabilityisobvioustoalayman,afindingofpermanencymustbebasedoncompetentmedicalevidencethatthereisamedicalprobabilityofpermanencyorthatdisabilityisreasonablycertaintobepermanent.Kellermanv.FoodLion,Inc.,929S.W.2d333(Tenn.1996).Absolutecertaintyonthepartofamedicalexpertisnotnecessarytosupportaworkers'compensationaward,forexpertopinionmustalwaysbemoreorlessuncertainandspeculative.Id.  Dr.Marney'scompetenceisnotquestionedandhistestimony,fairlyread,isthatthereisareasonablemedicalprobabilityofpermanency.Theawardofpermanentdisabilitybenefitsisaffirmed.  Inmakinghisfindings,thetrialjudgeinadvertentlymisstatedthedateoftheclaimant'sreturntogainfulemploymentasOctober31,1995.Thejudgmentismodifiedtoreducetheawardoftemporarytotaldisabilitybenefitsbyfiftytwoweeks.  Disabilitybenefitsarecomputedonaweeklybasisandbasedontheinjuredemployee'saverageweeklywages,ortheearningsoftheinjuredemployeeintheemploymentinwhichshewasworkingatthetimeoftheinjuryduringthefiftytwoweeksimmediatelyprecedingthedateofinjury,dividedbyfiftytwo.Tenn.CodeAnn.section506102(a)(1)(A).  Wefindintherecordnodirectproofoftheclaimant'saverageweeklywagesduringthefiftytwoweeksimmediatelyprecedingtheinjury.Asaresult,thetrialjudgewasforcedtoguessattheappropriatecompensationrate.Itwouldservenousefulpurposetosubstituteourguessforhis.
