ÐÌJ.€Arthur€Crews,€II,€Jackson,€Tennessee,€for€the€appellant,€Marvin€Windows.Ð ¾ ÐÌDonna€Brown€Ô_ÔWilkersonÔ_Ô,€Jackson,€Tennessee,€for€the€appellee,€Ann€Phillips.Ð ž!î  ÐÌÔ  ÔÓ  Óò òMEMORANDUM€OPINIONó óÔ#†¼çt»XXí³Á#ÔÔ‡Xí³X»¼çtÔÐ ~#Î" ÐÌÓ  ÓÔ#†¼çt»XXí³¦ #ÔÔ‡Xí³X»¼çtÔÔ‡X¢XXXí³Ôà  àPhillips€was€forty„two€(42)€years€of€age€at€trial.€€She€graduated€from€high€school€andÐ ^%® $ Ðcompleted€a€vocational€school€basic€computer€class.€€Before€working€for€Marvin€in€1987€or€1988,Ð J&š!% Ðshe€worked€in€various€factories€as€a€machine€operator,€inspector,€order€picker,€and€clerk.€€She€beganÐ 6'†"& Ðat€Marvin€as€a€door€builder€on€the€assembly€line,€and€worked€in€the€subassembly€department€whenÐ "(r#' Ðshe€injured€her€back€on€September€10,€1996.€€Phillips€described€her€jobs€at€Marvin€as€ð ðlaborÐ )^$( Ðintensiveðð€and€required€lifting€on€a€frequent€basis.€€Prior€to€this€injury,€she€did€not€have€any€problemsÐ ú)J%) Ðwith€her€back.Ð æ*6&* ÐÌà  àOn€September€10,€1996,€Phillips€was€lifting€a€bundle€of€door€panels€when€she€felt€a€pop€inÐ ¾,(, Ðher€low€back€with€pain€in€her€back€and€left€leg.€€After€reporting€her€injury,€she€was€sent€toÐ ª-ú(-ý ÐDr.Tucker€at€the€Ripley€Clinic.€€Dr.€Tucker€gave€her€medication,€put€her€on€light€duty€for€two€weeksÐ ° Ðand€referred€her€to€Dr.€Ô_ÔCanaleÔ_Ô€in€Memphis.€€On€the€date€of€her€appointment,€October€29,€1996,Ð œì ÐDr.Ô_ÔCanaleÔ_Ô€was€not€available,€so€she€saw€Dr.€Ô_ÔFereidoonÔ_Ô€Ô_ÔParsioonÔ_Ô.€€Dr.€Ô_ÔParsioonÔ_Ô€examined€her€andÐ ˆØ Ðfound€a€full€range€of€motion€in€her€back€and€diagnosed€her€condition€as€low€back€pain.€€Dr.€Ô_ÔParsioonÔ_ÔÐ tÄ ÐÑ€rÑordered€a€MRI€which€disclosed€very€mild€degenerative€joint€disease€in€her€lower€facet€joints.€€HeÐ `° Ðfelt€Phillipsðð€back€pain€was€probably€related€to€her€facet€arthritis€and€recommended€a€nerve€block.Ð L œ ÐÌà  àDr.€Gary€Ô_ÔKellettÔ_Ô€saw€Phillips€for€a€second€opinion€on€November€29,€1996.€€He€also€foundÐ $ t Ða€full€range€of€motion€in€her€back.€€Her€MRI€showed€degenerative€changes€of€the€lower€joint€lumbarÐ  ` Ðfacet€joints.€€Dr.€Ô_ÔKellettÔ_Ô€stated€her€examination€and€symptoms€suggested€lumbar€Ô_ÔradioculopathyÔ_Ô.€€HeÐ ü L  Ðalso€recommended€the€nerve€block€which€was€performed€and€temporarily€relieved€her€back€pain.Ð è 8  ÐÌà  àBecause€her€symptoms€continued,€Phillips€asked€to€see€another€doctor.€€She€was€seen€byÐ À  ÐDr.Riley€Jones€in€Memphis€on€October€24,€1997.€€Dr.€Jones€ordered€a€bone€scan€and€Ô_ÔEMGÔ_Ô,€whichÐ ¬ü  Ðwere€both€negative.€€He€diagnosed€mild€Ô_ÔfascialÔ_Ô€pain€and€referred€her€to€physical€therapy€for€three€(3)Ð ˜è  Ðweeks.€€A€physical€therapistððs€report€indicated€severe€back€dysfunction€and€recommended€a€non„Ð „Ô  Ðbending€job.€€Phillips€felt€the€physical€therapy€did€not€help€her€and€she€went€to€Dr.€Siad€in€CovingtonÐ pÀ Ðon€her€own€and€received€additional€nerve€blocks,€which€offered€some€relief.Ð \¬ ÐÌà  àDr.€Joseph€Ô_ÔBoalsÔ_Ô€examined€Phillips€for€an€independent€medical€evaluation€on€August€18,Ð 4„ Ð1997.€€On€examination,€he€found€a€full€range€of€motion€and€x„rays€showed€moderate€joint€arthritis.€Ð  p ÐDr.€Ô_ÔBoalsÔ_Ô€diagnosed€her€condition€as€facet€joint€arthritis€of€the€lumbar€spine€which€was€either€causedÐ  \ Ðby€or€aggravated€by€her€work.€€He€assigned€a€seven€percent€(7%)€permanent€impairment€to€the€bodyÐ øH Ðas€a€whole€and€suggested€lifting€restrictions€of€fifteen€(15)€to€twenty€(20)€pounds€with€possible€futureÐ ä4 Ðmodification€if€she€improves€and€for€her€to€reduce€her€bending€and€twisting.€€Doctors€Ô_ÔParsioonÔ_Ô,Ð Ð  ÐÔ_ÔKellettÔ_Ô,€and€Jones€did€not€place€any€restrictions€on€Phillips€or€find€she€had€any€permanentÐ ¼  Ðimpairment.Ð ¨ø ÐÌà  àPhillips€continued€to€work€at€Marvin€at€the€same€job€and€pay€for€approximately€one€(1)€year.€Ð €Ð ÐShe€then€changed€jobs€to€the€bundling€department,€which€requires€less€bending€and€twisting€andÐ l¼ Ðlittle€or€no€overtime.€€At€trial,€Phillips€testified€her€back€injury€limits€her€ability€to€lift€and€to€sit€orÐ X ¨ Ðstand€for€long€periods€of€time.€€She€takes€pain€pills€and€uses€a€heating€pad€to€relieve€her€pain.€€SheÐ D!” Ðis€able€to€do€her€present€job€at€Marvin,€but€would€be€unable€to€do€many€of€her€former€jobs€due€to€herÐ 0"€  Ðback€injury.Ð #l!
