Thetrialjudgefoundtheplaintiffhadsuffereda25percentpermanentpartialdisabilitytohisleftfoot.Thedefendantsaystheevidencepreponderatesagainstafindingtheplaintiffhadsufferedanypermanentimpairment. Weaffirmthejudgmentofthetrialcourt. OnMay25,1995,asteelbeamfellupontheplaintiffsfoot,causingafractureofthefoot. Themedicaltestimonyinthiscaseisnotextensive.Dr.LarryDavidJohnson,anorthopedicsurgeon,wasthetreatingphysician.Dr.Johnsondiagnosedtheinjuryasanondisplacedfractureofthefirstmetatarsalboneofthe[left]foot.Dr.JohnsonsawtheplaintiffonMay23,1995fortheinitialexamandonfouroccasionsafterthat.Hetestifiedtheplaintiffrecoveredfromtheinjuryinduecourse.Dr.JohnsonreleasedtheplaintifftoworkonJuly5,1995andfoundhehadreachedmaximummedicalrecoveryatthattime.Dr.JohnsonexaminedtheplaintiffonAugust16,1995andfoundthefracturehadhealed.Dr.Johnsonfoundtheplaintiffsufferednopermanentimpairmentfromtheinjury. Dr.RobertJ.Barnett,anorthopedicsurgeon,examinedtheplaintiffinJune1996.Dr.Barnettfoundthattheplaintiffwascontinuingtohavepaininhisfoot,thathehastowalkontheoutsideofhisfoot,andthathehadsomeswellinginhisleftfoot.Dr.Barnettstestimony,whenreadincontextoftheinjuryinquestion,isthattheplaintiffsustaineda14percentpermanentpartialimpairmenttohisleftfoot. ThedefendantasksthatDr.BarnettstestimonybedepreciatedbecausehisnotesshowedtheinjuryoccurredMay22,1994ratherthanMay22,1995.WhenthedefendantaskedDr.Barnettiftheinjuryoccurredin1995ratherthan1994 thenwedbetalkingalittledifferentsituation,wouldntwe,Dr.Barnettanswered couldbe.The couldbewasneverexploredbeyondthis.Dr.Barnetttestifiedsubsequentlythatthedifferencesindateswouldnotchangeanyopinionhegave. Theplaintiff,whowas45yearsofageatthetimeoftheinjury,hasahighschooldiplomaandoneyearorlessofcollegeeducation.Hisskillsareprimarilythatofaproductiontypeworker.Atthetimeofthetrial,theplaintiffwasworkingatMaytagApplianceCompanywiringwashers. Theplaintifftestifiedhisfootwouldswellandhurtifhestoodallday.Hetestifiedbecauseofthepainhehadtowalkonthesideofhisfootandthiscausedhisbacktohurt.TheplaintiffsaidhewasabletoworkatMaytagbecausehesatdownmostoftheday. Wereviewthiscasedenovoupontherecordwithapresumptionofthecorrectnessofthetrialjudgesruling,Tenn.CodeAnn.506225(e)(2),andweweightheevidenceindepthtodeterminewherethepreponderanceoftheevidencelies.Cooperv.InsuranceCo.ofNorthAmerica,884S.W.2d446(Tenn.1994). Theonlyissueinthiscaseiswhethertheplaintiffisentitledtorecoverforanypermanentimpairment. ItseemstousthecaseofThomasv.AetnaLife&CasualtyCo.etal,812S.W.2d278(Tenn.1991)resolvestheissueinthiscase.InThomas,thecourtsaid: Whenfaced,ashere,withconflictingmedicaltestimonyontheseissues,itiswithinthediscretionofthetrialjudgetoconcludethattheopinionofcertainexpertsshouldbeacceptedoverthatofotherexpertsandthatitcontainsthemoreprobableexplanation.Id.at283. Further,thetrialjudgemayaccepttheopinionofoneormoreexpertsovertheotherorotherswhenthereisadifferenceintheiropinions.Johnsonv.Midwesco,Inc.,801S.W.2d804(Tenn.1990). Thedefendantcorrectlypointsoutthatthiscourtmayevaluatethecredibilityofwitnesseswhotestifybydepositionascanthetrialcourt.Hensonv.CityofLawrenceburg,851S.W.2d809(Tenn.1993).However,weareoftheopiniontheexerciseofreweighingofevidenceshouldbedonewithcaution,andthecredibilityofadeponentshouldnotberejectedunlessthereissomeclearshowingthetestimonyisnotbaseduponexistingfactsintherecordorwherethetestimonyispatentlynotbelievable. Further,thedefendantsaystheSupremeCourthasheldthatincertaincircumstancesthetestimonyofthetreatingphysicianshouldbegivenmoreweightthanthetestimonyofanexaminingphysician.Wedonotregardthatviewtocompelthetrialcourttogivethatdegreeofweightinallcasesbutthatitmerelysaysthetrialjudgemaydoso. Thetrialjudgesawandheardtheplaintifftestify,heweighedhiscredibilityandthatofthemedicalevidence.Wecannotsaytheevidencepreponderatesagainstthejudgmentinthiscase.
