àWe€affirm€the€judgment€of€the€trial€court.Ìà àThe€plaintiff€is€now€69€years€old.€€He€has€been€receiving€old€age€retirementÏbenefits€from€the€Social€Security€Administration€and€from€the€œdefendants›€sinceÏFebruary€6,€1991.€€He€has€applied€for€black€lung€benefits€from€the€U.€S.€DepartmentÏof€Labor€on€three€occasions.€€Two€of€those€applications€were€denied.€€TheÏœdefendants›€sought,€by€Motion€to€Consider€Post„Judgment€Facts€in€this€case,€to€haveÏthe€results€of€the€third€Department€of€Labor€adjudication€admitted€as€evidence;Ïhowever,€the€Motion€was€denied€as€inappropriate€under€òòRuleóó€14(a),€òòTenn.€R.€App.€P.óóÌà ðChest€x„ray€done€on€re€above€listed€individual€on€April€28,€1971,€isÏinterpreted€as€showing€small€rounded€opacities€in€the€two€lowermostÏlung€zones€on€both€side€of€the€thorax€which€fit€category€P„1/1Ïaccording€to€the€U/C€classification.€€IMPRESSION:€Coal€WorkersÏPneumoconiosis.ððÌÌÓ  ÓÓÓà àThe€trial€court,€while€acknowledging€that€plaintiff€has€black€lung,€found€thatÏthe€plaintiff€failed€to€carry€the€burden€of€proof€that€he€was€totally€disabled.€€OurÏreview€of€the€findings€of€fact€made€by€the€trial€court€is€òòde€novoóó€upon€the€record€ofÏthe€trial€court,€accompanied€by€a€presumption€of€the€correctness€of€the€finding,Ïunless€the€preponderance€of€the€evidence€is€otherwise.€€òòTenn.€Code€Ann.€ððóó€50„6„225(e)(2).€€òòStone€v.€City€of€McMinnville,€óó896€S.W.2d€584€(Tenn.€1991).€Ìà àœThe›€evidence€on€the€issue€of€whether€the€plaintiff€has€met€his€burden€of€proofÏincludes€several€medical€depositions,€including€that€of€Dr.€Glen€Baker,€Jr.,€œa€board„certified›€internist,€œpulmonologist,›€and€ð ðBðð€œreader›€who€evaluated€plaintiff€at€theÏrequest€of€his€attorney€on€October€6,€1993.€€Dr.€Baker€diagnosed€job„related€2/2Ïcoal€workersðð€pneumoconiosis€which€he€opined€was€100€percent€occupationallyÍdisabling.€€He€also€testified€that€plaintiffððs€pulmonary€function€testing€and€blood€gasÏreports€did€not€qualify€œplaintiff›€for€black€lung€benefits€according€to€federal€criteria.Ìà àDr.€Richard€E.€œParrish,€a€board„certified›€internist€and€œpulmonologist,›€alsoÏtestified€by€deposition.€€He€first€saw€the€plaintiff€in€œApril›€1991,€after€Mr.€RutherfordððsÏretirement,€on€referral€for€evaluation€by€the€Department€of€Labor.€€Dr.€Parrish€alsoÏopined€plaintiffððs€chest€x„ray€revealed€a€2/2€classification€for€pneumoconiosis.€ÏHowever,€his€pulmonary€function€tests€revealed€normal€lung€function€at€that€time.Ìà àDr.€Norman€Hankins,€vocational€expert,€testified€by€deposition€that€heÏconducted€a€vocational€assessment€of€œplaintiff›€on€November€16,€1994.€€He€opinedÏthat€plaintiff€would€be€limited€to€sedentary€work€and€that€there€were€no€jobs€in€theÏlocal€market€that€he€could€perform,€therefore€he€would€be€considered€100€percentÏvocationally€disabled.Ìà àœThe€plaintiffððs€wife€testified€that€he€left€his€job€with€Cross€Mountain€becauseÏhe€was€not€able€to€do€the€work.€€His€strength€was€gone€because€of€his€hardÏbreathing.€€He€had€shortness€of€breath.€€He€could€not€sleep€because€of€hisÏshortness€of€breath€and€was€deteriorating€overall.Ìà àThe€Plaintiff€testified€that€he€had€to€quit€his€job€because€he€could€not€breatheÏand€he€could€not€sleep.€€He€would€have€prefered€to€go€on€working.€€After€he€leftÏCross€Mountain€his€lungs€became€worse€instead€of€better.€€He€worked€every€day,Ïbut€he€did€have€a€lot€of€problems.€€He€never€complained€or€talked€with€managementÏof€Cross€Mountain€about€health€problems€that€he€was€having.Ìà àMr.›€Robert€Brandonburg,€plaintiffððs€supervisor,€testified€at€trial€œthat€plaintiff›Ïnever€missed€work,€never€complained€to€him€about€any€breathing€œproblem,›€andÏnever€appeared€to€have€any€breathing€problems€at€work.€€He€stated€œthat€plaintiff›€toldÍhim€the€reason€he€was€retiring€was€that€ð ð€.€.€.€he€worked€all€of€his€life€and€he€wantedÏto€enjoy€what€he€could.ðð€€Ìà
